Complaint: [redacted] I am rejecting this response because: Let us make this perfectly clear, at no time did my daughter in any way threaten you! What she told you was that any time a customer is unhappy or feels that they have been cheated or treated unfairly, that they will typically go and tell at least other people Anyone that knows anything about business usually knows this statistic Unfortunately for you, she was just telling you realistically what can happen and what usually does happen People (customers and consumers) have a right to voice their opinions about a business and there is nothing that you can do about it except strive to be a fair and ethical businessowner This is not a threat, it is the right of free speech If you are not fair to your customers then these are the consequences This is why we have the Revdex.com, to look out for the customer and ensure people are being treated fairlyNo matter how much you would like to change what my daughter had said to you into your own twisted and uneducated perceptions, maybe you should take a look at yourself and stop continuing to try and personally attack my daughter As I mentioned before, she has an MBA, is experienced in Business Consulting, and Business Ownership She was basically only trying to offer you some sound business advice My daughter is a professional, ethical and responsible business leader and therefore she if very good at recognizing when things are wrong or unfair She has taught me a great deal about businessand that is why I can now recognize these issues as well It is clear that you are only trying to avoid taking responsibility for yourself and your own unprofessional and poor business practices By doing this, you are trying to avoid or acknowledge the issues I have presented to you and the basis for my complaint with the Revdex.comIf at any time I am unhappy with a business’s practices, if my daughter is unhappy or whomever may be unhappy with your business then each individual has a right to complain and to tell others That is not a threat that is the reality You need to be a responsible, business owner and leave my daughter out of itThese are the facts of my case against you:(1) Illegal business practices: I have a legal right to have a copy of the contract for which I have signed and it was your responsibility to have given it to me I should not have had to ask for it I would say that your refusal to give me acopy of that contract is probably illegal, which could make your “no refund policy” null and void (I don’t know, I am not a lawyer, but I will find out) As for my not asking for a copy at the time,well, I came there after getting off work, I was tired, I probably either forgot to ask or did not think to ask, I am years old As far as my not reading the document clearlyat the time, well, I happen to have Glaucoma and I cannot see or read very well in that kind of light I usually take paperwork home that is given to me and then read it more thoroughly later I do understand that most contracts have a cooling off period were the customer has time to change their mind so it is usually fine If I would have been given a copy as I should have this whole thing may have been avoided It was your responsibility as the business owner to ensure that I was given one upon signing it.(2) Misleading business practices:You were misleading in the way you acted that it would be very easy to stop the payment from going through if we wanted to cancel Because you acted like this was no big deal we trusted you If you wanted to ensure that we clearly understood you would have made sure and given us all documentation, or verified with me that I understood.(3) Deceptive business practices: When I came in to fill out the cancellation request, if your employee already knew that the money was going to come out of my account and that it was already too late, then why did she go ahead andcontinue to let me fill it out and believe that the payment would be cancelled? Why didn’t she tell me in the first instance? Even though this was and employee, it is still your responsibility to train your employees properly In addition, when I then came in and asked for a copy of the cancellation the same employee gave me a cut-off copy of the document, and no, this was not the only information that wasimportant The entire form and everything on it is important and I should have been given full disclosure This is unethical.(4) Unfair business practices:It is unfair that after letting you know that we would be out of town and not able to use your facility, and your allowing me to fill out a cancellation form believing that it would not come out of my account It is unfair and deceptive that you took the money and want to keep it for something we cannot use If you want to keep the $and this makes you feel good to take and keep my money through automatic debit knowing that I cancelled and would be out of town, then does this mean that you would allow, basically, $to ruin a business- to- customer relationship, and potentially risk tarnishing your business reputation with the Revdex.com? I will not accept or respond to any more of your comments By you misrepresentations of my daughter’s words, your pointless weak arguments and personal attacks and accusations toward her or me you are only proving my case against you That you are not being a responsible business owner and have used unethical, unfair, misleading, deceptive, irresponsible and possibly illegal business practices I feel that I have argued my case sufficiently to the Revdex.com and I have been able to demonstrate the evidence for my reasons of each of the issues I have stated above and previously At this point I would like to let the Revdex.com make a decision about whether you deserve to proudlypost their sign on your place of business and I hope that they will see that I have been treated unfairly and recommend that you pay back the money you took from me where I received nothing in return I also hope that this will be posted publicly so that others can beware of these kinds of business practices Regards,*** ***

I am rejecting this response because: This business owner has shown a pattern of lies That is not what my daughter said but, once againshe wants to twist the truth to suit her needs and cheat me out of my money She wants to hide behind the word "refund", just like she ran off today and hid when she knew I was coming to meet with her Like a coward, she leaves teenagers there to do her dirty work A refund would mean that I wanted my money back after use of the facility However, I have evidence that I cancelled the contract and she took the money anyway, so it is technically not a refund She knows that me and my daughter will not be able to use the facility this month because we will be out of town She did what gym owners are notorious for doing and that is using auto-debit to take money from customers after they cancelled their contract My daughter, who has an MBA and experience as a Business Consultant, merely suggested that it would not be wise to treat customers in such an unfair manner Therefore, I stand by what I said before and that is that I was not clear on the cut off being the 1st and did not have the opportunity to read the contract because she did not give me a copy and it was refused to me when I ask for it again I feel she uses misleading, deceptive, unfair, unethical and illegal business practices She wants to keep money for something I cannot use I deserve to have my money given back!

Business called stating that they refuse refund consumer

Per the agreement that was signed by Mrs ***, It does state that you give days notice to stop billing or you will be billed an additional month. Our Drafts are all batched up on the firstI made a copy of this and a copy of her agreement which she never picked up. We are a small
town business and do not enforce the day noticeWe are nice and ask that customers give us about weekdays before the end of the monthMrs *** came in ON THE FIRST and I did inform her that her membership was good until the end of the monthHer drafts hit her account possibly on different days but our records show the 1st alwaysI made copies of the computer printout showing her where our drafts occur on the 1st every month and it also states on the draft authorization SHE SIGNED that they come out on the 1stIt is yet again on the agreement she signed

I will not be bullied. She also stated "you're the owner, you can bend the rules. So clearly she knows she is trying to get around something. I Don not have to defend my schedule and I have every confidence in the maturity and knowledge of my employees. It does not matter who explains it to her, the information will be the same. The paper Mrs [redacted] signed will not look any different. I'm sorry she got a copy cut off. U DID Ask TO SEE THAT BUT I Believe THE Information that was important to this matter was visible. If not I'd be happy to provide Mrs [redacted] with another.
