Expedition Payroll, Inc. did provide payroll service for the complainant for two payrolls in the first quarter of 2015 and one in the second quarter of 2015. We did a year to date conversion and in the process reviewed the conversion with the...

client. Unfortunately the information supplied by the client resulted in a method of tip reporting that the client was not using in the way the documents were interpreted. This error was corrected with the first payroll and the checks were replaced. Accurately making adjustment entries were confusing to the client and we are sympathetic to the confusion caused but the information was correct. We subsequently spent several sessions with the client to attempt to explain the issues. We also provided several unscheduled payrolls to accommodate special circumstances and did so at no charge.
After the third payroll our services were terminated and the client indicated that another payroll service was replacing Expedition. At this time we were told that the replacement service would take care of the tax payments which had not been paid and the filings. All of the payments of taxes to this point had been paid in a timely manner. The third payroll was for hours worked in the first quarter but was paid in the third quarter and we discovered after we had been terminated that the client did not understand the significance of this and was unaware that we had processed in the second quarter. We typically impound as the payrolls are run but we had made accommodations for the client because of the confusion on the tip calculations. We understood that the new service was handling the filing we prepared a special report detailing what had been done by us to date. After reviewing the options with the client he requested the remaining impound be refunded and all outstanding impounded funds were wired to the client's account. We also filed reports for the client where they had indicated that the new service was providing that service. One of the fees indicated in the complaint would have been abated had the client not already been in the arrears previously. We offered to pay the federal liability timely but the client rejected the offer and we wired the funds we had impounded so that the client would have them in time to make their own payment.
Our clients are often not skilled in payroll and we work hard to help them through the many issues that can be confounding to them. We made several accommodations for this client and we did get off to a bad start but we cannot take responsibility for management. We only charged fees for two payrolls and the adjustments payroll and special payrolls were done a no charge. We do not feel any obligation to do anything more for this clients or to absorb any penalties or fees that they may have been assessed.

Expedition had to do 9 payrolls for 3 pay periods as they kept screwing up. Some employees were over paid, some underpaid, some no pay at all. Expedition did not collect unemployment tax, the federal tax collected fell extremely short, the state taxes were impounded but never filed. Proof from email;

Your taxes are paid current but not all of your taxes have been impounded so I will either have to impound them for payment or you can pay them directly. We will send you a report so you know what needs to be done.
Expedition had charged for quarter one filing on 3/3/2015 but never did the filing. I had informed expedition I wanted quarter 1 filed, if they were unable to do so, I wanted the final numbers (as there were so many screwed up payrolls I did not have final number from them). I had asked Expedition to submit Qtr 1.

Wells Fargo will be doing this for you so you don't want us to do it. We will send you a reconcilement of your taxes but they will make the payments for the first quarter based on their email. This is typical.
Expedition also states I was arrears previously on my taxes, to which I was not.
I have all emails with Expedition as well as documentation showing that they were paid to do a job they never did and I got stuck with the fees for their incompetence.

All the taxes fully impounded were paid on a timely basis. Our agreement is in effect until termination. The client may not have understood when he terminated what obligations he was undertaking. Although we understood at the time the client terminated that their new service would submit outstanding reports due in April for Minnesota Unemployment, they had not. We offered to do so and did submit the Unemployment Insurance report. The report was late under the circumstances and client was assessed a late fee of $250 for the report we submitted. Normally the state will abate this penalty for a fist time error but it was denied in that the client had been late previously with a previous report.
We also gave the client the option of having us submit unpaid and un-impounded Federal withholding taxes if they would provide the funds necessary, but they elected not to and we returned the impounded funds we had by wire to their account so that they could complete the payment on time. We also explained how to do this.
The client feels that we should pay fees but we have already waived several processing fees and all of the early termination fees. As per the agreement the client owes $400 (see below item 8. excerpt from the agreement). We feel we have been as generous as we can under the circumstances.
8. The agreement will be in effect from the date of acceptance by YPPCI. Upon termination of service, client agrees to thirty (30) days written notice of its intent to terminate the agreement or failing to do so pay a $250.00 termination fee. All clients leaving the tax filing service shall pay a termination service continuance charge of $150.00 to cover costs of required follow-up after the discontinuance of service. Should client leave YPPCI tax filing service owing tax balances and/or fees to YPPCI, the officers of said client agree to be held personally liable for the deficit amount.
