I am rejecting this response because:
I checked with the City and they did tell me that if they were to issue a refund to Executive Realty, that the license would be voided (the fee being returned, not the removal of their name from the license is what would put me into violation) and put me and my property into violationRemoving their name is fine but asking for the refund was not and being licensed professionals in this field, they would have know thatHad they notified me at all prior to requesting a refund with the city or had they stated at the time I informed them I no longer thought it in my or my tenants' best interest to have them manage the property that I owed them a reimbursement, it would not have been the issue that it isAs Nikki with Executive Realty had mentioned, it is a small feeI feel that this is one of many negative issues that I experienced while working with this company and still feel that other consumers should be made aware so they know that they could have similar experiences I think that perhaps Nikki with Executive Realty was not fully informed by her team as to all the happenings I have supplied supporting documentation for my previous claimsI also wish to clarify that I am not confused nor am I misinformed about what a W-is forI had consulted with tax professionals prior to actually renting out my home and was told that I needed to keep a clear trail of my expenses and what I actually collected in order to have all my supporting documentation come tax timeMy tax professional was against additional W-9's from outside companies as they prefer clear distinction on different types of income I may haveSince this was handled in the way that it was, their placement fee (1st month's rent) which is a fee that I technically pay to them and would write off is actually a separate check they had my tenant write out directly to them for their placement fee instead of check for her total- now hard for me to show definitive proof that I paid it and not my tenantI have attached the email correspondence where Phil B with Executive Realty states the only way to undo what they had done was to get the tenant to reissue checks once they refunded her.I have also attached a copy of the tenant placement form that I signedIt shows where it states that checks should be made out to me and sent to the address providedNowhere do I see where it states that by working with Executive Realty that all checks will be made out to them and Executive Realty would issue me a check from them instead of the tenant.As far as my communication in the process, despite working full time and going to graduate school, I was clear and timely in my responses with the exception of an email that Nikki sent while I was out of town for a week with very limited availability, which I had notified Executive Realty about prior to leaving town

Frankly, I'm floored.  Our agent, Joe, worked diligently to find a renter for [redacted], and informed her of every showing at the property.  Sometimes there were multiple showings in the time frame provided to [redacted], and I believe that is why she thinks that she was not informed of all...

showings.   I am not going to go into all of [redacted]'s claims, however I would like to clear up this matter.  I believe that several misunderstandings lead to [redacted]'s frustration with our company. First off, [redacted] believed that all checks would be written directly to her, however, we always have tenants make out their checks to Executive Realty, as we are the property managers.  After the checks clear our account, we deposit them into the owner's account (or mail them, if the owner prefers).   Secondly, [redacted] refused to sign a W-9 form, which is necessary for tax purposes if we are turning over more than $600.  [redacted] did not understand this form, and mistakenly believed that it would mean that she was employed by our company.  After countless attempts to explain the purpose of the form, [redacted] finally relented and signed.  We released all of the funds we were holding for her as soon as we received the W-9.  We even over-nighted the check to her.  We did not make any money from her funds being in our account for a couple of weeks.  The account's interest is turned directly over to the state of MN. As for our company's fee of $1450, we charge 1 month's rent for placing a tenant.  Part of our management includes assisting the owner in setting up the rental license, however, nowhere in the agreement does it state that we pay for the rental license fee.  Tenant placement is completely separate from that.  Additionally, [redacted] never signed the management agreement. She decided to manage the property herself, so our office manager, Claire, called the city of Eden Prairie to remove us from the license, as well as to request a refund of the fee.  We informed the city that [redacted] should fill out a new rental license form without our name on it, and pay the small fee of $57.50.  We did not do this maliciously, as it is standard practice for us to remove ourselves from licenses of properties that we are no longer managing.   Had [redacted] decided to stay with our company, we would have charged her the $57.50 rental license fee, so she would be paying it either way.  By removing our company from the rental license, we did not put [redacted]'s property in danger of incurring any fines.  The city was well aware of the necessary changes to the rental license, and therefore would not have fined her during the interim.  At no time was her home in "jeopardy."  Also, [redacted] stated that she tried to contact our company regarding the matter, however, we did not receive any voicemails. When we emailed her, it would take quite some time for a response. We tried diligently to get the funds to her, however, we also have protocol to follow for transferring funds. We bill all rental license fees to property owners. If our company took on the fee for each property, we would not be making any money.  Please let me know if you have any additional questions.
