XXXXX [redacted] XXXXX did sign an agreement with Aspen Ridge Holdings, LLC on or about September 23, 2014 for a loan of $401,533.00. In exchange for said loan, EPC promised to provide a Bank Guarantee in the amount of 11 Million in EURO within 15 Banking Days of receipt of the funds. On or about September 27, 2014 EPC received a wire for $401,533.00 from Aspen Ridge Holdings, LLC escrow. However, EPC's Bank (Chase Bank CA) wanted to review the federal wire deposit from Wells Fargo Bank NV and Chase Bank placed a hold on the $401,533.00. EPC worked diligently with Chase Bank to release the hold. However, after more than a week of said hold and no release date in sight, a Wire Reverse was ordered by Aspen Ridge Holdings LLC. On or about October 7, 2014, ARH received their $401,533.00 back into their escrow account at Wells Fargo Bank. Therefore Exclusive Precinct Corporation returned fully the $401,533.00 received from Aspen Ridge Holdings LLC. On or about October 10, and 15, 2014 ARH sent 3 Bank wire transfers for a total of $370,000.00 to Exclusive Precinct (L) Limited (EPL) in Malaysia, a member of the Exclusive Precinct Group of Companies. On or about November 25, 2014 EPL did arrange for a Bank Guarantee and paid through Bank Islam Labuan for the Bank Issuing Charges to Alpha Bank located in Cyprus. This was to trigger the issue of a Bank Guarantee per the said Agreement. But, due to technical issues it is still pending and EPL is getting this resolved.
Our initial arrangement with [redacted] would have allowed us to work with Prime Banks to issue the Bank Guarantees. However, because [redacted] did not have the normal required capital, but only $401,533.00 of which EPL received $370,000.00, EPL is only able to deal with smaller and lower rated International Banks, instead of the normal Prime Rated Banks. Thereby making this task much more difficult to complete with the new banking protocols.
EPL is working to resolve the Alpha Bank technical problem to ocmplete the required Bank Guarantee, as Bank Charge Fees (Underwriting, insurance, funds, Commitment, etc) have already been paid in part from the ARH funds. In addition EPL is preparing other Banks to issue smaller amounts of Bank Guarantees to build up to the contracted amount for ARH.
Mr. Taeleifi is keeping the Managing Member Mr. [redacted] of [redacted] up to date with the progress on a weekly basis. The consumer Mr. [redacted] gets his updates from Mr. [redacted]
EPC and EPL further anticipates to close this transaction asap and request your esteem office to give us some additional window time frame so that we can conclude this transaction and provide the rquired Bank Guarantee or the Return of ARH's $370,000.00
