Review: Last year (2014), we accepted a proposal prepared by Bartlett Tree to spray two pear trees, one in the front yard and one in the rear to suppress trellis rust.

Early this year, we had two large pear trees sprayed by Bartlett Tree in Westbury New York (###-###-####). They trees were impacted by "rust" and we were told that the spraying would take care of it. As a note, many other trees in the plant have the same "rust." The sprayings were on 4/**/2015, 4/**/2015 and 5/**/2015. Each spraying was billed $228.11 for a total cost of $684.33.

I only observed the first spraying on the tree in the back and noticed that most of the tree wasn't sprayed. I called immediately and was reassured that they did a sufficient job and they would do a good job on the second spraying, which I did not see.

Nonetheless, the tree has many brown spots on its leaves and "dead" branches. The tree in the front has many dead branches on top while the tree in the back has dead branches on its side,. So I called Tom (###-###-####) at Bartlett Tree in July and left a message. A few days later, he left me a message that he was about to go on vacation but would try to come out to see the tree before he left.

After nearly three weeks without a response, I called and left a message for Tom describing the issue. He did not reply, so a week later, I left another message without any details. He did reply to ask what I called about and when I told him, he said he was driving and would need to check his schedule to see when he could come out. He wanted to also check which chemicals were used and informed me that the spraying would only be 95% effective.

So another week passed with no response. Tom gave me some ** that the nozzle made a mist which magically floated up thirty feet into the air and therefore they did not need to spray the branches....So I sent an email to Justin Walker, the head arborist. That evening (9/**) I received a call from Tom apologizing because he hasn't been in my area for four days (although a week ago he promised to check his schedule and setup a time to inspect the trees) telling me that he would be out tomorrow to inspect the trees.

So Tom from Bartlett came out today (9/**) to see the trees. After he saw the tree in front, he changed his claim to spraying is only 90% effective. He remarked that the tree in the rear of the house had more "rust" than expected. The side of the tree had many bare branches which he blamed on wind. I countered that the tree has been here for almost 20 years and never suffered wind damage like that. He changed his diagnosis to feeding, saying it needed deep root feeding. Because of the excess "rust", he was willing to perform the first spraying next year for free. We would be responsible to pay for the second and third spraying as well as all three sprayings on the pear in the front yard.

He said that their spraying was effective; otherwise the tree would have no leaves. I disagreed and noted that there are many pear trees in the plan, some just at the end of the street that look the same as ours and they were not sprayed.

I told him that we paid their bill promptly, and spent two months trying to get Bartlett to send someone out to look at the tree. Now they expect me to pay five sixths of the cost to try to correct the problem which they failed to fix and now the tree is further damaged. I told him I would prefer a full refund and I would find someone else to spray the trees next year. I was so disappointed in Bartlett's response and their unwillingness to even come and inspect the trees. Tom said he would need to speak to his manager and he would get back to me.

It’s now, September **, six days since Tom was supposed to speak to his manager and “get back to me.” There has been no phone calls, no emails, nothing. I believe that Bartlett Tree has decided to ignore their mistake and hope it goes away. I want other to know of my experience and perhaps they will find a more professional, more honest firm to deal with instead of being “scammed” by Bartlett Tree.

Bartlett Tree did not provide the treatments paid for and the trees are more damaged than they were a year ago. Furthermore Bartlett Tree continually ignored my requests to inspect the trees and once they did, they only offered to redo the first spraying on one tree as compensation. I was obligated to pay them for the other two sprayings on the pear in the back yard and all three sprayings on the pear in the front yard. So they offered $114.055 ($228.11/2) for failing to perform on a service that they charged $684.33 for. In addition I would be charged an additional $570.275. This is certainly higher than their cost and thus they would be profiting from their error.Desired Settlement: I expect Bartlett Tree to provide a full refund of the $684.33 paid because they did not provide the service (protection from Trellis Rust) that we purchased. They probably should be responsible for the additional damage which has occurred to both trees because they were not properly treated.

Bartlett tree experts have a total disrespect of property, boundaries and homeowners. If they return to my property, I will press charges for trespassing.
