To Whom It May Concern: In this letter the company being summoned by the Revdex.com, Orbitrom USA Inc, dba EZ Motors, will be referred as, "we" and/or "us." The customer's name will not be disclosed in order to
protect its privacy; however it will be referred to as the customer, the buyer, the consumer and/or the individual We are very surprised that our customer, the buyer of the Toyota Tundra has submitted a complaint to the Revdex.com However, we are very thankful that the Revdex.com has given the opportunity to us, to write back and clarify our side of the story We have been in business for five years by now, and we have treated every customer the same With this particular customer it was no different, we feel that we treated him with courteousness and very fair He was allowed to inspect the vehicle before the purchase and was explained thoroughly every part of the contract and agreements he signedThe buyer was allowed to test drive the vehicle twice with no obligation to purchase The individual was out driving the vehicle for more than an hour and a half The consumer also advised us that before he bought the vehicle and signed any paperwork, he was to get the vehicle inspected by a mechanic of his choice During the test drive he was to take it to a mechanic to get it looked and get a professional opinion on the vehicle's mechanical status We do not have knowledge of what mechanic it was taken to during the time the customer was out test driving the truck However, we assume that the results given by the mechanic were satisfactory to the customer because he called our office to get the total amount of the vehicle with TTL included He stopped by the bank to withdraw the money while driving our vehicle stillThe buyer did ask if we had any previous history on the maintenance of the vehicle We answer by stating that we did not have or know of any previous maintenance history Since the vehicle was bought at an auction it was impossible for us to know of any maintenance background Although, while in our possession the vehicle drove fine and showed no mechanical flaws, we can not give warranty in any way because of the lack of previous maintenance history We further explained to the customer that we don't like to think badly of any of our customers, but the fact that we don't know how everyone treats their vehicle was another reason for the vehicles to be sold AS-IS After this was explained to the buyer, we encouraged a test drive and if the customer wanted a professional opinion on the vehicle by a mechanic before the sale All of this was permitted by us to the customer free of obligation to buy the truck We like for our customers to feel happy and satisfied with the vehicle before any paperwork gets signed We make sure that the customer also understands what stands for, and that the vehicle has no warranty and non is expressed in a verbal or written way The customer signs as agreement and the buyer's guides showing "No Warranty" to express his consent and his understanding of the vehicle having no warrantyEven though every car we sell is sold "AS-IS" we decided to help the customer after he contacted us with issues two days after the sale was completed We acted in good faith in an intent to help the buyer even when he signed and agreed that we would not be held liable or responsible for any fixing, cost of parts or labor needed for the vehicle in such event the vehicle needed repairs done; regardless of the length of time the customer had the vehicle in his possession We tried to settle the issue by having an independent, but trusted mechanic work on the vehicle, while we could cover part of the total cost When the customer and us talked on the phone, both parties agreed that the estimated cost for the damage repair would be around the sum of $not $like customer now claims We could only estimated the cost of the repair by what the buyer stated was wrong with the vehicle, however he also confirmed the amount with his mechanic and we agreed on said amount We offered to pay most of the expense and only have the customer pay an amount of $The customer demanded for the vehicle to be fixed by a mechanic of his choice located in Seguin, Texas, since we were not able to see the vehicle and diagnose the issue we denied his demand and suggested that it would be easier for us to have the truck in our possession for it to be inspected by the mechanic and have full control of the situation, to avoid any damage being blown out of proportion by the Toyota dealership We also reassured the customer with a time frame of days in which the vehicle would have been repair to full working condition, along with this he was to get warranty for the job once it was completed These terms were accepted by our customer, and both parties had now entered an agreement where the individual was to deliver the truck the very next day for the mechanic to start workingThe agreement was breeched by the individual when he failed to deliver the truck at our facilities or to notify us that he would not show up After several failed attempts to try to get a hold of him we left voicemails to contact us He returned the call later explaining that he was stuck at work and that he was not able to bring the truck We reschedule for the truck to be delivered two days later on a Monday The buyer again failed to deliver the vehicle the following Monday, we tired to contact him but we were not successful He returned the call the next day, and stated that he had already taken the truck to his mechanic in Seguin, Texas and that the mechanic had already started working on the vehicle The customer also stated that he would rather have his own mechanic work on his truck than us, due to lack of trust Since the customer was not willing to follow or terms we could not help him the way we would have wanted to, however we offered him to pay for all the parts needed for the repair as a sign of us willing to help him out still Customer said that he would get back to us once he knew the parts needed, he as yet to contact us with the list of needed parts for the broken head gasketCustomer states that we told him that the radiator was changed by us due to a hairline crack, this statement is false We did not change any pieces of the truck or used any "temporary fix." The buyer has always dealt with someone when he called our office, however he has failed to show up at our office or contact us after our last conversation over the phone We feel that if someone has a real major issue and really wants to come to and agreement to get it resolve, that individual should do all required actions to reassure the success of the settlement However the buyer has not shown interest in dealing with us, because he breached the agreement him and us came to, and also failed to visit or location if such allegations are true that we would not answer his calls or fail to return themThe individual feels that is dangerous to bring the truck to us for the fixing for reasons that are unknown to us; he has also made very clear his lack of trust Both feelings of danger and distrust are now mutual by moth parties, it is very dangerous to comply with demands to pay for something we have not been allowed to evaluate, and further more has not been caused by us We feel that we have been very helpful and willing to come to a settlement along with being crystal clear with the customer before and after the purchase of the vehicle We also feel that the individual is taking advantage of our good faith of trying to help him, even though he signed and agreed to buy the vehicle and not to hold us liable for any fixing, parts cost and/or labor An agreement that he is defaulting in and such action we consider to be grounds for a law suitWe do not wish to engage in any legal matter with the customer; however we are willing to proceed by contacting the stated arbitration party in the arbitration agreement signed by the customer, if he wishes for it If the customer wishes, we are willing to pay for the parts needed to repair a head gasket at our cost These parts are the head gaskets, the valve cover gaskets, the intake gaskets, the needed gallons of antifreeze and the needed oil and filter for the engine Customer is allowed to contact us anytime to let us know about what he wishes to doIf there are any further questions or any further information is needed by the Revdex.com, please feel free to contact me directly to my office by phone or by email
