Complaint: [redacted] I am rejecting this response because: the explanations given do not justify the lack of communication from [redacted] to myself; on 13JAN2016, [redacted] was asked if there were any problems in getting parts, and his response was "no." I was never told by [redacted] that there was difficulty in getting the Right-side tank, and I never approved or authorized the damaged tank to be 'fixed', instead of replaced.The following is my version of the timeline of events regarding this complaint:I contacted EXP Motorsports in September, for repairs to my motorcycle I expressed my desire for someone who had an eye and work ethic for details; and that I am very particular ***, the owner of EXP, claimed that he was as well, and would, “drive a perfectionist nuts.” I was provided an estimate for repairs; received a check from my insurance company, and signed it over to EXP Motorsports on 17OCT At that time, I expressed my wishes have repairs expedited, and since I had provided payment in advance, I would appreciate all sub-contractors to be extended the same consideration, in an effort to “keep things moving forward” I also expressed my desire to have the rear fender painted with the two tank side, and front fender The front fender and Right-side tank were damaged in the accident, and [redacted] said that he included the Left-side tank in the paint, as it is visible with the Right-side, and any color difference would be noticeable [redacted] claimed that adding the rear fender would be a minimal addition Also added was a desire for a different handle bar, and to move the horn button from the dash to the new handle bar I also expressed my desire for meticulous book-keeping and that all invoices were to be copied and included with the final reconciliation Additionally, I requested timely updates, and communication, especially if any problems or delays were encountered; as I would be a resource for help [redacted] agreed to my requests.On 13JAN2016, after not hearing from [redacted] once, I stopped by EXP Motorsports for and update and, hopefully, to pick up my motorcycle I found my motorcycle in the same position in which it was left when delivered on about 26SEP It appeared to have been untouched I questioned [redacted] as to the delay, and why I had not received any communication from him in over months His explanation was essentially that his Father was ill, and he has been dealing with that; and that things are better now, and that the parts to complete my motorcycle were in He also claimed that he would be getting the parts that need paint over to his paint-guy, and my motorcycle would be done next week I asked to be kept in the loop, and he agreed to do so We discussed handle bar options, and I explained my desires for the type of bar I was looking to have on my motorcycle I asked if there were any problems with parts, and he said, “No.”On 26MAY2016, after not hearing from [redacted] once since we last talked on 13JAN2016, I stopped by EXP Motorsports for an update and, hopefully, to pick up my motorcycle [redacted] claimed that he was “ waiting on paint; everything else is here; everything else is ready.” [redacted] claimed the parts should be back from paint in a week, and my motorcycle would be done at that time He also claimed that he had not been at the shop, as he was dealing with his Father, and also with his girlfriend I asked for my motorcycle to be done for my birthday, the first week of June He agreed I told him that my last visit was in January, and asked for him to update me I then asked him how many times he called me with an update, and his response was, “not-a one.” [redacted] then claimed that ***, the paint guy is out of town, and “once I (***) get the paint back, I (***) bolt it up, and we’re done.”At this point, I have not been told about any problems in getting the Right-side tank, nor that [redacted] had decided, without my approval or permission, to have the damaged Right-side tank repaired I was able to get the phone number for ***, the paint guy, and confirmed that he did have my motorcycle parts; he did repair the damaged Right-side tank, and was finishing the paint job I asked if he had been paid in advance for the job, and he said, “No.”On 30JUL2016, after leaving several voice messages at EXP Motorsports, I decided to stop by the shop in person I found the door locked during business hours While walking back to my vehicle, I noticed a truck enter the parking lot and park adjacent to the EXP Motorsports front door I observed men knock at the EXP Motorsport door, the door swung open, and I saw [redacted] in the doorway After the door closed, I walked up to the EXP Motorsport door and it was, again, locked I called the Arapahoe Sheriff’s office for a civil stand-by, and awaited their arrival Sheridan PD arrived with two officers, and we found the EXP Motorsport door locked I immediately called EXP Motorsports; there was no answer, so I left a voice message stating that I was at the front door with PD and for [redacted] to open the door There was no response to my message.On 03AUG2016, [redacted] was served with Small Claims papers with Sheridan PD and Arapahoe SO present.On 13AUG 2016, with Sheridan PD present for civil stand-by, I took possession of my motorcycle from EXP Motorsports It is not known at this time if all parts to my motorcycle were present at EXP Motorsports at the time of the re-possession of my motorcycle.On 16AUG2016, with Sheridan PD present for civil stand-by, [redacted] presented me with a part to my motorcycle, and I received an itemized bill for parts and alleged work to my motorcycle from *** At that time, in the presence of Sheridan PD, he offered a monetary amount to me if I would drop the Small Claims Summons Sincerely, David [redacted]

Thank you for the opportunity to respond to this .              Mr [redacted] brought his motorcycle to me in september of 2015 for a wreck estimate and repair . At that time I had explained to him that these older aftermarket type...

