I have reviewed the response made by the business in reference to complaint ID# [redacted], and have determined that my complaint has NOT been resolved because:

I would like to begin by stating that we hired a Wedding Stage Designer. A Wedding Stage Designer is a professional individual who in servicing the needs of their clients ensures that the stage they design is unique and that the stage embraces the experiences and representation of the couple. In doing so, the Wedding Stage Designer promises and ensures that the stage is customized to incorporate the couples or clients tastes, likenesses, opinions, and matches their budget. In meeting these requirements, the Wedding Stage Designer first begins by showing the clients pictures of stages designed and executed in earlier events to conceptualize the elements to incorporate in the customized stage for the client; this process is also used by the Wedding Stage Designer to showoff their unique skill sets, vision, creativity, and experience in exchange to persuade their clients that they are the right individual for the job. I came to know about [redacted]'s (who at the time not only, operated alone but also was the sole [redacted] of Exclusive Events) work in April 2012 at a close friend's wedding. [redacted] was hired by my friend at the time to design his wedding stage. Since that time being familiar with [redacted]'s work; his business affairs, and further researching his stage design concepts by visiting his website, I approached him to design and execute my wedding and [redacted] stages. I would also like to clarify that in my approach of [redacted] sole [redacted] of Exclusive Events at the time of signing the attached contract, I was not approached by any design team employed by Exclusive Events nor the staff members employed by Exclusive Events. I was solely accommodated and received by [redacted] who was the [redacted], operator, and the only Wedding Designer for Exclusive Events. All the stage designs I was shown during the day of signing the agreement to hire [redacted], was designed exclusively by [redacted]. He showed me concepts of his previous work, and I selected a stage designed before as a foundation for further customization. We went over the design concepts and in exchange [redacted] discussed that the stage will be built and designed to my liking and during the event dates the stages will be designed in accordance with [redacted]'s supervision, delegation, vision and it will have his personal touch to incorporate all of the elements to match mine and his likeness. In the process of hiring the right Wedding Stage Designer, [redacted] ensured me he will be the only Designer to design the stage. More so, his staff's responsibility is to load, unload, and put each part of the stage together as a helping hand; not incorporate the concepts agreed to erect the stage. The incorporation of the concepts, colors, and all fine tuning elements of the stage building phase will be handled by [redacted] himself and no one else as he stated during our meeting. This is the service advertised to me prior and at the time of signing the contract by [redacted]. As persuaded by [redacted]'s representation of the business (Exlcusive Events) and seeing his work in paper and witnessing his work in my friend's wedding in 2012, I decided to hire [redacted]. As per the contract, only few elements of the stage design is detailed in the contract, items such as umbrella, sofa, and etc. However, please be mindful that [redacted] is not an attorney nor an expert in constructing contracts. He is and was a Wedding Stage Designer and this has been his profession for many years. He constructed this contract in the form of an invoice rather than a formal contract not detailing all the elements to be provided to his client ([redacted]) in constructing a wedding stage. In his normal affair, he ([redacted]) normally draws his concepts in an abstract form and puts it together during the day of the events as he described to us during the time of signing the attached agreement; and the description of the items to be provided was a general description of the materials needed to design the stage not the stage itself. Again, this is [redacted]'s method of just providing a description for recollection and because he lacks the knowledge and experience in writing a contract, for formality he compiled a vague agreement without detailing all the elements of a contract. None the less, all implications of a personal service contract was discussed and agreed upon at the time of signing. In addition, [redacted] and Exclusive events never proposed to sell me products or goods. No impression or advertisement was made in my presence, nor any communication by [redacted] and Exclusive Events made to me that the stages are an entire piece and they are sold as one unit representing one product. Furthermore, he nor Exclusive Events agreed to sell me each items such as umbrella, sofa, mattress, and others detailed on the attached agreement as an unit, representing to be a product(s).  It was always advertised and directly communicated to me by [redacted] sole [redacted] of Exclusive Events, that he provides wedding services which are exclusive and unique from other vendors; and that all design concepts along with the respective stages are under his proprietorship. Therefore, the intentions and purpose behind this agreement is, [redacted] (at the time sole [redacted] of Exclusive Events) promised and agreed to provide me with services to design my wedding stage and [redacted] Stage (a service). A service which is personal in nature and requires ones individual talent, creativity, vision, and skills which cannot be substituted by anyone else nor any entity and it can only be performed by the expertise of [redacted]. When I came to know the business was sold by [redacted] to [redacted], I contacted [redacted] to grasp a better understanding of the situation and to meet with [redacted]. Again, I met with [redacted] in response to my disbelief of the situation and I was surprised to hear [redacted] sold his business. After meeting with [redacted], I felt very uncomfortable with his work and the manner in which him and his assistant handled the entire situation. Also, the fact that [redacted] has more experience as a ** not as a Wedding Stage Designer, I knew this is not what I agreed for. [redacted] and his team had no idea of the service we agreed upon with [redacted] originally. They seemed very confused and even stated that they have no idea of [redacted]'s work except what is stated on the contract. After few days, I contacted ExclusiveEventsNY and the new [redacted] ([redacted]) to request my initial deposit of $1,000 back and that because [redacted] assigned and sold our personal service contract to another party without my consent, [redacted] and Exclusive Events breached our original contract and we have no contract with [redacted] and ExclusiveEventsNY. We do not owe [redacted] the $1,175 as detailed in his response because I never contracted to hire [redacted] nor ExclusiveEventsNY nor any service has been rendered. There was never a contract made with [redacted] nor a contract ever existed. Please note the original contract was breached as soon as [redacted] sold our contract to [redacted] without our consent.

