Please allow me to elaborate (and also dispute each contention): I am pleased to learn that Excel Landscape has received no other BBB complaints in its 10 year tenure here in the North Valley. My wife and I have owned our current home and property for over 16 years and have never felt compelled to submit a complaint. Until now, that is. 1. I was intrigued to finally learn of Mr. [redacted] payment policy. It has never been mentioned before in our communications (nor did he inform us of any late payments) and is also not stated on his invoices. In the absence of any guidance on this matter, I assume standard business terms of Net 30 days. HOWEVER, I pulled the 9 invoices for 2014-2015 I received from Mr. [redacted] from our files. Yes, that's 9 invoices for 18 months of service. Invoicing was irregular in 2014 but monthly during 2015 as you'll see from the attachment. Invoices are not dated, but if I assume they were delivered to our home on the first day of the next month (which was rarely the case), I have attached a spreadsheet showing the delay from the first of the month. Excluding the invoice for June 2015 (of which I had forgotten since Mr. [redacted] neglected to address my complaints), a check for full payment was sent to Excel Landscape an average of 6.4 +/- 3.7 days after the first of the month. Our bank allows a maximum of 5 days for delivery. Hence, the delays could never have been 2 weeks. Again, we were never informed of any late payments and always (with the exception of June 2105) endeavored to pay for services in a timely fashion - much faster than standard net 30 terms. I am quite disappointed in Mr. [redacted] 's fabrications in this regard. Moreover, in some months, we simply received no service, not even the minimal blowing off of the patios. I often had to remind Mr. [redacted] that we shill existed (as you'll see from my attached SMS stream of communication with him). We have an eyewitness (our nanny and housekeeper) who had already informed us over the past year that the team from Excel spent very little time on our property. It's no wonder, we didn't receive the agreed up lawn and garden services. I have also attached photographic evidence of unmowed fields and weeds I pulled that were taller than myself (5’ 10”). 2. For the record, I was informed by the increase in pricing from $250 to $300 per month by the April invoice, not by Mr. [redacted] . When I asked him about the increase, he explained that it was because it took more time to mow the fields (I don’t recall any mention of the drought). I re-advised to him that he is cutting the fields to short and should let the clippings lie. There was no mention that I should seek another vendor for gardening services. I decided to see how this would work out, but as the SMS stream indicates, it most certainly did not work out well. 3. We had always agreed to mowing the property (front and back fields) on a bu-weekly basis during the growing season. Next time, I’ll be sure to get this in writing. 4. Although Mr. [redacted] and/or his employees may have visited our property on 6/5/15 and 6/19/15, the back field was indeed not mowed (please refer to the attached SMS record). I was forced to mow and clean the patios and courtyards before the July 4 weekend, as we had invited guests. I am quite disappointed in Mr. [redacted] ’s fabrications in this regard. 5. My wife and I each own small businesses and appreciate the challenges of managing such entities. However, Mr. [redacted] never used the “end of the drought” as an excuse nor did he mention late payments – which were clearly not late as explained in 1. 6. Mr. [redacted] ’s flexibility is only evidenced in the inconsistent service he provided us. All of our payments were timely, as evidence in the attachments. Any economic burden to Mr. [redacted] ’s company was of his cause, not ours. It has taken me nearly 2 months (and much physical burden) to make the fields and patios presentable again after the lack of service form Excel Landscape. Our flower beds and planters around the house are now so overgrown with weeds, I don’t know what we are going to do, except start over in the upcoming Fall and Winter months. This is an economic burden to me and my family and one we had not anticipated. 7. On the contrary, Mr. [redacted] ’s claims are false and unfair, as evidenced by the attached data and facts of the matter. I stand firmly by my complaint whose only resolution now is to refund our June 2015 payment of $300. If Mr. [redacted] is not willing to satisfy our requirement, we may be forced to take the matter to small claims court. 8. I am pleased to see that Mr. [redacted] now acknowledges the feedback from our nanny. However, as the facts show, our payments were never late nor was such brought to our attention. The attached SMS steam proves that Mr. [redacted] often ignored our requests and complaints. Before the economic downturn of 2008-9, we have previously used [redacted] ***. [redacted] and team mowed the fields bi-weekly and kept the patios clean, bushes trimmed, weeds pulled, etc. on a weekly basis. All for $300 per month (12 months per year – not only when reimded). Unfortunately, Excel Landscape was simply unable to complete the agreed upon work appropriate. Gardening and landscaping is a services business and should be guided by 2 principles – the quality and timeliness of the service provided as well as attention to the customer. It is truly unfortunate, that we had to learn an expensive and painful lesson that Mr. [redacted] is unwilling to conduct his business accordingly. It is for these reasons, that we stand by our originally submitted complaint and request for refund as its resolution. Regarding complaint [redacted] I registered on your site on 27Jul15, I accepted the proposed resolution from 01Sep15. However, Excel Landscape has yet to send us a refund check as of this date (as was the agreed upon resolution). Please re-open my complaint and remind the business owner that over 30 days have passed and no check was received. Thank you kindly in advance. Sincerely, [redacted]Receipt of the $300 refund check, as promised by the proposed resolution from Excel Landscape (for the last month of service paid but not fully provided). Moreover, Aron Z[redacted] should respectfully not enter our private property again. The threats and threatening tone he offered on 27Jul15 at our home are not acceptable.
