upon giving quote,gave deposit Dec1 for $850.00 for a job to finish on Dec8, refused to begin on dec10 and agreed but is not refunding deposit
Hello, Mr *** provided a quote and agreed to take on the job, as requested on dec 1st I provided him a deposit for $850.00 and he agreed to complete the work on Dec 8.
After several attempts trying to reach him, he finally replied on Dec 10 that he will not work on this job and will send me my deposit on dec 15 in the full amount of $850.00 via email transfer but he has not sent the refund and is not reachable.

Desired Outcome

Please I need assistance from Revdex.com for the compnay to provide my refund of deposot $850.00 as he refused to do the job after taking my deposit.

Exquisitely Contracted, owned and operated by *** (***) *** was hired for repairs and renovations at *** Windsor, ON. Various repairs remain outstanding, he continues to promise he is coming to the site and then does not show up. The windows installation at the property is not complete leaving the building structure exposed to the elements. We have various correspondences via text that he will show up at a certain time then he does not, does not attempt to contact us or even answer our calls. Our entire renovation has been brought to a standstill because he is not satisfying or completed the agreed upon contract and our building is being damaged by the elements while we wait for him to show up.

Desired Outcome

Finish the job We would like the agreed upon contracted repairs/renovations completed. We want an agreed work schedule planned and precisely followed. We do not want to have to continue waiting for him to show up at times he says he will, adjusting our schedule to him, only for him not to show up.

