Review: On March **, 2013 I had an initial medical consultation with [redacted], who practices at the Family Medical Care of Marine Park, P.C. practice (Chief Executive Officer [redacted], M.D.). I do not know what the fiduciary relationship is between my (former) doctor, [redacted], and [redacted] - i.e. I do not know if both doctors are partners in the practice, or if [redacted] is merely an employee of [redacted]. At my initial Mar. **, 2013 consultation, I provided the receptionists with my Empire MediBlue Plus Medicare Advantage Plan card (and my member I.d. number). I was told by the receptionist that I owed an Annual Deductible for 2013 of $147.00 (paid with cash). I later received a call from the practice telling me that I owed $100.00 for in-house laboratory fees. I paid that via my check (which has been cashed.) After discussing these fees with several Empire Insurance representatives, I was told that I did NOT owe either the $147.00 Annual Deductible for 2013 or the $100.00 in-house laboratory fees. I have sent two letters to the practice asking for a refund, have had several telephone calls with the receptionist, and spoke to [redacted] on Aug. **, 2013 - WHO CLEARLY STATED THAT HE DID ALL THE BILLING FOR THE PRACTICE - requesting the refund. On Sept. *, 2013 I sent a letter to [redacted], clearly marked 'Personal and Confidential' on the envelope, again requesting the refund. [redacted] called me at home on Sept. *, 2013, referencing the letter. By referencing (and clearly having read) that personal and confidential letter to my (former) doctor ([redacted]), [redacted] unethically and illegally breached the confidential physician/patient relationship between [redacted] and I. As of Oct. *, 2013, I have still not received my refund.Please also note that I have NOT had ANY physician/patient relationship with [redacted] at any time, and he has never been my physician.Desired Settlement: I want a full refund of my $247.00 payment made to the practice. I also want [redacted] disciplined to the fullest extent of the law by every appropriate Federal, New York State and New York City governing agency (i.e. The New York State Board for Professional Medical Conduct, etc.), for his clear illegal breach of the confidential physician/patient relationship I had with [redacted].'

This letter is in response to our phone call on 10.*.13. Concerning a complaint made by [redacted] ID#[redacted].

I have enclosed a copy of my corporate check stub indicating check #[redacted] made to [redacted] for 137.00 and mailed on 9.*.13. She has elected not to cash this check as of today 10.*.13.

I have also enclosed a copy of her own insurance explanation of benefits indicating with circles lab work performed in my office that was not paid. This is the money I lost because she presented the wrong insurance card. Keep in mind I have no interest in being reimbursed or whatever financial loss we took here. I just want the harassment to stop.

She has written letters and made several phone calls, all of which demonstrate a person with erratic, explosive, inappropriate and unstable behavior both to myself and office staff.

She has turned a simple matter of presenting us with the wrong insurance into a terrible nightmare.

We see up to 200 people per week, many of whom have similar insurance issues. They are handled very easily and cheerfully. There was no need for any of this.

If by some chance or error by the Post office [redacted] did not receive our check, I will be happy to cancel the original and send a 2nd check. If she believe we owe her an additional 100.00 I will send that as well/

[redacted] will receiving a cashier check for 247.00. I cancelled the first check sent on 9.*.13 which she claims she did not received. I have also enclosed a copy of the cashiers check that. I have sent to her "Return Receipt Requested."

I am sorry for this misunderstanding on all our parts and all the miscommunication.

I have reviewed the response made by the business in reference to complaint ID# [redacted], and have determined that my complaint has NOT been resolved because:

I have not yet received the check [redacted] claims he sent. If/when I do receive it, I will deposit it to my bank account and advise the agency that I am finally in receipt of monies due me for almost six months.

HOWEVER, [redacted] HAS NOT retracted his libelous statements contained in his letter of Oct. *, 2013 to the agency, stating that I '...demonstrate a person with erratic, explosive, inappropriate and unstable behavior both to [himself] and office staff', and that I have 'harassed' him. His statement in the attached note he sent to the Revdex.com, that he '...is sorry for the misunderstanding...and miscommunication...' is NOT an acceptable response to my demand that he publicly retract the above noted libelous and defamatory statements. Until the agency receives such a letter formally retracting these statements I will consider my complaint to the Revdex.com as still unresolved. Additionally, I am commencing appropriate legal action with respect to [redacted]'s libel.
