THIS COMPLAINT INVOLVES MY LEASE AGREEMENT LANGUAGE INDICATING A $100 DISCOUNT IF RENT IS PAID ON OR BEFORE THE THIRD OF EACH MONTH. THE PROBLEM IS THAT THE LEASING OFFICE IS VERY SELDOM OPEN (MY TRUE ESTIMATE WOULD BE 4 - 5 DAYS A MONTH). WHILE THE MANAGEMENT OFFICE DOES HAVE A DROP-THRU-THE-DOOR, EXPERIENCE SHOWS THAT THEY CANNOT BE TRUSTED TO APPLY THE PAYMENT TO THE RIGHT RESIDENCE CAUSING A "FIVE-DAY NOTICE TO PAY RENT OR QUIT" NOTICE BEING TAPED TO OUR FRONT DOOR. WITH ME/US, THIS PARTICULAR ISSUE BEGAN ON NOVEMBER 4 2014 WHEN EXACTLY WHAT IS STATED ABOVE HAPPENED TO ME/US. EACH MONTH AFTER THAT, WE HAVE FELT THE NEED TO OBTAIN A RECEIPT IN EXCHANGE FOR THE RENT CHECK. THIS MEANS THE FACT THAT THEY ARE NEVER OPEN BEHOOVES THEM TO RECEIVE AN ADDITIONAL $100 DUE TO UNTIMELY RENT PAYMENT. THIS UNFAIR AND DISHONEST BUSINESS PRACTICES. THE PROPERTY OWNER IS THE PROPERTY MANAGER. SHE SHOWS LITTLE OR NO CONCERN WHEN THIS ISSUE IS BROUGHT TO HER ATTENTION GOING AS FAR AS SAYING "YOU'RE NOT MY BOSS". FURTHERMORE, WHEN I HAVE ASKED WHAT TIME TO PAY THE RENT THERE IS NO DEFINITE ANSWER. RATHER, ONE OF THE OFFICE STAFF SMIRKS THAT THERE ARE NO SPECIFIC BUSINESS HOURS POSTED ON THE DOOR. THE FACT OF THE MATTER IS THAT THE BUSINESS HOURS ARE POSTED ON THE FRONT PAGE OF THEIR WEB ADDRESS. I HAVE TAKEN A SCREENSHOT TO PROVE THIS IS TRUE AS OF TODAY'S DATE.Product_Or_Service: RENTAccount_Number: [redacted]Desired Settlement1) POST BUSINESS HOURS (WHICH APPEAR ON THE WEBSITE AND THEIR MULTITUDE OF CRAIGSLIST ADS) ON THE DOOR TO MATCH WHAT IS ON THE WEBSITE SO AS TO UNBURDEN THE RESIDENTS. 2) CORRECTLY APPLY RENT PAYMENTS SO PAYMENTS DROPPED THRU THE DOOR ARE POSSIBLE RATHER THAN A PHYSICAL VISIT WHEN YOU CAN FIND THE OFFICE OPEN. Business Response Fairway Park Manor is in receipt of this complaint on 06092015. This complaint seems to be very personal. We apologize if anyone on the Fairway Park Manor staff has done something to offend any of our Residents. This apartment complex has 100 units. Our office hours are Monday thru Friday 10am to 4:30 pm. This residents' claim that we are only open 4-5 day a month, is false. If needed I can provide a list of tenant references that can attest to the contrary. However, during business hours we periodically close the office to show vacant units, do inspections, walk thru units, address emergencies, use the bathroom, etc. Our phones are forwarded to a live person 24/7 in the event we are not in the office. This complaint refers to an incident in November 2014 when this residents' rent was posted improperly by our office. When I was made aware of the error, I apologized and sent a letter confirming they had a $0 balance. This resident has lived here since 2013, and this improper posting has only happened once. To date, this resident has never been charged a late fee. It is not a reoccurring event. The complaint states that we are not in the office during rent time so that we can receive an additional $100 due to untimely rent payments, is absolutely false.In the future, we would be happy to make an appointment, if needed, to accept rent from this resident to assure timely payments. Unfortunately, we cannot guarantee the office will be open at whatever random time this resident decides to pay rent due to the reasons above. With this being a 100 unit complex, many residents have been using the drop box system for many years without incident. We encourage this resident to give it another try in the future.Consumer Response (The consumer indicated he/she DID NOT accept the response from the business.)The response does not address the complaint which is this: The office is rarely open during the end of the month when rent is due, regardless. I do not complain that I have paid late fees. I complain about the lengths we have to go to in order to pay the rent on time and obtain a receipt. Further; since the response the property manager has taken a close interest in our unit. We have seen her talking to our neighbors and looking past them directly at our unit. Today we are given a taped notice on our door accusing us of being "offensive and unsanitary". While this is unfortunate, it is not surprising. We have documented the conditions of the items in this notice as mentioned pertaining to us - as well as elsewhere on the property. Final Consumer Response (The consumer indicated he/she DID NOT accept the response from the business.)These responses from the property manager exemplify their behavior when any communication is attempted. Meaningless words are given in response and expected to be received as valid. I am surprised that the Revdex.com expects me to respond to this again. What I have requested is FOR THE OFFICE TO ACTUALLY BE OPEN DURING THE POSTED BUSINESS HOURS - Not just a sign on the door with random hours. I have indicated and can prove that there was nobody in the office near the end of the month allowing me to pay my rent on time. It is my experience and opinion that the property manager intentionally drags things out in what appears to be a test of endurance. What is there to lose? The burden of on time payment and penalties are all construed against the renter. This complaint remains unresolved. These responses from the property manager are exemplary of their behavior when any communication is attempted. Meaningless words are given in response and expected to be received as valid. I am surprised that the Revdex.com is prompting for a response to this again. What I have requested is FOR THE OFFICE TO ACTUALLY BE OPEN DURING THE POSTED BUSINESS HOURS - Not just a sign on the door with random hours unattended. I have indicated and can prove that there was nobody in the office near the end of the month allowing me to pay my rent on time. It is my experience and opinion that the property manager intentionally drags things out in what appears to be a test of endurance. What is there to lose?
