addition, some of our time and effort into a phase is put towards research, design and meetings, rather than the production of documents. Our contract was terminated by the client prior to the completion of documents. Therefore the PDF's that have been sent to the client for review are the best drawings available. We did not continue to work on the project after we were terminated. I've included one of the last sets of the PDF's which have previously been sent to the client. I've also included the contract which states that we are to be paid through the end of the phase prior to releasing drawings. We have not invoiced or been paid through the end of the phase, though the contract states that we shall prior to releasing the drawings. However, I've decided to not invoice for the additional fees and just send where we were when the project was terminated so that we can all move on. Its unfortunate that we were not able to finish the project, but as you'll see we've never had a complaint in 10 years of business and we have over 35 people working at EVstudio. [redacted]Colorado Architect and Principal, EVstudio

I am rejecting this response because:We still have not been provided with all of the documents generated...all layout versions and drafts of exterior elevations in particular. Our architect told us in a face-to-face meeting that he had sketches of exterior elevations that he would show us at our next meeting (which he failed to produce at that time), and now we are being told that they don't exist. Was our architect being dishonest, or is this response from EV Studio dishonest? In an email to us dated September 24, 2015, Mr. [redacted] accepted our termination, stated that we would not be billed any more than had already been invoiced and paid, and that "we're happy to provide them [our new design professional] with anything that we've created to date." Why Mr. [redacted] now states, "I'm not sure what was said about delivering it to an architect..." is inexplicable. All we want are ALL of the documents generated that we have paid for. If EV Studio had put half the effort into working with us to generate an acceptable design as they have into stonewalling us and not providing us the documents we paid for, we would already be living in our dream house instead of continuing to live this nightmare.

Hello [redacted] and the Revdex.com,The contract is quite clear that we are paid through the end of the phase, we don't rescind that portion of the contract we're just not bothering to invoice it as a show of good will. The contract offers that we are doing a topographic survey but that is not a document that would be signed. Basically the information on the ILC that you provided is what the county would want signed by your previous surveyor, but it is not fully adequate to design off of, therefore we added topography for the purpose of design. This is the first time that you've requested it, so I'm happy to attach it here. The elevations that we did we sketches and massing that we would have generated a drawing from when we had sign-off on a floor plan. The Revit software that we use generates information in three dimensions but if you are only looking at it in a plan view, the elevation views are just massing without detail and unresolved volumes. The floor plan continued to change and it did not reach a point of conclusion at the end of the phase and therefore it wasn't a real deliverable. The structural work is purely calculations and meeting and didn't produce drawings. Again, this is why our contract is structured in phases, we have to complete the phases to have deliverables. I've tried to think of a good metaphor, but there isn't one, we have an electronic system where we input information and prior to inputting all of the information we don't have a result. At the same time, if you do choose to hire another architect and they can tell us what software they are working in we may be able to give them some information. I'm not sure what was said about delivering it to an architect but you may not realize that each annual release of Revit and/or AutoCAD is only compatible with that release so we'd have to try to save it to the release they are working on, unless of course they are working on another non-Autodesk software. There's also a lot of prioprietary work that goes into our templates, literally thousands of hours, so we have to extricate the information that they need from our system. That's at least part of why our contract only requires us to release PDF's, architects have a copyright on all of our intellectual property, which includes the layouts that we've generated in the PDF as well as CAD but again I'm happy to try to work with the next architect and go above and beyond our contractual duty. I hope that helps and answers all of your questions.
