This buyer has been problematic from the very beginning; taking days to reconcile his invoice We know he is lying about certain aspects of this claim, and he knowingly bypassed our professional shipping services, and forced his hand by making us back this enormous lot at great expense We believe the buyer is not being forthright about the condition of items sent, and furthermore is trying to manipulate the system I personally photographed the train engine a gold plated item worth as much as the entire invoice He claims that the electric motor inside the train was "backwards" and corroded This is a flat out lie The Engine was in plastic in the original Styrofoam The box had wear on the outside from Years of storage(They only made this model for one year or so years ago) The exterior boxes condition was clearly photographed in the description It is hard to miss such a thing You'll notice in his complaint that the boxes 'dirty' and full of bugsThe condition of the boxes were clearly photographed, but the items inside were protected by plastic and Styrofoam before the auctionThese items were taken out of the plastic to display at the live auction eventWe photographed the engine, and it doesn't show any signs of corrosion Also no evidence of the engine 'being backwards' exists within the or so photo's he's submitted NoneHe's just overloading everyone with tons of pictures of dirty boxes, and chipped paint on the corners of train houses that sit on the floor He's only photographed the corners of the metal painted train houses that show a minuscule amount of wear in the very corner that probably occurred with being packed in it's original box and shipped by the Buyer using his own FedEx account If these were properly packed and put on a palette (understand the sheer volume and size of these items filled an entire pallet over feet high) His items would not have this wearThe train houses left here in excellent condition Another element of this transaction was that we do not ship, and this is clearly stated in the descriptionWe have the UPS store or other shippers professionally pack and ship The reason this is important is that the buyer insisted that we pack his items FOR HIM At no cost This is not our policy and we agreed to do it as a caveat that he does not hold us responsible After talking, He agreed to this Many of the items did not have boxes and needed custom made outer boxes to protect the originals We paid our employee for a day and half to pack this enormous lot of itemsHis FedEx bill was over dollars If he had these professionally packed and insured for 750, this wouldn't have been a problem Because he used his own FedEx account and had us do all the work - he probably has no recourse with FedEx as he did not purchase shipping insurance Not all pieces included in the lot were new, but old vintage hard to find items, including some of the buildings These are no longer made The ones that were 'like - new' in the box were described that way, the others made no claim In addition The Buyer claimed that the UPS store represented was a thief, and a 'foreigner' and a Muslim (he's actually Hindi) for quoting dollars to pack, insure and crate Furthermore this was a live auction and buyer agreed to our terms of saleNo refunds I answered many question about the items prior to the auction We offered to settle and give him a partial refund He wanted dollars That was outrageous considering his only evidence is some Old original boxes that had some spider webs in themWe hope you reconsider the outcome of this dispute, as this is a case of buyers remorse, and an example of the buyer being extremely aggressive and flat out lying about the items in questionSincerely [redacted] ADDITIONALLY WE HAVE SENT UPS LABELS FOR THE RETURN OF THE TRAIN OVER A MONTH AGO HE HAS BEEN REFUNDED ON THE TRAIN BUT HAS NOT SENT IT BACK IN GOOD FAITH I HAVE ATTACHED A COPY O OF THE SHIPPING LABELS RESPONSE FROM JOHN:HE WAS AN EBAY LIVE AUCTION BIDDER AT OUR AUCTIONHE WAS SLOW PAY,TWO WEEKS! Complaint: I am rejecting this response because:Again the seller is a scam artist and a fraudThey have been sent the following information and not responded.The total refund due on the set alone is ($PLUS the shipping and the sellers "Buyers Premium"Here is a copy of the message details sent to them.FedEx[redacted] 409/12/2016Ground[redacted] 009/12/2016Ground55.64These are the tracking numbers from the boxes the set arrived in, this is what I paid$55.64+$54.63=$in shipping plus the buyers premium I was charged, per your invoice of $The total due is the $buyers premium plus $shipping= $You prompt payment will be appreciated aI want this stuff out of my garage asapThanks They still owe me the $328.77!!! For the Set alone.-The shipping is their responsibility per Ebay policy they agreed to when listing the items with Ebay-They are not keeping the "Buyers Premium" $they charged me for defective items they want back-ridiculous!!! Complaint: I am rejecting this response because:The sellers are liars!!! That don't know what they're doileast when it comes to collector grade trainsThey represented these items as New in The box and they are notWhen I called them out on the condition they claimed they were "displayed" although the dozens of photos I sent them clearly showed they were usedAs collector items they are worth considerably less being in used condition and not new as advertisedThey are used, damaged, corroded and the engine doesn't work and is badly damagedThe engine is also not the model they listedThey listed model # 10-1126-which is a mechanical unitThe model sent to me was actually 10-1126-which has a circuit board in it (electromechanical-big difference!) that does not work, something is wrong with the circuit-board (again they don't know what they're doing in trains) In addition the engine was put back in it's steel shipping frame with the securing hardware left in a ziplock bag next to the engine so there was no protection to keep it from slamming back and forth against the steel causing great damage.Their shipper did not respond to my emails/messagesI called them and spoke to John Eubanks about the shipper who ultimately tried to charge around $which was ridiculousJohn even stated he was having issues with the shipperI told John that I have a FedEx account and that if all these items are new in the box "as advertised" I could just email them prepaid shipping labels, which I did, as long as they would only have to print and apply the labels to the boxesHe agreedAt no point or time did anyone say they had to pack anythingAll this whining and crying about paying an employee to do such a poor packing job was after the fact and irrelevant other than lying and misleading me about all the items being NEW in there factory boxesAll of which are badly water damagedThe items were set in boxes on top of protective covers and packing materials instead of being properly replaced for shippingPathetic.-AT NO TIME WAS THEIR SHIPPER REFERRED TO AS A MUSLIM!!!!!!
