Review: Some time last year, I signed up for what was advertised as a month-to-month plan at this gym (formerly Evolutions, now Life Health & Fitness). I decided to simply let my membership end once the credit card they had on file expired. I had assumed that, since I was on a monthly plan, they would simply cancel my account when they no longer had a chargeable card; however, they continued to bill my "account" without my consent until I began receiving calls from a collection agency for over seven months worth of membership fees that I did not owe. At one point, I had even specifically called them and told them to cancel my account and yet they continued to charge my account. They had clearly misrepresented the plan as "monthly" when I signed my contract and I am outraged that, even after specifically calling them and telling them to cancel, they continued to charge my account.Desired Settlement: All of the membership fees that they claim I owe must be dropped.

Review: My partner and I own a company for workout material. This is a new company that we recently established. We spent lots of our tome and money to establish this business. In order to promote our company my partner and I have reached out to different gyms in person. We went to life, health, and fitness several months ago and spoke with manager [redacted]. My partner, myself and [redacted] verbally agreed to providing life, health and fitness with 50 pairs of workout material to sell on consignment.This meant that once the fitness material was sold we would receive 40 percent of the pay and life, health and fitness would receive 60 percent of the money. In order to promote our product we also set up a table and had clients trying them out in the facility and once they presented with interest we directed them to buy them personally from life health and fitness. we did not make any money for promoting the equipment for the gym. at this time all 50 workout materials ghat were provided on consignment as per verbal agreement have been sold. We have been contacting the manager [redacted] as well as the owner [redacted] over the past 2 months they have been ignoring all attempts of communication. My partner and I came to collect the money today on 12/**/13 and [redacted] refused to pay indicating that we gave them the material for personal use. He indicated that he did not sign anything and that his word and negotiation of rate and amount to split is not binding. He is in turn lying as well as stealing.Desired Settlement: We would like to be paid the amount that was agreed upon which is $600. There should be no reason why life, health and fitness should keep 100 percent of profit when the agreed upon amount was 60 percent.

Review: Employees are not fully aware of the business's policies such as sign up and cancellation procedures and even the owner did not inform to me clearly when signing up. I do not understand how they would have the authority to register people in the gym if employees arent aware of standard policies.None of the employees had told me about the policy when I brought the issue of cancelling membership. Before calling the gym on the last Friday of January 2014, I had called earlier in the month asking what I had to do to cancel my account and the employee I had spoken to just said I had to come in and sign some papers to confirm cancellation and so that I would not be billed for February. She had said nothing about the 30-day notice.When I called in on Friday because I knew I could not make it on the [redacted], the employee I spoke to told me there would be no problem to not be billed for February and I could just come in during the weekend and she would leave a note confirming a freeze on the account. She also did not mention any 30-day notice.When I went in on Sunday the [redacted] of February, I found out I was billed anyway automatically to my credit card. The person at the reception also did not mention any 30 day notice, and told me he did not know what happened and rather resolve the matter with the owner, [redacted] through email. If I had been informed of this policy when signing up, I most likely would have acted beforehand or not file this complaint.The owner had told me that the 30 day policy was first a club policy and then after my second email he elevated his stance by saying it is NY State Law and this 30 day policy applies to ALL MEMBERS of the gym. It did not make sense he said that because two friends of mine had requested their year membership be cancelled and that did not require a 30 day notice.Desired Settlement: Refund of February fees but more importantly a full due diligence on the business whether the employees are aware of Business policies and state laws related to the business. If they do not know these policies, I do not understand how they have the authority to sign a new member up for the businesss
