Fargo Rents

This e-mail is in response to Complaint *** submitted on 2/20/to Fargo Rents in Fargo, ND. We have reviewed the complaint and statement by the customer. At the time of the move-out we were hopeful that cleaning would remove the strong odor from the carpet, but the cleaners
were unable to do so. As a result the carpet in the apartment needed to be replaced after the Customer moved out of their unit as it was damaged beyond repair. Since the apartment was new when the Customer moved in, the damage exceeded wear and tear pursuant to the terms of the lease the Customer is responsible for any damage beyond wear and tear

I am rejecting this response because: as outlined in my Complaint, we were informed that we would be getting the deposit back minus the carpet cleaning. The landlord/resident manager for this building signed off and specifically told me we would be getting the refund at our new address within 30 days. After speaking with [redacted] Zander on the phone regarding the bill that we received, he told me that he had as long as "he wanted" to charge us for anything in the apartment. I told him that I didn't think that was accurate. Then when I asked him to provide me with ND law backing up his stance he said "are you just going to pay it or not?" He refused to provide me with any information in which stated that he could go back AFTER we signed off on the check-out agreement and charge us for whatever he wanted. Fargo Rents should not have had us sign off stating that ONLY the carpets would be cleaned and the refund would be sent to us. I feel that with signatures from both of us (tenants) and a signature from their employee/resident manager, it was clear that the only thing that was being done was the carpets were being re-cleaned. If Fargo Rents suspected that the damage would have been worse/more than just a carpet clean, then they should not have had us and the resident manager sign off on the check-out agreement where it indicated that just the carpets were being re-cleaned. I believe that it is Fargo Rents responsibility for the damages that were not outlined/listed on the check-out agreement AFTER we signed it.
