Our policies are clearly outlined in the agreement she signed.  It clearly states that it has to be a permanent disability, and financial hardship for any agreement with any company does not allow anyone to be released from the agreement they signed.  [redacted] is not a co-owner...

Initial Business Response /* (1000, 6, 2015/06/22) */
We have attached copies e-mails, text messages, detailed notes on conversations, and his agreement he signed. This information will show that [redacted] was fully aware of what he was committing to when he signed up with us and is using threats and...

slander to try to manipulate his out of this responsibility. The letters will show that in no way were we harassing him, that our communication was professional and in attempts to help him avoid late fees and collections and answer his questions and statements he was making via e-mail. We will also show that his claims against our integrity are in fact a reflection of his own.
We would like to first start off that the complaint filed against us is inconsistent. [redacted] says at the end of his complaint "At no point was I told when I signed up that I would be obligated to pay" however he stated in the beginning of his complaint "Note the 6 months he told me I was signed up for, 9 months instead" As far as him stating that we told him not to read what he is signing is just silly. If anyone would every tell that to someone "not to read" what your signing, and you signed it anyways, that is just irresponsible as a consumer and bad business. We have over a hundred clients that are current members and go through the same enrollment process that [redacted] did.
ALL OF THE INFORMATION BELOW IS PULLED FROM DOCUMENTED ACCUNTS THAT [redacted] HAS/HAD FULL ACCESS TO BEFORE HE FILED THIS COMPLIANT.
Below is the outline and notes of how we tried to help [redacted] with him membership questions and problems, and how we came to find out that he was being dishonest to get out of his program.
MAY 18th 11:45am
[redacted] first contacted the school that his schedule changed and wanted to cancel his membership.
Dear [redacted],
Name: [redacted]
PhoneXXXXXXXX
Email: XXXXXXXX
Message: [redacted], I was taking the Tuesday krav maga class however a recent work schedule change prevents me from continuing so please discontinue my membership. If my schedule changes I will happily re-enroll, I just can't do anything right now. Thanks
MAY 18th 12:05pm
[redacted] called and spoke to him for 9 minutes 29 seconds.
[redacted] Notes:
I gave him alternative times to come to class, he said no, he just wanted to cancel. [redacted] was informed that he can only cancel if he moves or is disabled. He was reminded about our FREEZE POLICY: Students can freeze their membership for 2 consecutive weeks or more for up to 1 year. Freezes must be submitted by e-mail before the absence. Freezes add time to the end of your membership for free, however you are still billed during your regular billing schedule.
[redacted] asked, "What happens if I just decide not to pay" He was told that our billing company would still honor the agreement that he signed and he would also be required to pay late fees and possible collects fees if he decided not to honor his agreement with us and them.
[redacted] said that he would need to Freeze his membership until January of 2016 and start back then.
Special Notes on Freezes
This summer we have 32 members on freeze over the summer. Some are collage students returning this fall. Some are parents taking their family on vacation, some just for personal reasons. NONE of the families were confused about this. They are happily returning when their time permits. The school can stay open and functioning while people handle their person agenda, and they get to use what they paid for when they come back.
JUNE 1st 5:00pm
Evolve received a letter that [redacted] authorized a chargeback for his May 15th membership of $75. Our Bank charges us $25 for chargebacks, and our merchant account charges us $30 for chargebacks. Total loss $130 for the business. At that point his payment is now late, so our billing company will charge his account $30. So now [redacted] owes $160 for being late, tuition, and late fees and charges that he is committed to pay us as outlined in his agreement he has signed.
June 1st 5:24pm and 5:25pm
S.O.P is that [redacted] needed to contact him to see what was going on, and to correct any issues to prevent [redacted] from owing late fees.
[redacted] Hung up when [redacted] Identified himself, so [redacted] tried to call again, and [redacted] hung up on him again.
[redacted] sent [redacted] this text afterwards:
"My billing company has sent you a email. Please read it, our phone conversation we had on the 18th is in conflict with your actions. They are asking me to put you in collections tomorrow. I am willing to hear back from you on this before I must move forward.
From here, we refer to the attachment on this case titled "[redacted] Revdex.com E-mails" They were too long to copy in this section.
We would also like to point out that in his agreement he signed, the top 3 sections redundantly outline that he was signing up for a term agreement.
Our Billing Company and his Bank have all received copies of these e-mails and agreements and have found that [redacted] is liable for the terms he agreed to. Since he has put a hold on his card, they can no longer be billed. That is why we can only accept a check from him.
We hope that the Revdex.com will close this case due to the facts we presented above and the attached letters and agreements for your review. In all accounts, The staff answered him quickly and professionally.
