Their valet driving in Charlotte NC wrecked my brand new truck and this company is refusing to cover the damages and wont file an insurance claim
I gave their valet drive the keys to my brand new truck and about 2 hours into dinner they came to the table to tell me they wrecked my truck. The owner in Charlotte NC told me everything would be taken care of and that Express Parking will cover all the costs. They admitted fault, and gave me a claim form the driver filled out. After speaking with their claims department, they are refusing to pay the costs of the repairs, the full cost of the rental car which I had for 2 weeks becuase of how long it took to fix the truck, and the diminished value from their accident. I have hired a licensed appraiser to define the dimished value. I paid for the repais and the rental out of my own pocket. The valet company is also refusing to file a claim with their insurance company to pay for the damages.

Desired Outcome

$3,463.17 repaid to me for the repairs of the truck $943.94 repaid to me for the rental car during the time the truck was in the shop $ 7,836.00 paid to me for the dimished value with supporting report from licensed appraiser $250 paid to me for the costs of hiring a professional appraiser In total - $12,493.11 in total damages of the wreck from Express Parking

Express Parking has been a leader in the parking industry for over 29 years with operations in 3 states and many employees with dozens of locations ranging from hospitals to office complexes to restaurants. Express Parking provides parking services to over 5000 customers per month. We consider issues regarding safety of our customer's vehicles to be very serious, and we work to prevent incidents like these through rigorous pre-employment background checks and training programs, as well as strict policies and procedures in this regard.

The customer received a check within 3 days of submitting estimate including reimbursement for $50 a day for rental car based on owners repair shop time. An additional check was sent for damage body shop did not have on first estimate. Express Parking paid a total of $4167.23.

Customer has chosen not to cash the checks because he wants depreciation.

My insurance company nor any other would not pay depreciation, I recommended he turn the claim over to his insurance company and have my insurance and his company settle claim.
He has refused to turn claim over.

We do not cover the cost for gas mileage or any optional insurance coverage on vehicles we only pay normally for Compact cars only in the customer case he has received more than enough to cover rental expenses, customer chose to rent the most expensive car available.

This type of situation is very rare among our valet employees, in part due to our careful background check and training program for new hires. Prior to employment, every single prospective employee is subjected to a rigorous review, including: criminal background check; drug screening; and motor vehicle record check. If a prospective employee passes the background check, they then undergo a training program in areas such as valet driving, customer service, safety and professionalism.

This incident is unrepresentative of the typical day-to-day interactions and services provided by Express Parking as well as the men and women who work at our locations nationwide. We remain committed to serving the people in the Charlotte area with a high level of professionalism and customer service.

This is not the first time they have had issues in Charlote. There is a news story from a couple years back about a driver wrecking someone's mustang that included flying debris hitting another parked car nearby.

I am not asking for "Depreciation" there is a key difference between that and diminished value.

The diminished value to my vehicle totals $7836 as established through an independent Diminished Value Appraisal commissioned on February 3, 2020. Please find a signed copy of the Diminished Value Appraisal enclosed for your review.

That amount represents the reduction in my vehicle's market value occurring subsequent to being in the accident and then repaired which has been expertly and comprehensively calculated using local dealer comparables. In effect, the accident caused my vehicle to sustain accelerated depreciation.

A reasonable person will not pay the same price for a wrecked, then repaired vehicle, as they will for a vehicle with no prior accident history. Additionally, my vehicle no longer qualifies under the Certified Pre-Owned Ram program which impacts my trade-in options of the vehicle. Even if the repairs are satisfactory, the vehicle has still lost value. It is this inherent diminished value loss (which is independent of the thoroughness or quality of the repair) for which I am seeking compensation from youthe at-fault driver.

This is indeed a third party inherent diminished value claim and is compensable in the state of North Carolina pursuant to tort law which demands that an injured party be "made whole".

And yes, Insurance companies do pay diminished value when it is brought up to them with evidence to back it up like we have.

However you wouldn't know becuase you didn't file a claim or talk to your insurance company about it. I've talked to them multiple times and they have no record of you contacting them or filing a claim.

I could not cash the checks you wrote, becuase you wrote in the memo line "Endoresement relieves EP of all future liability" of which I do not agree.

The coopeartion of the Express Parking team has been poor at best. They are extremely difficult to deal and customer support is sub par. Its not a surprise you're not a Revdex.com accredited company.

They tried to con me from the beginning by offering to send me a check for my dedicutable and to have my insurance cover all the damages forcing my rates to go up.