decorations for his event. When customers hire Exclusive Events to decorate the event it is done in 2 ways; either the client hires a wedding planner who helps design the event or look at pictures of setups which were done in the past and select a design from them, to which they can add their own touch. [redacted] the customer chose the latter and hired Exclusive Events to provide a  specific stage setup, which was not mentioned in the contract hence we as the new [redacted]s had no idea as to what specific designs were chosen. Regardless, we setup appointments with each client 2-3 weeks before their event to finalize the details of the services we are providing. To Whom It May Concern,Exclusive Events Inc. operates as a decor company that provides event decor such as: flowers, centerpieces, tablecloths, backdrops, decorative sofas etc.  Upon any and all inquiries, a meeting is scheduled and potential clients are given the option to either hire an Event Planner/Designer/Coordinator OR choose a pre-made design shown via. photographs of our previous work.  Should the client choose the latter, they are then given the option to add/remove and/or change specific elements such as: flowers used and/or colors.  The client referred to in this case, chose the latter option where they decided from an array of pre-designed decor.  According to our contract, [redacted] and [redacted] did not choose to hire an Event Planner/Designer/Coordinator, they chose a pre-made design based on photographs that were presented at their initial meeting with [redacted], an agent of Exclusive Events as stated in the contract. There have many cases where clients choose our first option of hiring an event planner/designer/coordinator, a sample of such contract is attached (with client and event details blacked out).[redacted] first contacted me in June of this year and was immediately told of the change of [redacted]ship.  A meeting was promptly scheduled for a few days later at which both [redacted] and [redacted] were present.  During the course of our meeting, [redacted] expressed her distress with regard to not knowing weather or not I would be able to meet her expectations fully.  I then overlooked their initial contract with Exclusive Events Inc. and proceeded to show both [redacted] and [redacted] the same sample photographs that were shown during their first meeting on January, [redacted]. 2015.  Both [redacted] and [redacted] confirmed choosing the same photograph based designs they had initially chosen for their events scheduled on Thursday, July [redacted]. 2015 and Saturday, August [redacted]. 2015 (photos of the exact decor chosen are included as attachment in this response).  Exactly three elements of their decor were changed from the original sample photographs: two decorative umbrellas were added, two towers of decorative pots were added and the flower color shown for the decor used on their second day was changed from peach to hot pink.  By the end of our meeting, both above named clients were pleased with my service and professionalism and both agreed to continue with their contractual obligations to move forward with allowing Exclusive Events Inc. to provide decor for their two upcoming events. With regard to [redacted] stating int his previous response that his chosen designs were meant to be used only as a foundation is untrue, simply because the only elements modified were the color of flowers on one design and addition of 2 umbrellas and 2 pillars of decorative pots on the other design as mentioned above, clearly no new designs were created or any sort of designing implemented. Should [redacted] not be fully satisfied with the lack of detail included in the contract he signed on January [redacted], 2015, this matter should have been brought up during his initial dealings with [redacted], before agreeing upon and signing the contract. Approximately two weeks later, I received a phone call from [redacted] stating that he no longer wished to proceed with Exclusive Events because he is uncomfortable and under the wrongful impression that he had hired a “personal event designer” who would be present on the day of the events (which, as stated initially in this very response, is certainly not the type of service that the above mentioned client chose).  [redacted] also requested a refund of his initial non-refundable deposit of $1,000.Upon receiving this call from [redacted], I immediately contacted [redacted] who then contacted [redacted] and assured him that he ([redacted]) would personally oversee the decor operations on both days for both events as a courtesy to the clients, resting their worries once again.  [redacted] agreed to [redacted]’s offer and I was made aware of the new verbal agreement between [redacted] and [redacted].A few days later, I received an email from [redacted] stating that he had decided to hire another decor company and again requested his non-refundable deposit be returned. In my opinion, all of [redacted]’s concerns have been quelled. In addition, his request for [redacted] to be present and to oversee decor operations for both events has been agreed upon as a courtesy. Yet, [redacted] is still requesting his deposit to be returned simply because he is “uncomfortable”. Exclusive Events Inc. has reserved the date July [redacted] and August [redacted] for aforementioned client, who has now decided to breach their contract by canceling the services agreed upon with Exclusive Events Inc. a mere one month before their event date. At this point Exclusive Events Inc. stands at a loss for the aforementioned date as we will not be able to retain any new clients for the same date as all bookings are secured 2-6 months in advance. At this point I am at the legal right to request full payment for my services since Exclusive Events Inc. is not responsible for breaching the contract.Lastly, as per our contract (see attached), there is no mention of null and void of contracts should management be changed. In addition a copy of our contract (signed and dated by [redacted]) is also attached in this response. Please note, once signed, invoices are included in our contractual paperwork. So, as per our contract, deposits are non-refundable.

