Complaint:
I am rejecting this response because: all the information that was given was and signatures were forged, we have documents that were faxed over to our mortgage lender stating that Tomas and Ignacia wrote at letter saying that they were unemployed and Rafael Hernandez has nothing to do with us we don't have any one in our family that's disabled like the letter describes it (letter attached) Regards,

To whom it may concern,
This is to explain the
situation, about the [redacted] letter that was sent to Mr. [redacted]’s
lender by mistake. At that time, we had an employee that accidentally attached
the letter to the wrong loan. These issues are normal and we can correct them
with no problem, which we did, however they do not happen very often. With that
being said, the letter in question was received by Mr. [redacted]’s lender, and his
lender assumed that it was for his case. This was already explained to Mr.
[redacted], as well as his lender, they both understood that it was sent in error, and
they understood that the letter was for another one of our clients. Rafael
Hernandez is actually a very satisfied client, amongst many others that are
very happy with our services, and he would not mind if you called him for
reference, he can be reached at # ###-###-####. All documents used for Mr.
[redacted]’s case were pertinent to his case and his bank (I have attached the full
contract signed by Mr. [redacted], the authorization form and the 4506-T for
modification assistance, signed in our office. We also attached his social
security card, as well as his driver’s license, which we made copies of when he
signed the contract).  As far as the allegations
of forged signatures go, this is completely false, as we have all our clients
sign the authorization and the 4506-t based on our financials, when they come
to sign our contract. Mr. [redacted], tried canceling our services but the
cancellation was null; (he signed the contract on 12/19/13) we give all of our
clients, 5 business days to cancel after our contract has been signed, and we
were already 6 months into his process when he made his request. The 5 day cancellation
policy, is made clear to our clients when they sign our contract, the cancellation
page is in the contract, which will be attached to this email, as already stated.
This is a zero fraud tolerance company, Mr. [redacted] keeps slandering our good
name and the truth is, his claim has no bearing on this matter. The facts are,
he signed a contract with a licensed R.E agent of California, now he is reneging
on the contract. Our financial packet was received by his lender, and is the procuring
cause of the modification/assistance, that he received from his lender (attached
is the letter of confirmation, that the lender received the financial packet
and that there was a single point of contact assigned). Executive 99 is now
seeking payment for the services rendered as mentioned before. We have tried to
work out a solution with Mr. [redacted] and we will accept $1000.00 dollars to
settle the contract and avoid small claim legal action. If no settlement can be
concluded we will have no choice but to pursue for the full contract value. I
hope this shines some light on the issue at hand.
Thank You

Response:

To whom it may concern, I am responding back in regards to the complaint that was filled. The information that has been reported is incorrect. This client did receive the assistance that we offered and he did accept it, we have proof from his lender that the modification has been accepted by the borrower the date and time. This client is actually in collections with our office for the remaining $1937.50 that he listed. Representative we spoke to was Denise on 10/2 and advised us the borrower was approved and he did accept the modification program that was offered to him based on our work. The amount due has been owed to us from last year and now we will be seeking legal action threw small claims. [redacted] is now current with his mortgage and has a lower payment then he did prior. Of which he has not paid us for. He signed the contract and it is in English and in Spanish. He understood. And now he is not telling the facts and is threatening us with Revdex.com complaint. Why did he not take us to small claims??? Because he knows is not telling the truth about us or our services.

Response:

To whom it may concern, I am writing this to further expalin the complaint that was filed with you office. Our company was in the process if pursuing a modification for the Mr. Z[redacted]. With that being said the lender did not provide assitance to the homeowners. I have personally discussed with the clients that if the lender did not provide us any options for there account that we would fully refund the first half. So for this specific account our company has already approved the refund of the money he paid. We let the client know that this is a timely process and the refunds can take up to 6 months to a year to refund. In the begining client was patient for the first 60 or so days but after that became very rude and used foul language and raised his voice with me and demannded refund then and there and various other threats. This is not how our company policy works with refunds and client was advised this in writing and verbally. We were merely asking for the time to process the refund as best and as fast as we could. In the end Mr Z[redacted] does not need to contact our office 4 to 5 times a day requesting a refund and seeking other options in order to get his money back when the refund was already approved. As this could only delay the process. If you have further questions or concerns please feel free to contact our office.
