We have met with Andy and Asa to go over our list of items that need fixed(August 25th 2017)They did show up and do some work, but not allThe floor of the home still needs some blocking for the deflectionIf the blocking doesn't work we have talked about a beam. They are also going to replace some siding that is scraped pretty bad in spotsPlus a few other items on the listWe would like this work finished soon as possible (one or two weeks) Therefore I would like to postpone signing of the ATA until then to allow them time to fix problems(one or two weeks).Thanks ***

I am in receipt of your email dated today (5131) in regard to a complaint filed by [redacted], I have read the complaint in its entirety and...

the facts of the matter are described below. 1) Start and completion dates; please see this paragraph out of the signed contract: V. Start and Completion Dates: General Contractor shall be entitled to COMMeriCe withthe work immediately upon securing a Building Permit. Said work shall be completed within 5 months from issuance of the Building Permit- if the scope of work should change, change orders are made, ARC delays occur, special order materials delays, weather delays occur or Owner's indecision delays occur, then the completion date shall change accordingly. Excalibur has documented 96 Jost business days (5 months) on the [redacted] home due to weather, owner's indecision and non-payment by owner. (see attached spreadsheet) The [redacted]'s refused to pay invoices for work completed through-out the entire building process to save themselves the cost of interest on their construction loan. 2)  Cutting.Cprnera: Excalibur has never cut corners, in fact the [redacted]'s had their own  independent home inspector inspecting the home during the entire process and  Excalibur corrected anything the inspector wanted.  3)  Call Backs: Excalibur has gone back to the [redacted]'s home after completion to perform  "Final Punch List" items on 5 separate occasions, completing the items on the list each  time, only to have them dream up new items that are questionable damage from living  in the house:, and now it appeals in the complaint that they want us to comeback again?  We will gladly do this, one last time; a final punch list is exactly that, final. 4)  Desired Settlement: The house was finished weeks ago and we have gone back numerous times to Fix damage after they have been living in the home. Not only will we not pay for the [redacted]'s referenced bank loan interest, Excalibur is going to charge the [redacted]s interest as we have still not been paid in fall for the home we built. If the [redacted]s continue to delay final payment Excalibur will have no other option but to foreclose on the home and sell it. The contract clearly states: The home shall not be occupied or belongings moved into until home is paid in full, Should Owner be unable to pay the remaining balance as outlined above, interest at the rate of 18% shall be added to the balance until the balance is paid in full. If after 30 days the Owner fails to pay the remaining balant-,e in full the General Contractor shall have the right to sell the property. Sincerely, Andrew J. M[redacted], President

I am rejecting this response because: The house has not been initially completed. We did not put the concrete on the siding we did not scuff scratch or scrape the siding. The foam board he used is exposed. Andy said it would be buried, Its not.The dirt is closer than six inches to the siding in spots.The drip edge is all bent up.The patch job on the gutter needs to be fixed. Replace gutter.The utility room is a mess spray foam all over. The water lines are fastened to my heat duct.Metal trim edge some are dented and scratched.The garage door have damaged the sheetrock.The heat duct were never cleaned. sawdust sheetrock dust carpet pieces.The insulation needs fixed in basement a lot of pieces are to short and leave gaps.The refrigerator is not centered under the cabinet, filler was not installed properly or at all.The chase door leaks water, gets behind siding.The trash at the edge of lot.(rebar cement chunks steel posts)So the house being done for the first time. NO  We tried to get them to come back but they are always waiting for materials. This is ordered or that is ordered.I do not agree with the weather days at all we drove by everyday if it was cold or bad weather they worked inside. He needs to come finish and fix these things. He was given a list numerous times.
