Initial Business Response / [redacted] (1000, 5, 2016/09/01) */ I have made attempts to contact Ms [redacted] via phone and emailI am awaiting her response so she and I can discuss the charges that have been outstanding since March 1, I will attempt to reach her one more time when I am in the office on September 6, Initial Consumer Rebuttal / [redacted] (3000, 8, 2016/09/06) */ (The consumer indicated he/she DID NOT accept the response from the business.) I do not accept the response from office manager [redacted] fro MITCOver a phone conversation, on September 6, at 115pm, Ms [redacted] explained to me that the policies reguarding the charges are due to a vote from the board of the booster club changing the year contract to a day drop notice back in May If there was a change, where is it, When was that notification given, and what does the booster club have to do with the business aspect of Midwest Training and Ice? Again for the third time, I ask MTIC to provide written documentation in reference to the changes that would justify the current chargesMsMaatman gave me an ultimatum that Midwest training would need the balance paid in full by September 15, or else late fees would start being charged at [redacted] per occurance.Needless to say, I and MTIC are at an impassAlthough I did say I would make a payment on Friday September 9, Final Consumer Response / [redacted] (4200, 12, 2016/09/28) */ (The consumer indicated he/she DID NOT accept the response from the business.) I did not receive the proposed email back in march, however, MTIC did forward me an email from [redacted] from september 6, I read the email but it does not state as to when the day drop notice was going to beginIn the past, I signed a contract; the contract is expiredI also requested numerous times for MTIC to forward that contract to meThey have not done that No new policy forms were signed by me and no where did MTIC post any new policy at the gymIn addtion, the email does not state when the change in policy occuredBusinesses just cant change policy and bind people without them having acutal notice of when policy takes effectand agreement, or posting new policy at the gymIn that case, any business can make changes in billing without providing acutal notice and making sure notice was received and understood and take their moneyI am disputing the amount for services not recieved by MTICMtic is charging me monthly tuition for my daughter who is no longer goes there I have spoken to former booster club committee members and they have said billing policies are not the responsibilty of the booster club but of the owner Final Business Response / [redacted] (4000, 14, 2016/10/03) */ To clarify the email sent to our client, it was sent from our Gym Manager [redacted] not [redacted] Our client still has not paid anythingHer daughter is now dropped, however, her past due balance needs to be paid immediately or we will take legal actionShe did not fulfill her obligation of her payment arrangement from 9/9/We have for the last two years tried to work with our client regarding her past due paymentsHer daughter had attended Midwest for months with no payments being madeWe have been very accommodating with our client, but month after month her excuses continued

Revdex.com [redacted] in response to complaint iD of [redacted] which we received on /2/17, we have tried to resolve this with the customerThe installer of the floor went to the home and determined the damage to the flooring and subfloor was due to waterI along with the installer made another trip to the customers home and at that time she called her plumber and he informed me over the phone her sink was not leaking but the damage was caused by water which he was not sure of its originAfter looking around outside her home we spotted on her roof that there was a space between the roof and the gutterThere is no fascia board installed due to the way this is done it Is letting water get between the siding and wail which is then traveling inside and has caused the damage to the floorWe have a copy of the report from the inspector that was sent by her insurance that states that the problem is caused by poor roof design letting water inside the homeWe have offered to repair the subfloor and reattach the vinyl floor at a minimum cost to the customer of We also informed the customer that we can not be responsible if the floor tears while trying to fix the subfloor being that is glued to the subfloor.We have made several trips to the customers home along with sending her a registered letter of which she failed to pick up and was returnedWe are still willing to help her with the repair to the flooring as long as the problem allowing water into the home has been rectified and she agrees to the cost and conditions of repair.Thak youSam N***Fantastic Floors

