Below you will find an email dated April 26th that was between myself and [redacted] in regards to her pool deckAs well this is a direct reflection on the complaint that was filedAs well the repair was started on June 1st and completed on June 8thMrsHall has since then added items to her punch list that we are also addressing however she is not allowing us to complete them until after a party she is having at her house June 20thShe has placed her patio furniture on the patio with full acknowledgement that the punch list would be completed today June 15thWe cannot be responsible for moving furniture nor any damage that may occur in the process."Good morning Susie,I wanted to get back with you in regards to your complaint about the [redacted] However I wanted to go over my notes prior to responding.After reviewing my notes we will be moving forward with removing and replacing the stones that you pointed out that you feel are trip hazardsAs well after speaking with my Factory representative, from [redacted] with regards to your concerns to the "sandy and washed out" look in the polymeric sandWe will be pulling out the non hardened material and replacing with fresh materialIt is believed that some of the material may have been mixed weak and did not hardenWe will grout the areas between the [redacted] and the pool edge as well as the [redacted] and the block for the patioThis will be a permanent fix for bothThe pool deck was up to your satisfaction from the time installation started on February 25th and when it was noticed that there was extra material you stated in a text "yesterdays work looks good" then requested on February 27th that additional material be laid downI was up there on March 2nd to measure the area you wanted to add and you signed a change order for only the labor and additional base material that was needed for $At this time there was only a couple of concerns with certain areas that you wanted remediedOn March 5th you stated via text " It is looking really good"On March 16th you stated via text " [redacted] s are broken in several places and I want them to replace before putting in place permanently"On March 18th you sent me an email from another email address that stated you had met with (2) companies in regards to the landscaping you were looking to get done after we were completedYou stated that those companies expressed concerns about how your deck was done and asked if it was finished and if there was another application that needed to be doneOne of the companies that you expressed came to look at your pool deck was [redacted] which a company that is not only in direct competition with our company but as well in direct competition with [redacted] which is ***'s company I suggested and as well forwarded your email to [redacted] to meet with you to address your concernsOn March 25th [redacted] met with you to do a walk through of the patio and decking areaIt was pointed out to him that there was two stones that needed to be addressed for a trip hazardHe accommodated with replacing themOn March 27th we communicated via text about the majority of the patio and bench completion and you stated "it was looking good"Between March 27th and when we met on April 16th There were minor punch list items to addressOn April 16th when we met you expressed once again that the other companies advised you that your pool deck was not done the way they would do itYou requested that the entire [redacted] area be pulled up and resetI expressed that this was not required to address the areas you waned fixedOn April 20th you sent an email stating that you were still looking to have the entire pool deck removed and resetAs well you sent pictures of [redacted] patiosThe [redacted] in these pictures in not what we originally discussedThe [redacted] in the pictures is an untextured cut [redacted] and the material you requested is a textured uncut [redacted] As well the thickness of the pieces in the pictures you sent appear to not exceed 1" in thicknessThe material was installed based on the picture that I sent you on November 2nd You did not like the gravel in between the [redacted] There is not gravel installed with your [redacted] I am willing and able to remedy the punch list that we spoke aboutHowever there is no need to pull up the entire deck to fix itLet me know how you would like to proceed.Thank you-- [redacted] ***V.PResidential DevelopmentH2O Industries d.b.a Family Pool and SpaN.W13th streetGainesville, FL32609###-###-#### work###-###-#### cell###-###-#### fax

We have been pushed on our completion of the punch list requested until after the homeowners party on June 20thThe minor corrections will be completed at that time as long as the homeowner has the patio furniture removed from the pool deckThere is a substantial balance remaining on the contract and does not reflect in anyway the amount of the work to be completedWe will have the punch list completed next week when we are allowed to finish.Thank you

I am rejecting this response because:If
what *** had written in his response to you had been the truth - I would have left my complaint aloneBut because there is still unfinished business at my house I feel compelled to set the record straightThe work was not completed by the 8th as he
stated in his responseHe asked me to come back on Monday the 15th to complete the fire pit
and to fix the mortar where the flag stone did not set properlyDue to having my yard landscaped and
electrical work done on my porch, I asked that he wait until after I
host a large party on the 2othTo
date my pool still leaks, it hasn't been programmed for automationI
am unsure if the electrical work has been done in order to complete the
automationI have yet to have a pool school and have requested it at least times
My pool has not been properly cleaned to a sparkling finish since it
was installed. *** has said it will be cleaned by Friday for the party on SaturdayI emailed
him once again asking for pool school so that I know how to operate the
jets and can begin enjoying the spaHe has yet to respond if that can be
done at the same time as the pool being cleaned by his peopleI work - so scheduling the time off is of consideration.As
for the *** - they did come out and remove all of the original
compound used to secure the *** in the deckThey started all over and
used mortarWhile on the surface it appears to be a HUGE improvement -
there are still a great deal of places that need to be addressed because
the mortar is cracking and the *** is moving when walked on
Mortar also needs to be washed off the stone where it "bled over" during
applicationAgain *** has assured me this will be addressed next
weekThe other part that bothers me greatly about David's
response is that he said I asked for additional work (punch list) and that is why it
isn't completeThat part isn't true eitherWhat I am asking for is a professional completion of the project that is within the scope of the contractThe cost of the project is quite large - and to have been treated in this manner - with work that is sub par - and taken far longer than it ever should - then topped off with his untruths in the response to the Revdex.com - finishes meI have called the store and left messages for *** ***, President of *** ***, twiceI also asked through *** if I could speak to Mr***chances and three strikes*** told me he doesn't get involved with day- to - day businessIf my experience with Family Pools is their day to day business - then I fear my concerns will never be addressed properlyWith great concerns for my investment with Family Pool I close,*** ***