Review: I went to Exclusive Events for our Wedding planning on 01/**/15. We hired the previous [redacted] because of his experience and work. We made a deposit of $1000 on that day. On June [redacted], we came to know through an outside source that the business has been sold to a new [redacted]. I was very upset because we were not made aware of the situation. My fiance and I went to meet with the new [redacted], on June [redacted], 2015. He is a ** and is not a wedding planner expert. He had no idea what our wedding stages looked like and what we have planned with the original [redacted]. I had decided not to go with [redacted], the new [redacted] because of his lack of experience. I have paid the deposit to go with someone of experience, and whose work I am familiar with. The contract we signed with [redacted] was breached once he sold his business and we were not made aware of the change. He sold our contract without our acknowledgement and our approval to go with the new vendor. [redacted] claims that it is the same business and things are done the same way. But I am not willing to pay someone who is not aware of what I want for my wedding and is not an expert. I went to a wedding planner who has been in the business long enough to take care of my big day. I am upset that the business did not have the decency to let the clients know of the change. The business was sold in April 2015 and I got to know about it in June- 1 month before my wedding (through an outside source). This is unacceptable. The new business [redacted] claims that we cannot change our mind 1 month before the wedding, but if we were made aware of it 2 months ago, we would've taken action right away.I would request business bureau to please look in to this situation. They have no right to withhold my $1000. I am not going to go with the new [redacted]. They are unprofessional and lack experience. And I have every right to change my wedding planner according to law. [redacted]'s number: [redacted]'s number:[redacted]Desired Settlement: I am asking for a refund of $1000. It is my right since there is no standing contract with [redacted]. The contract was breached and it is not legal for Exclusive Events to hold my money.

Response:

After few days, I contacted ExclusiveEventsNY and the new [redacted]) to request my initial deposit of $1,000 back and that because [redacted] assigned and sold our personal service contract to another party without my consent, [redacted] and Exclusive Events breached our original contract and we have no contract with [redacted] and ExclusiveEventsNY.

Response:

Response:

I have reviewed the response made by the business in reference to complaint ID# [redacted], and have determined that my complaint has NOT been resolved because:

It is a waste of time to argue with an [redacted] who does not understand the wedding planning business himself. People go to a "wedding planner" to have the wedding planner help them make their wedding look glamorous. If we were to rent the back drops, we would've gone to a furniture store to get the items and made our own design. Or we would've gone to home depot and gotten a worker off the street to help us put the decors up. It's pathetic that [redacted] don't understand the concept of the business that he purchased. And his email from earlier clears up why we would not want any business with him. This issue will never be resolved with the mid set he has. He is arrogant and ignorant and has no empathy towards couples who are getting married and are going through a lot already. It is unfortunate that [redacted] and [redacted] is creating additional stress for couples who are getting married. They claimed that they would contact couples 2 weeks before the wedding to let them know that the business [redacted]ship has changed and a new person will be taking care of their planning. And as per the disclaimer says, they would contact the couple 2 weeks before the wedding to get them to come in an get the money. So, basically, the couple would come, find out about the new [redacted]ship, freak out, and they would have no one else to go to but choose [redacted] over [redacted] and pray that their planning goes well. As for us, we will not even consider [redacted] because [redacted]'s associate - [redacted] already mentioned that [redacted] always promises the couple but never shows up to the wedding. This business is nothing but a scam and make wedding couples go through this trouble. We have nothing else to say. This issue will only be resolved when the correct law comes in play.
