Which is about 30%+ more then he originally quoted us for the job. The work load never changed.  We never added any more work to the job then he originally quoted on doing. [redacted]s quoted price of $2500-$3000 was about 25% higher then other bids we had gotten for getting the same work order done. However [redacted]s was available to start when we needed him to. So even though his original quote was higher, Explicit Exteriors decided to award him the job. [redacted]s worked alone, never had any helper of any sort. Multiple times, Explicit Exteriors had to lend helping hands and labor to assist him with the tasks he was hired to do because he never brought his own helper with him. Against Explicit Exteriors better judgement we had already paid [redacted] again roughly 30% more then he originally quoted. It has been almost 2 years since this job took place, so forgive me, but I believe we paid him right around $4,300.00. We were upset to pay so much more then he originally quoted us, but we needed to get the work he started done for our client. Becuase we have never and I mean never left any client with a job we were hired to do not complete. So I was blown away when [redacted] tried to hand us a Bill for over $10,000!!! Review: This company was contracted to renovate an apartment in Westchester County. He was not able to find someone who would do the job he need so he contacted me. I sent him the contract, he signed it and he began demoing. I then replumbed the water and waste. I received my 1st payment for materials I purchased and some labor. Then I went back many times because the they could not finish one thing at a time. Toward the ending of the job they abandoned it, I was left to finish it one my own and when I gave the final bill it was never paid.Desired Settlement: They should loss there contracting license and pay me in full for all my time and material put in.

Review: There are two issues I would like to get your help with resolving.

The first one is regarding a window caulking job that this company did on 2/**/14. I had this company install a new roof on my house on 4/**/12, based on the date of my check, so when I noticed a leak in my house on 2/**/14, I called the [redacted], [redacted], because I assumed it was a roof leak. He told me that it was not, after I described the problem to him, given that the water was coming in at the window level and not above, however he said he could come over to ser[redacted] it.

He sent two men and after they had been chipping ice away from the area for about 15-30 minutes, one of the men then told me that the leak was coming through the sides of the window and that it needed to be caulked. He told me I had two options of payment, either I could pay $400 to just caulk the window or I could pay $800 to also remove snow from my roof. I chose the lesser of the options, as I can only afford to fix issues that are in immediate need of fixing. I was not given an option for them to just charge me a ser[redacted] charge and leave, as [redacted] later claimed I was. After the window was caulked, the worker then told me that I should get a new window because it was really old and in need of replacement. I had wondered why he did not tell me this before he caulked it, as I could have chosen to put that $400 into installing a new window.

I later contacted [redacted] to ask him why I was charged so much money to caulk one window. He told me that he had to charge me surcharges, including fuel charges and the cost of sending two men for their time. I had asked him why he did not tell me this before he set up the job, when I spoke to him on the phone, because if I knew that I would be charged extra money, I would have hired another local roofer or professional to come and fix the leak, given he was sure it was not a roof leak. He refused to respond to this question. As I told him, I proceeded to get two other estimates, from local roofers, of how much they would charge to caulk a window of that size and remove the surrounding ice and was told the fees would range from $150-200. I also asked him why he did not explain this when I bought the roof from him, that if he had to come and it wasn't a roof issue, I would be charged all these surcharges. I specifically asked him, before he installed the roof, if I was close enough for him to ser[redacted] and in his ser[redacted] area and he assured me that I was. He did not mention anything about having to charge extra charges if he came to ser[redacted] a leak and it ended up not being a roof issue. I feel that these practices were highly unethical and misleading because if I knew, I may have gotten someone else closer to install the roof to begin with and I at least could hire other local professionals to assess follow up leaks. He refused to address these issues, yet kept telling me what a stand up guy he is and how much he went out of his way for me and how he was doing me all these favors.

The caulking around the window did not take properly and all that was left on my window was small, scattered pieces of caulking, which was not explained to me as being a possibility of happening when the work was done. My ceiling began leaking less than a week after they did the work to supposedly stop the leak, in the close vicinity of the window. So because I no longer trust him and this company, I told him that I do not want him coming back to fix this or assess anything else. He offered to send me a check to reimburse me $52.57 and I told him that I would accept this offer, yet he has not done so and I do not believe he will. I believe that this too is an unethical business practice.

Through many text messages and emails, I found that [redacted] had contradicted himself and been misleading several times. I found it all to be highly unethical and I have decided I no longer trust his words or want him coming to my house to fix anything in the future. When I looked for my roof contract, I realized I must have misplaced it because I could not find it. So, I asked him if he could please send me a copy of my roof contract. The first time he responded, he stated that I didn't have to worry about it because he had one. The second time I asked for a copy, he told me that he couldn't find it and that he had no information about my roof at all or when I bought it, although he ironically recalled other very specific details about our meeting and how and when the workers came to install the roof. He also contradicted himself again, as he first told me that he had to have had the contract before he began the work or else he would have never installed the roof without it and then he told me it was probably my fault that he did not have it because I didn't mail it back to him at the time. I proceeded to ask him how that could be because if he never received it back from me, then he would not have installed the roof. He did not offer to make me another contract or give me any roof information at that time. When I asked him a third time, for either a new contract or proof of purchase and warranty, he replied that he does not take orders from anybody and insinuated that I did not use a simple please and thank you to request it, which I did, several times.