bikes are difficult to do and hard to get parts for similar to old cars and getting an insurance company to approve the repairs may take some time . Mr [redacted] said that he understood and agreed to move forward , I did the wreck estemate and submitted it to the insurance company this process took about a month as expected . Once the check was processed through the bank, part started to be ordered which took quite a bit of time , one problem that came up immediatlywas the fuel tank that was damaged was an original tank and have been obsolete and discontinued many years ago so I had to order an aftermarket tank which was shaped differently than his original tanks so the one that was being replaced did not match the left side and it was painfully obvious , so a second tank was ordered which did not match either so I ordered one more with the same result . so trying to move the job forward I started to explore my options and took the tank to my painter who said he would be able to repair the damage to the tank . At some point of this going on Mr [redacted] expressed that he would like to have all 4 parts of the body work all painted so they would match , I explained to him that I could fix some of the damaged parts on the bike to like new and that would leave some money to cover the cost of the extra paint and he agreed.  While all of this was taking place a couple of Mr [redacted]'s parts had started to show up but as expected many of them were back ordered or no longer availible , so I started looking for alternate parts which took a lot of time , Mr [redacted] had also expressed that he would like a different set of handlebars and asked if I would be willing to move his horn button from his dash to up on the handle bars and I agreed .   PLEASE KEEP IN MIND THIS BIKE IS NOT A HARLEY DAVIDSON , it is a home built bike it has an aftermarket frame ,part of a front end from a 1955 harley davidson and a lot of parts that are no longer made so finding these parts can be difficult at best and requires a lot of time which was explained several times .         While all of this was in process my father was diagnosed with cancer heart failure and kidney failure and I am all that he has for family so I was not always availible to Mr [redacted]  and I did explain this to him . the morning of 7/30/2016 when Mr [redacted] tried to catch me in the parking lot I had just recieved a call from the hospital telling to get there as fast as I could my father passed within 15 minuts of my arrival , I was not in a position to do any business that day .         The next Wednesday Mr [redacted] served me with a summons to small claims court and on 8/13/2016 he showed up at the door with sheridan police and took his bike out of my shop which I helped them gather his parts both the new parts and the parts that had been removed as I was working on the bike starting to put it back together for final assembly  At the point that Mr [redacted] retrieved his motorcycle I had spent about 20 hrs chasing parts and working on his motorcycle I had paid the painter $1450 for paint and body work I have also spent $1393.50 for parts .I also feel that I would split the labor with Mr [redacted] as there was about 10 hours billed on this job witch is $850        thank you for the opportunity [redacted] owner Exp motorsports

This is in response to mr [redacted]'s response          when this job was first brought to my shop it was in the middle of september of 2015 , he was refered to me from another shop because most shops wouldnt touch a bike like this. I took the job in and told him that bikes like this are difficult and do take some time as there are many aftermarket parts and parts from many other year motorcycles . I did tell him that I am a perfectionist and I am . I completed the wreck estement  which took several hours to complete and submit to the insurance company . I spoke to the insurance company several times about this motorcycle which took another couple of hours because they had no reference to the value of this motorcycle the insurance company wanted to total it which in hind site I should have let happen but I spoke to them several times and eventually got them to do the repairs as this was what mr [redacted] had indicated that he wanted to happen . the time that lapsed between when the estement was submitted and when mr [redacted] recieved the check for repairs  was about 3 weeks , which I believe was the middle of october as standard procedure with my bank on insurance checks there is a 10 day hold , which means funds were not availible until about the end of october . at that time parts were ordered and about two weeks after that some parts started to show up otheres were either on back order or dicontinued , ( very normal for a bike like this ) so the next step is to find similar parts from other sources . the right side gas tank is an original tank and had been dicontinued from harley davidson for more than thirty years so the only sourses are aftermarket most are made in korea or thialand needless to say they are not made in the same way as originals and do not match the originals . mr [redacted] is a very intense and particular individual and many of the things that he wanted to be kept in the loop on would take far to much time to explain and discuss with him as there was only ten hours of time on this job for labor and I had easily doubled that just chasing parts doing the estement and dealing with the insurance company . I do have other bikes of the same vintage in my shop and have had them far longer than I had this one in my shop for exactly the same reasons .            mr [redacted] also had asked me in november of 2015 if I would look at a subaru for him because he said that this motorcycle was his only transportation and I was happy to . I looked it over for hom and told him the things that needed to be fixed and about how much to offer for the car . he purchased the car brought it down to my shop because it needed a clutch and I told him no problem. but since it was his only vehicle I offered him another subaru to get him around for a day or so till I could get his fixed . I completed the work I believe within two days as I could easily get parts , I believe that it took mr [redacted] a week and a half to get back to the shop to pick up his car and upon returning my car he proceeded to complain about the car that I had lent him at no charge . I had lent the same car to several other people and not one of them had a problem with it . the only reason that is relevant is that it shows mr [redacted]s general attitude towards me trying to help him.                   mr [redacted] ahd served me with a summons for small claims court at that point I stopped working on his motorcycle about a week and a half later he showed up on a saturday and removed his motorcycle in pieces with the assistance of sheridan pd at that time he told me he would be back on tuesday for his paperwork . when I arrived to work on the following tuesday I was met by three sheridan pd officers and mr [redacted] . I handed him his rear tail light assembly and gave him a copy of the original estement and the revised work order with a complete inventory list of the parts that he recieved and the cost of everything to that point he requested all of my invoices as well which I refused . I explained the cost of the parts and paint and labor which I split with him as I had about 20 hours in this and there were only 10 hours of labor on this job so I said that I would split the labor with him if he would like and if he would release the summons and bring me proof that he had I would cut him a check for the ballence and it would be done , mr [redacted] refused         Thank you for your time regarding this matter [redacted]
