I contracted with customer at the beginning of November, 2015. The contract was to paint a very large house in two separate stages. The house, which was still under construction, was promised by customer to be completed and ready for paint no later than December, 2015. The painting of the house took four separate stages, due to the customer changing her mind in other aspects of the construction. After we completed three stages of interior painting, the customer contacted me on February 26, 2016 to finish the final section of painting of the house and garage. The customer told me the house was ready to go and we could get started at any time. I told the customer I would bring a full crew to complete the final stage of painting once I received a draw on the outstanding balance she owed me. These draws were written into our contract, and she signed the contract in agreement to these terms. The draw was for already completed work, as well as partial payment toward future contracted work. She complied and sent a payment for $2,500.00. I showed up on the job site a few days later (which was an hour drive each way) with a full crew only to find the drywallers were still hanging drywall in the areas we needed to paint. We had to leave the job site, since it was not ready for us. I texted the customer and told her the situation and she contacted me back less than a week later and told me everything was ready for us.I and a full crew showed up on the job site the very next day. Again, we found the drywallers still working on the drywall in the areas we needed to paint We left once again. A few days later, the customer said the walls were ready for us now so we went back. We primed two coats on all areas except for stairwell and garage, due to the fact that there was no more primer, which was to be supplied by the customer as stated in the contract. I contacted the customer again and told her we would need a $1,000.00 draw on the balance of $2,500.00 before we could come back to finish the job. She refused to pay and after many correspondences to try to get her to comply with the contract, she refused and said she was going to hire someone else to finish the job, even after I knocked $500.00 off of the final balance as an incentive to get her to pay. We have a total painting time of nine days on her job, and had about an hour and a half left for priming and about four hours left to spray the already primed areas with a single coat of paint to finish total contract when she refused to honor the contract.