It was very frustrating going back and forth with him on these issues and I should not have had to ask so many times. As I told him, when there is a leak in my home, I have no way of telling if it is due to the roof or another area leaking. If a get a leak in the future, I would like to hire a local roofer to look at it so that I do not have to pay his surcharges for fuel and two men or two fees to have him look at it and another local professional to fix the problem, so as to avoid his high surcharge fees. He told me that the warranty I purchased offers reimbursement on roof materials, if I were to have another roofer fix a problem, so as I told him, I would need to know this information if the time comes when I would need to use my warranty. The warranty is supposedly for 10 years. Given all of his contradictions about this and refusals to give me this information, I have been left wondering if I even have a roof warranty with him or a roof company. I believe I am entitled to request and receive proof of my roof purchase from the company I purchased it from.Desired Settlement: There are two:

I would like to be given the reimbursement of $52.57 that the [redacted] offered me to resolve the issue of what I find to be a highly-overpriced window caulking job.

I would also like to be given a copy of my 4/2012 roof contract or if that has been lost, a copy of a new contract or proof of purchase and warranty information of the roof I purchased from this company.

This is my response in support of my position on the matter between Explicit Exteriors vs [redacted]. My name is [redacted], and I am the [redacted] of Explicit Exteriors, Inc. I guess I should start from the beginning. My company installed a new roof on [redacted]’s home back in the spring of 2012. I had given [redacted] an estimate on replacing her roof, a few days before she had called me back and said she had completed her estimating process and had decided to move forward with my company for her roofing project. At that time, I remember that I actually had an opening in my schedule and had offered to come and complete the job for her within the next couple of days. [redacted] had lived a little over an hour from our address, so I offered to have my [redacted] meet her at her home the same morning that we were going to start her project, to have a contract signed as well as pick up a start payment for her roof project. My company does not ask our clients for a deposit upon contract signing, but we do ask for a start payment the day we start the project. [redacted] even left his home that morning about an hour earlier then we usually start for the day, to accommodate [redacted] so that this project would not interfere with her work schedule.

Job went very smoothly, no problems what so ever. We completed the roof, as promised. [redacted] paid in full.

Then, Sunday, the [redacted] of February, 2014, [redacted] had called My company in a panic. She stated she had water entering her home and believed the roof was leaking. I had said “No Problem” that I could send two mechanics right away to evaluate the situation. At that time I had started asking [redacted] about the water entering her home, and explained thoroughly to her that if I sent men out on an emergency call on a Sunday, that if the problem turned out to not be the roof, that I was going to have to ask her to pay a ser[redacted] fee. I had also told her that if the problem was not severe, and if it wasn’t causing any damage that it would be less expensive for me to send men during regular business hours, which are 8am-4pm Monday-Friday, which by the way I told her there would only be a fee involved if the problem was “Not” with the roof. Having to pay any money for any ser[redacted] at this time had seemed to be a major concern to [redacted]. So then I had asked her to send me some pictures, so that I could try to evaluate the source of the problem, so that I could try to get an idea of whether it was actually a roofing problem. For all I knew it could have been a burst plumbing pipe or some other source of a water leak. I was trying to be helpful and prevent [redacted] from accruing any ser[redacted] fees with my company. Based on the interior pictures that [redacted] had sent me,(which were of her window and her ceiling) I saw no sign of it being a roofing issue. The water was not showing up on the ceiling, it was actually entering her home at window level. So at this point I am still unsure if it’s a plumbing issue, a window issue, a siding issue, I could not tell from the photos. But I made [redacted] well aware that I did not believe it was a roofing issue, and that I couldn’t be sure what the problem was without thoroughly inspecting the situation. And that I suspected that fees were going to be required for my services. Now, keep in mind that I have no idea what I am sending my mechanics out to repair. So I send them with a Full size truck, loaded with equipment, tools, ladders, metal break, supplies…etc… I sent Two mechanics, because again I have no idea what they are going to be up against. The ground and roof are covered with over 2 feet of snow and ice, extremely dangerous for any 1 man to deal with to begin with.