My name is *** and I'm the sole owner and operator of Exquisitely Contracted. Thank you for taking the time to allow me to preserve my consumer goodwill, as I take this very seriously. I was in fact hired to do repairs and renovations at *** The first time I met with *** and *** we spoke of doing the windows in unit 1 and 2 as well as an upstairs hallway, renovating the kitchen in both the units 1 and 2 as well as the various plaster repairs and removal of some plaster and install new drywall (approximately half the rooms worth) in the downstairs units 1 bedrooms. After we negotiated the price of the work, I notified them that at the time I was the only one working for the company and I would only take on jobs that I can handle on my own. I also stated I'm a full time college student in a law assistant program. My daily hours of work would be from 2pm on and there will be days I need to take of as I'm also a full time parent. On a few occasions both *** and *** argued with each other. At the time I didn't think that much of it, as I thought they were excited for the job to commence as I was also. To my knowledge *** is the full owner of the company ***. Work started approximately around April 15th. Within this time frame I hired a general labourer for random cleaning duties and just to have a helping hand on site as he had no previous construction experience. His name is *** Both *** and *** were not in town but we made arrangements for me to get keys to the units and *** gave me a deposit for materials to commence the work in unit number 2's kitchen upstairs. I finished as much as I could complete with the given materials I had at my deposal and much of the time my job consisted of was dry time in between the mud and paint. I filled in random locations on the walls and ceilings in an attempt to flatten them out so they would cosmetically appear flatter. The walls needed 5 coats of paint. I asked for them to send more money for materials via the internet but *** reassured me he would be in town within a weeks' time and there wasn't any rush as he was unable to send more funds via the internet. As of April 30th I asked *** to be a work reference for Exquisitely Contracted and he agreed to this. A screen shot of this is available upon request. At this time *** added many more contracts for both unit 1 and 2. In or around the first week of May I began to be confronted in an unprofessional manner by *** on a few occasions. This involved some swearing at me and name calling to my employee ***. On May 5th myself, *** and my driver went for lunch and *** called me yelling and swearing at me asking where we went. I stated we were out for lunch and I didn't see the need to tell him we went for lunch but we would be returning within an hour's time. Upon our returning to the jobsite I felt the need to record the conversation I had with *** as he was slurring his words and swearing at me again. ***. He was verbally questioning my character asking about my personal life and called *** a *** and ***. I had to remind him these things aren't relevant to my tasks and me doing my job and to only direct questions to me that would pertain to my job at hand. I have this recording available at the request of the Revdex.com. In or around this time *** made a payment plan to pay me $500, this payment never happened. I have another recording of *** refusing the payment blaming his father for non-payment on May 15th, this said recording is available at the Revdex.com requests. Even in this conversation where the tone was neutral every other word from *** mouth was "***." After the conversation he left the unit and we began work. In or around this time I hired another general labourer named *** By May 13th I sent *** a text message stating his swearing and attitude are affecting our ability to fulfill the contracts we had with his father ***. I asked if he continued this behaviour to remove himself from the site to ameliorate the hostility on site. After this *** became hostile towards me as well. He did not respond to my calls or text messages even though they were dealing with our contracts. Upon ***'s return to the job site tensions were apparent between all three of us (Myself, *** and ***). They both argued about specific job tasks, they argued with me about the level of completion of the work. I tried to explain to both of them that the level of work and coats of various materials such as paint and mud are high because of the condition of the unit before we commenced our contracts. The walls and ceiling had cracks all along them, the floors were in bad condition and everything was extremely dirty and in serious need of repair to my knowledge. Unfortunately, tensions have not subsided and have only gotten worse. On May 23rd *** called me while I was at school on break. He was screaming at me so loud my teacher and classmates heard him. He then proceeded to say "*** you" to me. At this point every conversation or meeting I had with either *** or *** involved them swearing, yelling or insulting myself or my employee's. *** said no one showed up before I was done school but he asked for my employee *** to help him on another project at the building on *** as he needed help. I allowed *** to go help *** but *** took him to a job he had for his own personal company. I followed this up with an email to *** as a final warning as I cannot complete the job under these conditions. A screen shot of the contents of the email and the letter I sent is also available upon request. The following day myself and *** apologized to each other and came to what I though was an understanding on timelines and acceptable behaviour as these seemed to be the main issues on both sides. *** said he was very happy with the quality of work and he couldn't say anything about the work that was completed but his issue laid with the timeline strictly. I asked *** to deal strictly with himself as the relationship between *** and I was broken to my knowledge, he agreed to this. Work again commenced but only after a few days *** became very hostile and the swearing and yelling began again and his final action to me was slamming his son's truck door in my face while I was trying to work it out with him and he proceeded to drive off. I left the job site with all my tools except a paint pool I left in the upstairs unit that was securing down a panel of the tub enclosure as I planned on returning once we settled the issue again. On May 30th *** made first contact since that incident. He stated to return the keys, return an air conditioning unit that *** threw away as scrap and to also return any tools I borrowed. I told him work would commence when he paid us and the professional behaviour improved. I also stated I left all of their tools on site and didn't take them with me. *** has contact both *** and my driver *** A for them to work for him full time since in or around the middle of May. This was also in the letter I emailed to *** on the 23rd. Proof of *** breaking the payment is also available upon request. *** stated I had only this day to return to the jobsite to resume work after telling me to return the keys but I wanted to ameliorate the situation. I stated I would like to finish the job but I wouldn't be able to attend the jobsite until Friday it was Wednesday at the time of this conversation. *** stated this was unacceptable and threatened me with another contractor finishing my work and me being responsible for any associated costs is also available upon request. It was raining this day so I couldn't complete the windows but did say I would finish the grout upstairs but by 7pm he messaged me stating it was too late for me and not to bother him again. When I left the job site for the final time on May 27th, I took photographs of the entire units as well as the exterior sections of the building we did work in. There was no damaged present in any of these photographs and are available again at the Revdex.com request to see them. His last message to me stated for me not to return at all. Never in any circumstance was I or any member of my crew hostile towards them, we never used vulgar words, swore at them or even raised our voices. As per the customers desired resolution seeing as *** isn't the owner of the company who hired us to do the contracts and is stating other than what the owner is intending only further demonstrates the unbalance in their behavior and job goals and my difficulty to do my job and find a suitable line of agreeance as they both have done to me on several occasions.

*** and his company Exquisitely Contracted were hired to complete 3 jobs: intall windows and all flashing, finish unit #1 and finish unit #2. Despite receiving a deposit prior to starting the job, two advances and requesting another advance claiming he only received one, none of the jobs were completed. He would repeatedly show up for work then disappear to go provide other estimates to other potential clients, would often not show up at all despite assuring us he would be there and caused the projects to be severely delayed by weeks. He is not a competent contractor, has no transportation or tools of his own and often leaves inexperienced workers unsupervised for lengthy periods of time which contributed to one of his workers breaking a radiator pipe with a sledgehammer, after he was warned not to let his workers unsupervised. Whatever fiction he provided in his response does not in any way address the fact that he was hired for 3 specific tasks to which he readily confirmed his ability to complete yet did not care to finish once he realized he was far behind schedule and no further advances would he forthcoming. He is the epitome of the nightmare contractor. He overpromisses, underdelivers and drops the job after he has squeezed as many funds as he can from the job. I do not recommend this company or contractor in a way shape or form. The absolute worst contractor I have dealt with in many years. Bottom line: if you want the job done and done right, do not hire *** or his company Exquisitely Contracted.
