information they gave [redacted] is incorrect. I will be more than willing to release Mr. [redacted] from his agreement. All I ask is that he provide me with a 30 day notice and proof that he's moving.

I do not feel I should provide [redacted] and Exclusive Fitness Studios a 30 day notice and proof of moving due to the fact that they "DID NOT" provide me with a written contract the day I entered their establishment. On day one, [redacted] and Exclusive Fitness Studios did not explain the terms of the contract which I never saw or informed of. NOT ONCE! Yes, they were more than willing to take my credit card information without hesitation. On that day, I did mention to [redacted], her husband and their new employee that a few of my co-workers that my fellow co-workers have a membership with their gym. One of my co-workers who was there that day in the elliptical / tread mill room with testify they witnessed the whole transaction at the customer service desk in which none of the Exclusive Fitness Studios staff did not explain the terms of the contract nor gave me a printed copy. So I find it funny that [redacted] would like for "ME" to provide a 30 day notice and proof of moving, but Exclusive Fitness Studios did not provide me no printed contract or explained terms of the contract from DAY ONE. That does not seem fair to me. I have not once used their facilities because atthe time they were still renovating the whole gym for several more weeks. My other issue is with Exclusive Fitness Studios association with [redacted] which is a representation on their company. The day I contacted [redacted] I made sure my "legal representative" was there to "record" and "listen" to everything the [redacted] representative said to me. I am absolutely furious that they threaten to send me to the Credit Bureau if I break my contract. Again, on the day that I signed up for membership at Exclusive Fitness Studios, none of the staff including [redacted] did not explain nor provide printed documents about membership at their gym. Again, this was witnessed by my co-worker who will testify to this. By sending me to the Credit Bureau could have devastating effects on my future employment, purchasing a home, getting credit, purchasing a vehicle and many other things that could be affected by my credit. You mess with my credit, then you mess with my money. I will not stand for that. I really do appreciate the Revdex.com trying to be the mediator in this situation. Unfortunately, it looks like I possibly need to take "legal action" against [redacted], Exclusive Fitness Studios and maybe even against [redacted] due to threats of ruining my credit. If it comes submitting a lawsuit against [redacted] and Exclusive Fitness Studios, then I will ask the courts (or during mediation) that [redacted] and Exclusive Fitness Studios pay for all my legal bills and for time missed for work. All I want is to be released from a contract that I have never seen nor was given a printed contract without the threat of being sent to the Credit Bureau. I should not have to provide proof of moving since I was "NEVER" provided or even shown a contract with this gym. It is not good business. [redacted] provides a written / printed contract explaining terms of gym membership. [redacted] provides a written / printed contract explaining terms of gym membership. How come Exclusive Fitness Studios "did not" provide me with a written / printed contract explaining terms of gym membership???? In addition to "potential" legal action against [redacted], Exclusive Fitness Studios and possibly against Affiliated Acceptance Corporation, I will take the recorded conversation of the [redacted] representative to WFMY 2 Wants 2 Know and FOX 8. That way the viewing public with learn from my mistake of not receiving a printed copy and explanation of gym membership with an organization like Exclusive Fitness Studios. I just want to wash my hands of this nightmare of situation. Just release me from my contract (no proof since you did not provide "ME" with proof of a contract) or we will be battling it out in court and in the media.

Review: I sent in my notice of cancellation on 3/4/15 and was charged on 4/6/15 for the month of April. When I called the gym to find out why I was charged, the GM [redacted] gave me the run around and never followed up with me. I called from my work phone and no one answered. He called back not knowing the number and spoke with a lady that I work with. Once she told him that she would transfer him to me he said "ughhh. Ok. Transfer me. I'll deal with her." HOW RUDE AND UNPROFESSIONAL TO SAY TO SOMEONES EMPLOYER!!!! He basically stated that he doesn't deal with the payments and couldn't help me. I received a phone call from the owner Jenise. She told me that she was on vacation but needed to call me because I was "causing a ruckus over there". No one should have to go these lengths and deal with this many unprofessional and arrogant "business" people to get their money back when it is rightfully theirs. I had to eventually call the 3rd party company who handles the payments and she told me that they didn't receive the cancellation from them until a week after I sent it. I still have not received a follow up email, call, or my money back. WOW!Desired Settlement: I want my money refunded that was taken out of my account for the month of April. I sent in the cancellation on 3/4/15 and was charged on 4/6/15. At the VERY LEAST I should get a prorated amount and only be charged a couple of days...which is their fault for waiting almost a week to send in the cancellation. They should not be able to steal from people like this.
