Review: This business just repo my vehicle and I own the vehicle. [redacted](0owner) never gave me my pink slip& he just repo my vehicle with all my belongings

[redacted], I purchased a truck in or around 2007 and I traded in my ford escape and pickup truck along with [redacted] as cosigner.....I paid payments for over a year and then my husband took off with the truck and his it and went into prison. It was a hardship for me but eventually I paid fair oaks auto the rest of the money owed on truck. I never got the pink slip so I knew they were ripping me off because of the husband(nowx) taking the truck and hiding it..so now I don't have my truck at all..they just repossessed it.Desired Settlement: My 1989 dodge truck returned to me

Response:

The vehicle in dispute is a 1998 Dodge Ram Pickup which was purchased in 2007. The vehicle was financed in house by Fair Oaks Auto Sales. In 2008 the customers moved from California to the State of Idaho. Shortly after registering the pick up in Idaho the customers stopped making their scheduled payments.

Correspondence from both of the registered owners advised that they were separated and that each was expecting the other to make the scheduled payments. The situation was not amicable between the registered owners. Each claimed rights to possession of the vehicle, however, neither party made payment against the outstanding balance owed. Correspondence from each party indicated they expected the other to continue payment on the vehicle. Correspondence from both parties indicated the vehicle was being hidden. The complainant wrote letters encouraging the repossession of the vehicle and promises of payment should she be awarded sole ownership of the vehicle by a judge. In 2008 we were unable to locate the vehicle for repossession as it was indeed hidden.

We recently learned the complainant had regained possession of the vehicle, but had not contacted Fair Oaks Auto Sales to advise such. Neither purchasing party made any payments toward the outstanding principal balance of $5613.91 for over 5 years. The outstanding balance owed has been significantly increased as the result of accrued interest, repossession fees and transportation fees. Prior to the repossession the complaintant made it clear she had no intention of paying the balanced owed. Unfortunately, we had no choice but to repossess the vehicle.

Response:

After the above referenced vehicle was repossessed we received a call from a gentleman claiming that [redacted] had been letting him use the truck and that he had tools and personal items he wished to retrieve. He was given the phone number to the repossession company so he could make arrangements to pick up the personal items. The truck arrived in California Saturday December 28th and did not contain any personal items. If Ms. [redacted] has not collected her personal items she will need to contact the repossession company and make arrangements with them.

Mrs. [redacted]'s complaint regarding the revised outstanding balanced owed was explained in our initial response. Since no payments were received in over 5 years, interest, repossession, and transportation fees added significantly to the debt.

Consumer

Response:

The balance was paid off to fair oaks auto sales in 2011. They never sent my pink slip and they said they wanted more money. They sent me an amount of over $8,000! So they were not getting my property (my truck) .....3 years later, he comes out of the blue and takes my truck! These people are unbelieveable! They made a bundle off of me, when I traded in my Ford Escape and my pick-up truck. They made double on my Escape alone! Then I pay these people off and they don't give me my pink!!!!! I have the pay-off balance that I payed to them and the paper came from Fair Oaks Auto, and these balances that they are giving you, are not even close to what they sent me in 2010. I still have the paper they sent me with my balance. They should not be in business to do this kind of thing to people, and Im a senior citizen!
