Hello.  The information, dates & amounts, etc, that I need to submit a complete response is at the office.  Right now I can tell you that as soon as the checks came back we tried to contact her by phone and mail, for WEEKS, with no response.  I kept telling her she at least...

needed to come in to the office and talk to me, pay something towards the checks and we'd make arrangements.  In the meantime, her loan was getting further and further past due.  She said she'd come in and pay something, and not show up. When she finally did, and paid $30, I told her I would apply that to the checks, provided she come in by the end of the week and pay the balance.  I told her, several times, that if she did not, then I would apply the $30 towards her past due loan, and the checks were going to Bell County Hot Check Dept.  I guess she didn't believe me.  Evidently she got notice from Bell County and had the clerk call me.  I told her exactly what I told [redacted], that the $30 was going to be applied to her loan if she didn't pick up the checks, etc.  I'd been holding them for a couple of months.  There is a statute of limitations as to how long before the Hot Check Dept. won't accept them.

I am rejecting this response because: I don't think it's appropriate to announce to the world someone's disabled. Secondly, I never said I would not pay ever. I said I can't because I have to pay county or go to jail! I can't in my situation do both at same time. I had told your assistant my husband was in hospital and I had phone off most times. Then when he got home He had some bad reactions. They prevented me from tending to my business paying bills, was one. Yeah, you. assistant came out and spoke to my husband once. The other times I can't say if I was or wasn't home.  Once she went to m. neighbors and left card there then went back out to highway.  My neighbor came got me and showed me his video footage of it! As for the calls, you haven't been the one to call it was your assistant. I got three voicemails in one day, really. I should have saved them it was like she's almost yelling in the phone. I have had a couple people ask oh my God, who is yelling at me like that. Its not my cup of tea to call someone who just left me a voiemail and is either yelling at me raising their voice at me whatever you call it, I don't handle those situations well.

I am rejecting this response because:
She is ignoring the facts. First, she out right lied saying she didn't know if my checks were post dated. She knows the monthly payment was post dated!! Second, I did have communication with her assistant. Lack of communication between employees. I have been having some issues because the money was taken out of my bank, and redeposit. That part is not her problem at all. I did finally find a time that I could go in and she would be there. It was a Thursday, after my kids got out of school. I put $30 down and told her I would try and get the rest asap but, my family lives out of state. I could do nothing for 2-3 days easy. She said I had til next day to get there. I tried my best I had just over half and I got pulled over on my way there due to a officer seen my truck try and flip on right hand turns. I missed her by time I got a ride. It was too late. Also, I believe she took them that morning and had ever intention on doing so. I told her if it was I wanted my $30 to give so I don't go to jail. She wouldn't let her assistant completely fill out receipt. She told her leave Revdex.com it blank. The fact is that was a post dated check, I even have checks numbered after that with dated before then.. She lied to the court so she didn't get in trouble, and I have to pay more fees and could still go to,jail. Just so she can have someone else collect for her!!! The other I paid on, the court said it couldn't be processed if I did. I am showing them her statement here where she admitted that money was intened by me to go on the check. She told the court it went on my loan. The court clerk wrote and signed her receipt saying that money was for my loan not check per [redacted]. Thank you for admitting to one of your lies! As, for the rest the truth will all come out in the end. I am asking again quit calling my phone, do not show at my residence. I was called after her response on here!!

Her check for $140.00 was returned on 9-22-15.   I tried to reach her by phone and got her voice mail.  I wasn't too concerned.  Her checks have been returned before.   I only had to contact her  and she would take care of it very quickly.      Several days went by, and I still hadn't heard from her, so I started calling more often and sent  her mail asking her to please call me.   On 10-9-15, her check for $145.00 was returned. Of course I then tried to contact her every day by phone. On 10-21-15, after a whole month,  I decided it warranted a house-call, as now her loan was past due, also.  My assistant drove out there and spoke with her husband and he told her that he would deliver the message. I still heard nothing until 10-27. She called the office saying that the money was in her account, she didn't know what was going on, she was going to her bank to find out and she would get back to me. On 11-4, and 11-9,  my assistant drove out there again.  No one was home either time.      On 11-19, she called the office and told me someone had taken money from her account, and that she would come to my office the next day, on 11-20, which turned out to be another broken promise.     On 11-27 she finally came in the office.  She could pay $30, which covers the NSF fee for ONE check.  I told her that I would accept the $30 as partial payment toward the checks, if she could pick them up that week.  It had already been TWO months since they were returned, and I couldn't hold them any longer. She said she didn't know if she could do that.  I told her if she couldn’t, then she had to come to the office to make arrangements.  If she did not, the $30 would be applied to her past due loan and the checks were going to the County Hot Check Dept.  I still gave her another week, during which I heard nothing from her.  I turned the checks in on 12-7.        This is all for lack of a phone call.  I have been more than fair.  Her loan is now sufficiently past due to be reported to the credit bureau, which I haven't done yet.  If by "refusing to do business" she means not paying her loan, she will receive a form 1099-C, and will have to pay income tax on the balance, as the Treasury Dept. considers it income. I have no idea if this will cause any problems with her Social Security income.   I also have the option of filing for judgment in small claims court.
    So...I will stop calling.
