The buyer's offer was terminated due to title issues as per Section of the Real estate Purchase Addendum: The Seller has the right to terminate an Agreement if: the Seller determines that it is unable to convey title to the Property insurable by a reputable title insurance company at regular rates; (see document attached)At this time Fannie Mae is still working on resolving the title issues on the here referenced propertyOnce resolved, the property will be placed back on the market and buyers are more than welcomed to re-submit an offer if still interestedThank you for your inquiry to Fannie Mae and feel free to contact me should you need further assistance

Dear [redacted] ***,When a property enters Fannie Mae's [redacted] inventory, Fannie Mae has the right to market the property for sale because the foreclosure has been completed, and title has passed between the foreclosed party and Fannie MaeIn some cases legal title to the property may have not yet been recorded to Fannie MaeTypically, this may occur due to delays in the servicer execution of deeds to Fannie Mae, a delay in the court process, or a backlog at the recorder's officeDelays in closing may also occur in cases where the Homeowner's Association, Condo Association, or other interested parties raise legal objections or place liens against the property preventing the sale from going forward until the issues are resolved. In most circumstances, these issues can be resolved prior to the scheduled close date and while they can occur, delays in closing due to title issues are rareShould a delay be necessary, Fannie Mae works to minimize the delays as much as possible by diligently following up with its title vendor on the status of the conveyance deed until the issue is resolvedIn the case of the property listed in the complaint, though negotiations have continued with the Homeowners Association, no resolution had been achieved after an extended period, and the buyer decided not to extend closing further to await resolution with the Homeowners AssociationAs a result, the contract has been terminated and the Earnest Money Deposit has been returned to the purchaserSincerely, Royce Fannie Mae’s Resource Center

Complaint: ***
I am rejecting this response
because:Although I appreciate Sergio calling to lend an ear, there was no change or reassurance that Fannie Mae is acting ethically and actually trying to "promote homeownership and contribute to neighborhood stabilization" as their site saysThe exact response I received was that "Fannie Mae acts in their best interest" which is not just the highest bid but cultivating other business relationships therefor overriding the purpose of their own program and leaving the potential homeowners as the losing partyThe company should not be able to receive any type of government funding if Fannie Mae is providing advertising and not trying to help the communityAgain, my offer was OVER listing, during the day First Look period, I am an owner occupant, I requested no concession requests from the seller, and was a cash offerOf course they can't disclose the accepted offer amount but if it was in terms of a higher bid, it would have been in Fannie Mae's best interest to counter my offer to encourage a bidding warThat didn't happenIt seems safe to assume it wasn't about the offer yet an investor that could perhaps purchase multiple propertiesIf this was any other for profit company, that would be fine but again, it is advertisement to promote the First Look period if it doesn't really existI am a single mother that has saved years to try to purchase my first homeI feel as though I am being penalized because I can't afford to sit at the "big boys table" where the deals are actually being doneI don't think others know about these questionable practices because naïve first time homeowners just think that an offer was rejected and doesn't know to ask whyThis has stayed at a customer service level and has not been escalatedI would like an independent government department that handles unethical or fraudulent practices be brought in or for Fannie Mae to admit that the program is flawed and evaluated or discontinued

Dear [redacted],When a property enters Fannie Mae's [redacted] inventory, Fannie Mae has the right to market the property for sale because the foreclosure has been completed, and title has passed between the foreclosed party and Fannie Mae.
In some cases legal title to the property may have not...

yet been recorded to Fannie Mae. Typically, this may occur due to delays in the servicer execution of deeds to Fannie Mae, a delay in the court process, or a backlog at the recorder's office. Delays in closing may also occur in cases where the Homeowner's Association, Condo Association, or other interested parties raise legal objections or place liens against the property preventing the sale from going forward until the issues are resolved. In most circumstances, these issues can be resolved prior to the scheduled close date and while they can occur, delays in closing due to title issues are rare. Should a delay be necessary, Fannie Mae works to minimize the delays as much as possible by diligently following up with its title vendor on the status of the conveyance deed until the issue is resolved.
In the case of the property listed in the complaint, though negotiations have continued with the Homeowners Association, no resolution had been achieved after an extended period, and the buyer decided not to extend closing further to await resolution with the Homeowners Association. As a result, the contract has been terminated and the Earnest Money Deposit has been returned to the purchaser.
Sincerely,
Royce
