 It's unfair and unethical business practice for you to charge me and my son $600.00 for an educational trip that was canceled or transferred without any fault of mine.  Exploica please be aware that this trip is for 8 graders for 2016, by 2017 my son will not be age appropriate for the trip. 2. This trip has not been planned or scheduled . 3. Please refund me my money and keep the $99.00 nonrefundable fees that is what you're entitled to, please stop using business policy to steal my hard earned money.  4.  This trip is more than 1 year and 6 months away, what's your policy when a trip is in unforeseen future?

Please add your rejection comments below. Unfortunately,  the response above by Explorica does not adequately express their true offer.   They only offered the above if I would sign a waiver not to sue and also to sign a further non-disclosure.   Both of these legal documents are not adequate as the behavior of their personnel was abysmal.   Dealing with their current personnel in regards to this claim has also been somewhat problematic and accusatory.   I have stated clearly what I wanted, which is reimbursement not only for a trip that my son's health was at risk and ignored by explorica representatives, but also for expenses incurred due to their negligence.  That includes flights we had to make to get him back to the nearest US hospital and flights and travel expenses/lodging for my wife, son, and I to get back home from where he was hospitalized.   We have not asked for any other punitive actions.  Explorica despite acknowledging these actions has continued to stay steadfast in their current offer and the mandatory signing of other "gag order" and release of legal responsibility and culpability orders which when they are not paying my true expenses of their negligence is unacceptable.   I am asking that they do this quickly.   Some explorica comments: 1)Thank you again for taking the time to speak with me today.  I would like to extend a further apology, but more importantly I want to assure you that our conversation was not taken lightly.  I will work towards ensuring that this does not happen again, and your family receives appropriate compensation. Most importantly, the one question that I did not ask because, frankly, I was at a bit of a lose for words is how is (your son)?2) I am horrified.  I promise you, a little later than we would like, but this is going to be given the serious attention it necessitates.3)I understand you spoke with (explorica employee name) at length last week regarding your son’s tour. First let me express my compassion for what (your son) had to go through on tour, I hope that he is feeling much better. I understand your displeasure for how the situation was handled on our behalf, as well as the lack of communication following the tour. To date, we have:·         Removed the Tour Director from all future tours with Explorica·         Reviewing partnerships with our operators in [redacted] for future business·         Began an internal investigation and learning loop on this emergency to guide us in the future I would like to offer a refund of $1000 to your family due to the situation and lack of follow-up as well as a standing credit of $750 for any member of your family on any future Explorica tour. Please let (explorica employee) or myself know if there is anything else we can do for you.4) I apologize for the delay in response, this is a unique matter and I wasn’t aware of your limited timeline. I believe that we can come to an agreement, however any significant agreement would include a release. My understanding is that you have already begun to post your story, I would ask that you remove the posts so that we are able to work towards a solution in a timely manner.5)I'm sorry to say that if you are set on receiving more than the cost of the trip then lawyers will need to get involved on both sides. I should also note that Explorica did not receive a penny back from the airline for the flight home or the hotels and activities, when we offer the cost of the trip this is money that was already spent we are offering. Finally, since this is a large refund for Explorica I feel much more comfortable, and would insist, that you sign a simple release in order to receive the money.6) We absolutely would like for you to sign a release. Without a release you could take this refund and then go on to also get lawyers involved and bring action against us anyway (for instance). We would like the matter closed and a release would be the only way to guarantee that it is closed.These details from emails from explorica show the true offer and the acknowledgment of the behavior of their staff. I have not even included other issues that could be more problematic.  I have asked for the above terms I have outlined and basically would walk away.  But this is the absolute final time I would do so and I believe it is extremely reasonable considering the nature of the problems outlined in the initial complaint.  I understand but disagree with their stance and I am considering sharing through multiple platforms our true story to other parents so they consider the possibility of an  unproperly vetted and uncaring guide and Explorica trips.
