Initial Business Response /* (1000, 6, 2016/01/18) */
Contact Name and Title: [redacted] - Founder/Preside
Contact Phone: XXX-XXX-XXXX
Contact Email: [redacted]@excelisys.com
We are in agreement that the desired timeline was not met. And we also agree that less than six hours were worked between the...

Christmas and New Year holidays while our offices were officially closed (of which all our client's, including Mr. [redacted], were notified several weeks prior). Unfortunately, there were several circumstances beyond our control that came to light throughout Mr. [redacted]'s project and pushed the completion date beyond the end of the calendar year.
We were asked to create custom software based on wireframes (screen design sketches) provided at the beginning of the project. We were also provided with a Microsoft Excel document detailing how the system had to work behind-the-scenes. The solution we were hired to build was to integrate with another database solution that was created by a third company that Mr. [redacted] had also hired previous to hiring Excelisys, Softweb Solutions Inc. The integration requirements were immediately found to be problematic, and violated some fundamental principles of proper relational database design. We spent a good deal of time at the beginning of the project educating Mr. [redacted] and his team about the issues before finding an acceptable solution that would be both efficient and responsible to avoid significant problems later in the project.
Since the reference materials were often inconsistent with one another, we proposed alternatives at various stages of development to achieve an acceptable compromise between the requirements and an improved experience for the end-users. Our original goal (which was not guaranteed in any way) was to have a system available for testing by 12/5/2015. As of that date, the database that served as the core (backend) of this system had not yet been delivered by Softweb Solutions so full testing was not possible. They later made this core system available to our mutual client, Mr. [redacted], in late December, without incorporating the changes we requested in the preceding months. This made proper testing nearly impossible until very late in the timeline.
We were surprised by Mr. [redacted]'s sudden change in direction given his positive feedback immediately prior to his termination notification right after the holidays. We are disappointed that we could not come to a mutually-beneficial agreement with Mr. [redacted] to see his project through to completion. He is in possession of all the work that we have completed to date. Unfortunately he chose to hold Excelisys solely responsible for a timeline that was negatively impacted and software that was not fully functional due to matters beyond our control. We extend our best wishes to his entire organization and hope they will be able to satisfactorily complete the project they began with us.
OFFER:
To work as both parties originally agreed to as set forth in our work for hire agreement that Mr. [redacted] signed and agreed to when he hired us in July of 2015.
Initial Consumer Rebuttal /* (3000, 8, 2016/01/21) */
(The consumer indicated he/she DID NOT accept the response from the business.)
The response from Excelisys coincides with their business practices. Deceit, finger pointing and twisting the facts in all areas. This is why I had to leave, and this is why I will never come back. We are currently working with another company correcting all the issues from the extremely past due, way over estimate and dysfunctional program that Excelisys created.
I need the following to close this complaint:
1) Detailed logs of hours worked. Dates and Times. Excelisys is billing me more then 6 hours and they say in this statement they worked less then 6 hours. Timesheet needs to show when programmer uploaded hours and coincide with financial pentalies
2) Financial Penalties applied for hours worked as stated in email correspondence with program manager.
3) Copy of the Microsoft SQL Certification for program manager that was working with our SQL dbase that they say was problematic. I believe fraud was committed and this individual holds no such certification.
4) Copies of all research that they billed us for. We still have not received any reports on hours of research they billed us for.
Given the dishonesty of this Company, I do not trust any thing they say, and all must be verified by us or a third party. If they do not want to provide us with information we request, we want a full credit on the second, 200 hour, block of time purchased.
Final Consumer Response /* (4200, 17, 2016/02/03) */
(The consumer indicated he/she DID NOT accept the response from the business.)
I have not received any research they are charging me for and have not received credits documented in email. To bring this dispute to an amicable resolution, I am looking for
83 hour credit which equals 9,960.00. If they are willing to provide me with all research documents and show me O365 programming I will release payment.
I will be responding to the last email from the Revdex.com. It seems that I need to respond to this one first before I can. In that email, Excelisys clearly stated that they are not SQL certified. If they are unwilling to settle for the 85 hours we will be seeking all credits back for work they said was done by a certified SQL technician. THIS IS FRAUD!
Final Business Response /* (4000, 15, 2016/02/03) */
According to our CC processor, [redacted] the $6,960 due to Mr. [redacted] (for the remaining 58 hours at $120/hr of unused time), was refunded and debited from our account on 1/11/16 , we submitted the refund on 1/4/16 - but due to Mr. [redacted] dispute with his AMEX card for the full retainer paid (which Mr. [redacted] is also in breach of the agreement), the whole amount is in limbo and is awaiting Amex to finalize.
At this point we have done what we feel we have agreed to as stated in our contract that Mr. [redacted] signed and agreed to on 7/15.
