Initial Business Response /* (1000, 6, 2015/05/18) */
We've done quite a bit of filling in and would be willing to do a $2,refund and resolve the matter
Initial Consumer Rebuttal /* (3000, 8, 2015/05/18) */
(The consumer indicated he/she DID NOT accept the response from the
business.)
since the original payment was for $there was in no way $worth of filling inMy guess would be more like a $refundalso Since I've been promised refunds for the past months , how can I be sure to receive any amount I agree to?
Revdex.com:I have reviewed the response made by the business in reference to complaint ID[redacted] and have determined that this proposed action would not resolve my complaint. For your reference, details of the offer I reviewed appear below. The business has just restated their earlier claim that their copy of the [redacted] kit is somehow superior to the [redacted] kit offered by their competitor. They claim that this somehow exempts them from honoring their guarantee of beating their competitor's price. As I stated in my email, that is unconvincing. They said they would beat any competitor's price and they should keep their word.
I thank the Revdex.com of San Diego for providing a neutral public forum in which such deceptive advertising practices can be discussed and made visible to other consumers. It is my hope that the management of Express Companies Inc. decides to change the wording of its advertisements and apologizes for its actions. In the meantime, I have already purchased an [redacted] elsewhere.Regards,
[redacted]
Review: I was shopping for an [redacted]. Express Companies, Inc. offers a [redacted] and claims prominently in multiple places on their web site:
- "Lowest Price Guarantee"
- "We'll beat ANY price"
- "Our online prices are already $[redacted] off, but call Toll Free for more discounts or to have us BEAT any quote from any Authorized Dealer!" -
The words ANY and BEAT are bold, underlined, and italicized for emphasis on their page. The URL to the web page in question is [redacted].
I found a competing site, [redacted] which offers the same [redacted] for $[redacted] less. I contacted Express Companies by phone, cited their beat-any-price guarantee, and asked them what their lowest price would be. The operator asked me to email her the URL to the competitor's site, which I did. A day later, she replied saying they would offer me the same price as their competitor. I explained that "beat" implies lower, not matching their competitor's price. They disagreed, insisted on only matching their competitor's price, and tried to convince me that their copy of the [redacted] was somehow higher quality than AED Superstore's copy.
I offered them $[redacted] for the [redacted]. They said this wasn't a bidding process and told me to take my business elsewhere.Desired Settlement: To remedy the situation, I recommend that Express Services management:
1. Use the word "match" instead of the misleading word "beat" on its web page.
2. Send me an email admitting that their advertising practice was misleading and apologizing for having wasted my time.

Response:
This customer asked us to beat a price for a different product package. We explained this to the customer. Our guarantee is for like items, not generics. The customer didn't "offer us $[redacted]" he first offered us $[redacted] (to our $[redacted] "match price") even though our package was for all name brand, and the product he wan[redacted] us to match was their "house brand"/generic for almost all components as can be seen online.) The customer then threatened us with a Revdex.com complaint if we didn't accept an even lower price of $[redacted].Here is the entire email exchange (please read bottom up):

Yes, [redacted], you are
correct – in 22 years of business we’ve had one other complaint – and it was
resolved amicably which is why we have an A+ rating.
We have offered
superior product to what you asked us to match/beat, at a match price.
We cannot “beat” a
price for generic/substitute items which we do not carry, just as nobody could
match or beat our price for our own brand products. This is why our policy
online refers to Authorized Dealers of [redacted] products – the “package” you
want us to beat is not all of [redacted] Brand.
Our price is, in
fact, lower on the actual brand name items, but we cannot offer products
unavailable to us.
Thank you for your
interest, but this is not a “bidding” process, nor do we feel a need to respond
to “threats”. Please take your business elsewhere.
We hope you continue
your goal to provide the caring gift idea of supplying your parents’ home with
this lifesaving device, but please look to another company to assist you with
your order.
Thank you and Happy
Holidays! Have a Safe Day!™
