Dear[redacted],

RE: Complaint ID[redacted]
The purpose of this letter is to respond to the above mentioned complaint filed by a
customer of ours. The customer had called us in...

October 2013 for an estimate because they
were having a leak in the basement in the area of the front (north east) corner of the basement.
Our estimator visited the property and provided the homeowner with an estimate to remove a
section of the paneling in the basement and to repair a wall crack. I have enclosed a copy of
that. Since the wall was covered with paneling and studding we provided only an estimate and
the source of the leak would have to be determined after the wall covering was removed. The
work was scheduled for November 7, 2013. We arrived around 9 am on that date to do the
work. Our technician removed the paneling and could not find a crack in the wall. He called
the estimator out to re-assess the situation. At that time the estimator observed evidence of
water leaking down the wall and water marks on the base of the bottom wood plate on the
floor that showed signs of a water leak. There were no signs of water or discolored wood in any
other part of the exposed area that would indicate there was leaking in any other area. The
scope of work was changed from the original estimate to address some bricks that where loose
on the exterior directly above the area of water marks on the wall and a 2' section of floor was
opened up to address a potential footer leak in that area. There was a contract provided and
an adjustment to the price for the revised scope of work that was performed to address the
area that showed evidence of leaking along the front wall. This area was approximately 4-6'
from the north east corner. The customer signed the contract and we advised them to leave
the walls open to make sure there was no other areas leaking. I have enclosed a copy of that.
On April 11, 2014 our production manager visited the property because the homeowner had
called and said their rug was wet. He pulled back the studs directly in the corner and found
there was a crack in the foundation and it showed signs of leaking at the bottom. He informed
the homeowner that there would be a charge to seal the wall crack and he would call them to
schedule the work. The homeowner informed our production manager that they would be out
of town for a couple weeks and the work was scheduled for Friday May 16. We needed to
move the scheduled date to Saturday May 17 due to a conflict and at that time the
homeowner's wife expresses her unhappiness regarding being charged for the repair. Our
production manager explained that the leak was outside of the area we had previously
addressed and there would be a charge for sealing it. The homeowner was not happy but
accepted the fact and the work was scheduled for Saturday 5/17/14 between 12 and 1 pm.
Upon arrival of our technician to do the work the homeowner stated they were not going to
pay for the work so our technician called our production manager and was advised to leave. I
understand that the homeowner feels we should fix the area in the corner at no charge
because the new leak is in the same vicinity of the area we worked on in November, however I
do not feel this is reasonable. It is our opinion that the area we sealed originally was not faulty
and did not fail. There is a new area that is leaking. This area is in the vicinity of the original
area but is not the same area. The new leak is directly in the corner at least 4' away from the
area we originally worked on in November. We did not do any work in that area or attempt to
seal any part of the corner. The original work was done in November and we were called out
regarding this leak in the middle of April. In between the two dates we experienced two major
thawing events and several severe rain events. There was never a call to address any part of
the work we had done previously in November. This was a very severe winter with a very deep
freeze for a long sustained period of time. That type of weather condition will cause excessive
pressure on foundation walls and cause wall cracks to open up and leak. Also, the
homeowner's gutter downspout was emptying directly onto the ground right in that same
corner. This condition will exaggerate any saturation or freeze expansion of the soil and could
cause a crack to open and leak. We have a very good track record and reputation in the
waterproofing industry. We stand behind our work and if our work would have failed there
would be no question regarding our willingness to address the issue. The homeowner had a
leak in an area behind a finished wall. We exposed the wall and addressed what was the most
obvious condition we noticed based on water patterns and staining. We feel it is unfair and
unreasonable for us to be expected to be responsible for areas that leak outside our scope of
work. If you have any further questions you can call me directly at [redacted] ext.[redacted]. Thank
you.
Sincerely,
[redacted], President
