I am cancellaing your membership effective with today's date with nothing further due.Our cancellation procedure is not confusing, all information is clearly stated under the Terms and ConditionsThere will be no refunds as you aleardy charged back $You only placed your membership on freeze for month, signed documentation was scannedYour cancelled membership has been notated with the above information

Good Afternoon,Please find attached a copy of your signed and initialed contract along with the Terms and ConditionsYou also received a copy of this contract when you joined with *** on August 15, The contract is set up that we collect 1st month dues and last month dues1st month dues
covers membership from begin date of August 15, to September 14, Last month dues covers last month providing day notification is provided directly to *** *** (via email- we have simplified this for our members) as is stated on the Terms and ConditionsYou froze your membership beginning with the September 15, invoice with a freeze rate of $(the freeze date must coincide with your billing dateThe Freeze policy is also stated on the back of the terms and conditions. On September we received a cancellation letter dated 09/28/with the same postmark date on the envelope (both of these were scanned in upon receipt) On 10/02/ 15, *** one of our membership consultants called you regarding the cancellation letter (per the Terms and Conditions- all cancellations are processed via *** ***On 10/you returned ***'s call and he was not available to take your callHe replied on the very same day, again leaving a voicemailThere is no further communication documented at the club level from that pointOn 10/5/you emailed *** *** requesting to cancel your membershipYou were charged $on 10/15/which you are responsible for and you placed a chargeback with your credit card company*** *** also applies a fee to Evolve Fitness for all Chargeback.If payment of $is collected then I will waive the annual service fee of $as a courtesyYou will need to go into the club to make the payment, once payment has been received I will waive the $and personally cancel your membership.You may contact me directly at *** *** ***, Sr Operations Manager

In fact the business acted improperly and illegally as my son DID cancel the membershipEvolve seems to have a pattern of ignoring cancellationsEven so, the account has finally been cancelled and that was my desired outcome

Please be advised the membership was cancelled: However please be advised- the reason the membership was not cancelled in the first place- is because memberships may not be cancelled by anyone other than the member themselvesIf the member is under then we will allow for a parent to cancel
Also, in order to cancel for Military- Orders must be received from the military branch for verification that the member is actually leaving for militaryMilitary paperwork was not providedMembership has been cancelled as a courtesy this time

My Apologies for not responding sooner, I am out of the country and finally received internet accessI just reviewed the internal datatrack notes from ***There is no record of them recieiving an emailThere are several conversations from club notes, member was provided with cancel information
Please submit original email that was sent to *** with date and time stamp and I will reviewIf there was an error, I would be more than happy to refundHowever if proof can not be submitted then past due is owedMember did receive a copy of his contract with full disclosure and an additional copy sent upon my approval of contract with full disclosures

I was already charged for the last month at sign-up time.
And at the time I was assured that any other fees, including the annual
enhancement fee, would be waived as the relationship was not going to be any
longer than two months. The in-person request to cancel the account around
September 10 was changed to account ‘freeze’ at the recommendation of your
staff. It was taken in good faith but it has apparently resulted in further
charges and extending this relationship to beyond 60 days. Your confusing
cancellation policy has made it difficult even for this organization to fix the
final month and stop charging my account. Even with the freeze, the last month
is October and the sign-up charges covers that month. This relationship was based on good faith and was intended
for a short duration during which I was hoping to take advantage of their staff’s
expertise. That window closed in September and was inadvertently extended by
the ‘freeze’ to October. They received full payment for all three months; two
regular charges and one freeze charge. Any deviation from their policy notice
requirements can be easily explained by scheduling difficulties on all sides or
recommendations made by their staff. Again, this is all based on good faith.