Revdex.com [redacted] In response to the letter dated on 12/18/in reference to claim ID [redacted] I will advise you on our thoughts according to this matter, in the letter from the customer to the Revdex.com she states the claim adjustors report states there is no damage to the flooring due to waterThis is an incorrect statement, the report states that when the roof was installed there was no fascia board installed, therefore when the gutter was attached there is a two inch gap between the roof and gutter which is allowing water to flow back up under the shingles and run behind the vinyl siding which therefore would get to the kitchen floor which has caused the damage to the flooring and subflooringIn the correspondence from her insurance company the reason her claim was turned down was due to poor design of the roof; she was also advised to complete the necessary repairs to prevent further damage as failure to do so may jeopardize future coverageI have included the report from her insurance company and the inspectorI have highlighted the areas stating the above mentioned claims that she is misinterpretingIn trying to solve this matter we also reached out to her insurance consultant and were told that she was misreading the report and were told they would call her and explain to her that the floor was damaged due to water and the poor design of her roof allowing water to enterAs for the opinions of her floor expert I have to dispute some of the claimsThe first one is that the part of the floor that is buckled is the end of a roll, there is no way of telling if the part of the floor is a beginning or end due to there not being any markings to determine this, also this floor can be installed using a loose lay method which would mean that it would lay flat however it is laid out, so how someone could make this claim is falseSecond: the statement that extra glue was used to hold the floor down is also in correct, they stated that glue was not allowed to dry properly before the floor was laidIf that was the case you would get a permanent bond to the subfloor which is also a method of installing this product but not the one used here as he was able to pull vinyl back .We are happy to repair the subfloor that was damaged and reattach the vinyl floor but if the vinyl were to tear in the process of pulling it back we cannot be held responsibleWe have been doing flooring for years and if this was a problem caused us we would gladly take care of it at no cost, but do to fact that this problem was caused by the problem stated above we will have to offer to do it at what we feel is a fair price of $.Thank you, Sam N***Fantastic Floors

[redacted] is correct in they have addressed some issues - but done in my time frame and with call always returned - FALSE I did not expect things done in my time frame, but in a time frame given to me by his company The work was to be rolled on the edges in the beginning - based upon our Contract The breach occurred at the onset when they did the work initially and did not roll the edges The matter that [redacted] indicates that rolled edges means to stop on top and not covering the side of the concrete is completely inaccurate based on his discussion, sale, and contract entered into with us *** gave me visual instructions how the edges would roll down over the edges and leave a smooth roll over This was show with his hands indicating a roll down over the edge when we initially discussed the contract and we signed Since the amount we paid and what the Contract indicated was for the edges to roll over, that is what we requested the edges to be completed The fact that the company did not property apply initially is not our fault and the company should have done it correctly in the beginning and any type of adhesion line would not have been seen This matter isn't about the adhesion line but how most of the work just fell off the edges and then when the workers came out, they broke the remained away, leaving uneven edges and then pushed fill dirt up against the edge We have submitted numerous photographs showing the inadequate rolled edges, the parts that were removed, the edges not being straight, the blocks of discolor on the driveway, glue on our brick home, and the waves over the driveway We do understand stone is a natural product however [redacted] and his installers have indicated from the initial application the concern with the coloring and the waves that he has never experienced this before and does not understand why the coloring, waves, etcis so unusual If [redacted] is so determined that stone is a natural product and will not always be uniform in color, then why did he question his own work done? We were showed numerous photos of driveways completed and although there may be slight color variances in certain areas, the colors in no way come close to compare all the discolorations in my driveway This matter has been going on for a few years now with many promises made in addition to the written contract We are just completely frustrated with the quality of the work done thus far and as ***ient as we try to remain, each and every time we look out at the driveway or even if a visitor comes, we just shake our heads We are beyond frustration and sending us a letter after numerous unanswered calls, indicating that yet again we need to "take a wait and see approach and see what happens", is not an acceptable as a solution after paying over $20,for this product We also understand that they have "done more cleaning and applying epoxy to his areas than on any other job I don't have a base line to go by", however if the job was done properly in the beginning then perhaps the cleaning and reapplying would not have been an issue and the workers would not have needed to return to our home as often We also understand it is now winter (the 3rd winter) since the initial work and although the weather does not permit work at this time, we do believe that something in writing to reassure and confirm that the issues will be addressed and corrected are warranted not just to provide a letter indicating that we need to wait and seeOur attorney suggested we take the Revdex.com route first in an effort to try and resolve this matter without court action We are hoping we will be able to resolve this timely and move on

As noted in Mr [redacted] complaint we have gone and addressed every issue he has brought to our attentionWas it always done in his time frame no, but we always went and always returned his callsOne of his issue is rolled edgesRolled means stopping on top and not covering the side of the concreteThat is what he paid for and that is what he gotHe continued to ask for the sides to covered and we discussed with him to do that after the fact was not a good ideaAdhesion and seeing a line would be the main issue but to appease him we did it anyway and he has complained about it ever sinceI sent him a letter saying that we have cleaned and stripped and applied multi coats of epoxy that we should let it go for a while and let the stone blend in on its ownI also reminded him that the stone is a natural product similar to granite and will not always be uniform in colorThe problem is Mr [redacted] wants something in writing as far as a time and I simply can't provide that at this timeThe reason for that is because we have done more cleaning and applying epoxy to his area than on any other job I don't have a base line to go byI am not saying we will not inspect the area in the future or do some touch up but lets take a wait and see approach and see what happensThank you, [redacted]
