Complaint: [redacted] I am rejecting this response because: Thank you for your reply and the photographsThe photographs show the apartment in the same condition as it was when I began my leaseUnfortunately, since Exclusive Real Estate Management did not own this property when I began my lease, they were not able to observe the condition of the property prior to my modateThe claims made by Exclusive Real Estate Management regarding damage incurred during my lease at this property are completely false My legal counsel and I are also well-versed in Oregon lawPlease be advised that the address to which you refer is correct and in fact my permanent addressTherefore, due to the lack of legal relevance of arguments provided by the landlord since (1) the charges were not communicated to tenant within the deadline established by Oregon law as proven by no written communication being received at this address until October 17, with Exclusive Real Estate Management's acknowledgement of having the correct permanent address; and (2) since the carpet, dishwasher, and walls were in the same condition as received by tenant at beginning of lease, I am requesting a full refund at the earliest convenience within the next two weeksThank you in advance for your immediate attention to this matter.Sincerely, [redacted] ***

Again, I sent the final accounting to Mr [redacted] to the forwarding address that was provided to meThe management software program that I use creates the PDF letter that is send out to every tenant upon move out detailing the accounting-the fields are automatically filled in once I process the move out and it is not something that I have the ability to changeI am well aware of Oregon Law and my responsibilities as to tenant security deposit and have never not sent out final accounting to a tenant I feel that if Mr [redacted] was concerned about his deposit then he should have scheduled a final walk through with me prior to his departure and tuned over keys while at the houseThis would have solved many of the issues that he has and he would have known well in advance that cleaning, carpet cleaning, yard clean up and repairs were needed in order to get the unit in rent ready condition I am attaching two photo pages of some of the cleaning and nail holes in the unit-I wish it could say how badly the unit smelled but unfortunately I can not send this with a photo

*** *** did rent a unit that I took over after he started his tenancyHis initial walk through of the house was completed with *** Realty and that walk through sheet was turned over to meWhen Mr*** vacated the home I completed a final inspection/walk through of the premises along with
a check sheetI compared notes to when he moved into the home and Mr*** was charged for cleaning and repairs that were not marked when he moved into the home that were necessary to get the home in move in conditionThe house was very dirty and smelled very bad-the source of the majority of the small was a dishwasher that was full of waterThere were also broken blinds, yard care that was not completed , trash that needed hauled away, touch up painting from large nail holes plus additional items that the owner was charged forCleaning was completed on the house along with professional carpet cleaning and repairs necessary-all invoices were paid a final accounting was mailed 8/27/and a copy of this is attachedThis accounting was completed within the stipulated time frameThe voicemail that Mr*** is referring to was in response to one of his phone calls letting him know that the final accounting had been mailed to the forwarding address that we had on fileMr*** called and emailed my company on numerous occasions and additional copies of the final accounting along with the invoices were mailed to him as he requestedI also received a certified letter in the mail on October 12th and again mailed copies of his final accountingI am unable to determine why Mr*** did not receive the initial accounting sent to him but as I relayed to him via phone calls and email messages the accounting was sent to the address provided when he turned the keys into my office

Complaint: [redacted]I am rejecting this response because:
No cleaning or damage repair needs were reported to me before the deadline dictated by Oregon law. Exclusive Real Estate Management’s brief report attached in their previous message, although dated for August 27, 2015, was e-mailed to me on September 23, 2015. After this, I made several documented attempts to contact the company, and I received mailed documentation with the itemized list on October 17, 2015. No written documentation was received until this date, and no proof of any documentation arriving at my permanent address before the deadline established by Oregon law has been made available. I do have records of all my communications with Exclusive Real Estate Management, and there is no record of the 8/27 response that the company reports. 
Regarding the voicemail I received and still in my possession, in reply to my query as to the status of my security deposit, the voicemail on September 14, 2015 states “We have put it in the mail…you should get it anytime now.”
In reference to the claims made in the response, I put zero holes in any walls in the apartment, and I did not use the dishwasher at any time during my stay in the apartment (I wash my dishes by hand). I left the apartment in the same condition as when I moved in under the lease with [redacted] Realty. My flawless previous rental history, having never had a security deposit even partially withheld, reflects my respect for the properties that I live in. 
In good faith that this is an honest mistake, I will be happy to collect my refund without interest if it is processed within the next two weeks. Thank you for your collaboration for a prompt resolution.