At this point, my men arrive at [redacted]’s home, and immediately start evaluating the situation. They had found the window, in the area that the leak was entering the home encased in ice. When I say encased, I am not exaggerating I mean it was engulfed in ICE! The ice dam from the gutters was so bad that the ice had wrapped around the gutters, ran down the siding and engulfed the window in ice. This was causing the window to allow water to enter the home. One of my men, knocked on the door and explained to [redacted] what the problem was. He had explained to [redacted] that they could chisel away the ice, try to dry the frame of the window which was in very poor condition, and apply a silicant around the frame of the window to prevent any further water from entering her home. He had told her that the total for this ser[redacted] would be $400.00.. At this time, my mechanic had also suggested to [redacted] that she consider hiring us to also clear her roof and gutters from the 2+ feet of snow and ice, to prevent the ice dams from growing any larger, and possibly causing more leaks to her home. He had told [redacted] that we would provide this ser[redacted] for $800.00 total. So for $800.00 my men were going to clear all the snow and Ice from her roof, gutters and siding. My mechanic had give [redacted] a choice to hire us for either of these two ser[redacted] options. Nobody forced these services on her, she had a choice to either hire us for the repair at this time, or simply say “No Thank You”. At which point my two mechanics would have jumped back and the truck and returned to the other job that we had running at this time. [redacted] had chosen to have us complete the $400.00 ser[redacted] option, to just address the matter at hand at the time. So we did.

A few days later, [redacted] had called my office, and had told me that after speaking to some friends at work I believe, that they told her that paying $400 for sealing a window was a lot of money. Which, I understand, it is! [redacted] and I had many back and forth conversation regarding the mater, either via email or via text message. She had been demanding that I refund her some money. I very nicely tried to explain this whole situation to her, and how it had literally cost me $347.00 that Monday, the [redacted] of February 2014 to send 2 mechanics in a full size truck loaded with equipment which runs on Diesel fuel that is about $4.39 per gallon. I explained to her that my company profit on her ser[redacted] was about $52.67. At this time, I realized the she had some real financial concerns about having to come up with any money at the time for a ser[redacted] on her home that was not anticipated. I had felt sorry for [redacted] and offered to send back a refund in the amount of my company profit, which as I mentioned was $52.67. [redacted] then went in to telling me about how she had called Two other construction companies and asked them how much they would charge her to come out and caulk a window for her. She told me that the other companies told her around $200.00-$250.00. So she was unhappy with the refund offer I had made her of $52.67. (Please keep in mind, that if [redacted] would have called me and said she needed a window caulked, I would have been more then happy to do this for less then $200. But I would NOT have sent two men and a full size diesel truck loaded with equipment to handle any possible task at hand.) At this point, our conversations were going back and forth as I had mentioned earlier via email or text message. I was even kind enough to continually try to work this all out with her on weekends and late evenings, way after business hours. I really grew frustrated with [redacted], as she was saying my company was unethical.

Finally she had asked me for a copy of our contract, because she could not seem to find her copy. I assured her I had a copy and that it wouldn’t be a problem for me to provide her with another copy. Unfortunately when I went through filing cabinet, after filing cabinet, I had to inform [redacted] that I also could not find our original agreement. I had proceeded to tell her that I must have it somewhere, because I would not have invested almost $7000.00 into her home without some sort of signed documentation stating that she was going to pay me in full when the job was complete. Being that Explicit Exteriors, Inc. does not ask for deposits, we would be taking a 100% risk if we completed work for a customer without signed documentation stating that we will receive payment in full once project is complete. When I told her I could not find it, she accused me of being contradicting. As you could imagine I was growing more frustrated with this whole ridiculous situation I seemed to be in. I told [redacted] that if I could not find the documentation, that we could draw up new documents so that she and I could have records of her project. I then asked her two very simple questions about her project. I asked her if she roughly remembered around what month and year we completed the roof. I also asked her if she remembered what the color of the roofing shingle was that we had used for her roof. I simply asked these questions so I could list a date and color. My companies roofing contracts are all pretty much worded identically, with the exceptions of Customer name and address, date which project took place, and color of roofing shingle.

As far as her warranty, [redacted] has a 30 year, GAF Timberline architectural shingle, which because she had a Certified Installation company complete the install of the product, the manufacture will stand behind the product for the life expectancy of the product which in her case is 30 years, against any material defects. Explicit Exteriors, certified installer identification number is [redacted], this is the only number she will need to get her material covered in the event that the shingles are defective and fail prematurely.

So after all this, I agreed to send [redacted] a refund for $52.67 as well as new documentation for her roof installation. Apparently I did not send this refund or documentation fast enough, and now have received a letter from your department. I am terribly sorry about this inconvenience on your department, as I truly feel this whole situation is extremely silly. I provide an excellent ser[redacted] for roughly 75-100 clients annually, and I truly understand the value of a dollar, as I have a wife and three children myself. But I sometimes completely pojects for clients that are well over $150,000.00 and I have never had a complaint, and now here I am with a complaint against my company over $52.67. Which is part of the reason I agreed to send [redacted] a refund to begin with. I mean If I offered money back to any customer that just calls me one day out of the blue and says, “Hey [redacted], I feel that my new roof should have cost me $2000.00 less then it did, how about you send me a refund!” Well needless to say, I don’t think I could stay in business.

Once again, I am truly sorry that someone from your department had to take the time to review this silly complaint. Some people just cannot be satisfied, and I think that they think the whole world is out to get them!