Our contract states and is signed by all customers that all time frames are only estimates, that many variables exist such as availability of subcontractors. In this case the hardscape subcontractor scheduled with the [redacted] company to have a delivery done last week. However the [redacted]...

company moved it to this week. There are many steps in construction and this is a one of those steps. In order to place the spa, construct the kitchen and erect the screen enclosure the pool deck must be completed. I spoke with the home owner [redacted] this morning and updated her in regards to the material delivery. I also left a voicemail yesterday January 4th at 5:15 pm to update her with information I just received.The date that I gave Ms. [redacted] of January 7th was only an estimate. as of this email sent November 21st:Good morning [redacted],We are through the first week of our construction schedule of a 6-8 week process. I am estimating to have your pool completed by January 7th. With the holidays it does slow things down slightly however we are going to keep moving forward.As in the email it was only an estimate based on the process not having any delay. All of my contractor are very busy and stay that way. As with the hardscape company that does all of my paver and [redacted] deck work they had several delays that has pushed all of our projects back. Ms. [redacted] and Ms. [redacted] are in the next slot on the schedule to have their pool deck completed and then we can move on to the rest of the work that needs to be completed.

I am rejecting this response because: 1) The person ([redacted]) who responded has no credibility with me due to multiple commitments not honored (and no communication that they wouldn't be honored).  Two examples - decking material was suppose to be delivered last Thursday.  It wasn't and there was no call as to why.  Another example - electrician was supposedly contacted over 1 month ago by [redacted].  When electrician finally showed up at the job two weeks ago, he said he had just found out about the job the day before. I would like to hear from the person [redacted] reports to so I know my complaint has been reviewed by him ([redacted]).  Since the job began in mid November, we've been lucky to have someone working on the project 8 - 10 hours per WEEK.  This was scheduled very far in advance (June/July) and if the job couldn't be completed in their normal "6-8 weeks", it shouldn't have been scheduled.  There have been constant excuses and no communication about set backs unless initiated by me. 2) I want a response to me, not the [redacted].  I am paying for the pool (over $60,000) and [redacted] called the [redacted] instead of me.  He complained a few weeks ago about having to respond to too many people - me and the [redacted].  Sorry, but since I'm investing a large sum of money, I expect emails and phone calls returned to both of us instead of complaining about "who should I contact?".  We are two [redacted] in our 60's and have concerns we are being taken advantage of.  We also have concerns that the more we complain, the less work is being done.  Since [redacted] has never visited to see what/how construction is being done, I also have concerns about the quality of the job.  If I had it to do over again, I wouldn't use this company, but I've already sunk a lot of money into it and just want it completed in a reasonable amount of time and with high quality.

Good morning,In response to the complaint received. Our website has various headers that run on it. One header reads "inground pool installed for $14999" this is a true promotion that get our homeowners a 8ftX16ft vinyl inground pool with standard equipment and 2ft of brushed concrete decking. We...

have a separate header that has a special for a "Free custom outdoor kitchen with the purchase of a [redacted] fiberglass pool" This is a separate promotion and is not combined with the $14999 vinyl pool special. I also noticed that the complaint was from [redacted] which is not an area that we cover.

On our website we have several banners in rotation that run. One for kitchens, one for aboveground pools, one for spas, one for billiard tables, one for [redacted] pools and one for pools starting at $14999. There is no misleading information on our website in regards to this complaint. These are separate specials and not in conjunction with each other. Feel free to look at our website at [redacted]. Under Inground Pools there is a header that states" Inground pool completely installed from just $14,999. Current special[redacted]Every [redacted] fiberglass inground pool includes a free custom outdoor kitchen. These are two separate specials. A inground pool for $14999 and every [redacted] fiberglass pool comes with a free outdoor kitchen. And again we do not service [redacted].
