Review: Listed below are the complaints I am lodging to the Bureau of Automotive Repair concerning the mandated smog tests performed by "EZ SMOG & REPAIR", 2700 Florin Rd. #5, Sacramento, Ca. - station # RC264634; and it's Test Technician - ONE -[redacted], [redacted]: [redacted]. COMPLAINTS: (1) 01-11-14 EZ SMOG BUSINESS: EZ SMOG and the above listed technician WRONG-FULLY stated my vehicle had been supplied with the wrong aftermarket catalytic converter. SEE EXHIBITS: A-C-D-E-F. Would not pass smog test. (2) 1-16-14 EZ SMOG BUSINESS: EZ SMOG and the above listed technician stated to me that He would not retest my vehicle; seemly because of my challege that the aftermarket catalytic converter on my vehicle was in compliance for California, and there-by depriving me of a retest at a reduced price of $26.75, should I elect to do so. It should be noted that the EZ SMOG TECHNICIAN; [redacted], [redacted]: (EA634118); made the statement to me; (A DIRECT QUOTE) "I'M SAYING I'M NOT GOING TO PASS IT"; based on my aftermarket catalytic converter challenge. This occurred on 01-16-14 at Mediation, and before complaint # 3 was brought up for discussion. (3) 01-11-14 EZ SMOG BUSINESS: EZ SMOG and the above listed technician WRONG-FULLY was mute, did not respond face to face question about modification I had made to A.C. engine idle boost system. I asked thetechnician if this modification would in any way impact the related smog test.He would later say-at Mediation. (A DIRECT QUOTE) "I DIDN'T KNOW" (IRESPONDED WITH) "NO YOU DIDN'T SAY ANYTHING" (TECHNICIAN'S RESPONSE ADIRECT QUOTE) "I DIDN'T KNOW" AGAIN The technician wouldlater say at Mediation; a planned revisit arranged by phone to discuss a remedydated 01-16-14 in the PM; that he took up the issue of the A.C. engine idleboost modification to his boss, whom WOULD came to work at about 8:30 as Irecall. The Technician had already logged on to the state competer and the testwas under way at 01-11-14 at 8:27, just a few minutes before his boss came towork. Technician [redacted]: (EA634118) is certified, licensed smog technician and in my opinionshould have been capable to make the call on the A.C. engine idle modificationat the time I asked him is it would affect the smog test results, BEAR IN MIND THISOCCURRED BEFORE 8:22 AM the time I signed the Customer Estimate and WorkAuthorization. had he stated He didn't know if the A.C. engine idle boostmodification would impact the smog test, before the time he started the test, Iwould have delayed signing the work authorization, until a ruling was made onthe modification, affording me a opportunity to correct the problem. I further stated toTechnician [redacted], [redacted] that in my opinion He was obligated to give me somekind of response to my concerns about the A.C. idle boost modification to myvehicle, to not do so in lieu of the circumstances would constitute a BAD FAITHBUSINESS PRACTICE, to which He answered in a SHARP-ARROGANT VOICE: "I'MNOT OBLIGATED TO TELL YOU ANYTHING" then added "I DIDN'T KNOW."AT THIS TIME I ASKED FOR ALL MY MONEY BACK, $49.75. TO WHICH Mr. [redacted]SAID "NO." I INFORMED Mr. [redacted] THAT HIS ACTIONS HAVE COST ME A GREATDEAL OF TIME IN RESEARCH AND PERSONAL ANXIETY, AND THAT I will be filing aCOMPLAINT WITH THE BUREAU OF AUTOMOTIVE REPAIR. (4) 01-11-14 EZ SMOG BUSINESS:It would appair the above listed technician falsified a entry on the; (EmissionControl Systems Visual Inspection And Function Check Results); See:"FAIL-IGNITION TIMING: 99 A.T.D.C. It is obvious I couldnot have driven my vehicle to the test facility with such a ignition timing. Inreality the State B.A.R., Referee found the ignition timing to be right on themark, 20 B.T.D.C.; but found the engine idle speed out of specification, toolow at 670 RPM: SEE EXHIBIT B: EZ SMOG never addressed a engine idle problem,quite a contrast. IN CONCLUSION: SmogInspections are mandated in this county for the good of us all and I want to domy part, I also want to be treated fairly by the business that do these SmogInspections. I wonder how many consumers have wasted money on needless smogrepairs due to such in-confident smog technicians, I was almost one. Desired Settlement: REMEDY: (1) Investigate my allegations and take punitive and or corrective action if justified. REMEDY: (2) Order EZ Smog & Repair, Station # RC264634, to return the full service charge of $49.75 (Forty-Nine & 75/100) TO ME. Apology
