October 1, 2017Dear [redacted] ***,This letter and the enclosed email printouts including the court document filed with Montgomery County Courthouse pertaining to my attendance in the deposition serve as proof to my claims.On August 24, 2017, I contacted Farrell Court Reporting for their service on my upcoming deposition held at the Montgomery County Courthouse on September 8, Donna have not provided information on cancellation and on if the meeting is cut short.I had setup a meeting to attend via video conference due to medical condition and filed it with the court along with the notification to the opposing counsel more than a week before my deposition (this information is irrelevant to the refund issues)As the meeting was getting closer, I was not sure if the reporter will be in attendance because I have not paid them yetSo, I called Farrell Court Reporting on September 7, to ensure the reporter will attend and to find out what they require from meOriginally, Donna provided a quote of $but when I called their office they increased it to $but I reiterated that the meeting will be about minutes only and I already ordered the money order for $The check issues came up the day before my deposition and I was very worriedAfter numerous talks with Donna to get the check mailed, I ended up paying $for overnight deliveryNo one in their office reached out to me about the missing payment which I believe is not a good business practiceAs for the reporter, Donna asked for the address of the court again in one of our phone conversations and told me that she have a reporter around Montgomery County Courthouse.The meeting only lasted seven minutes because it was cancelled by the opposing counselThus, I expected a refund back for the unused serviceOn the same day of the deposition, I emailed Donna to tell her that the meeting was cancelled and that the meeting only lasted seven minutesI inquired on how much refund I will get backShe replied on September 11th and told me that she did not get the invoice from the reporter yetOn September 14th, I emailed her again because I have not received any communications from her regarding my refundShe replied back the same day and told me via email that she had spoken with the reporter and confirmed that the deposition lasted between 5-minutes (see attached printouts of the emails).Donna also said to me in one of our phone conversations that if I received the transcript that itwill be of no charge (email copy) if not mailedTherefore, I was very surprised when I received the invoice and how the transcript was producedThe margins were way off creating an illusion that it was more than five pages, so they can make valid reason to collect the full amount of $I understand that Farrell Court Reporting provided service in the seven minutes period on my deposition meeting but to collect the full amount of $for a seven minute service is an act of stealing moneyI request a refund for the service I did not receive

September 28, 2017Dear *** ***,In response to your letter dated September 21, in regards to the above referenced ID #, I respond as follows:*** *** *** called requesting our services for a deposition scheduled for September 8, at the Montgomery County CourthouseAt the time
she called she told me the deposition would last about hour to hourI explained to her that we charge per page and not by the minuteShe said she only had a few questions to ask so I then explained to her that there was a $minimum transcript fee, which is our fee for all of our clientsI also told *** *** that since she was out of state (California) that we would need some payment up frontI gave her our address and then she called about weeks later and asked for our address to send a check, which I then gave her the addressagain.The day before the deposition she confirmed with us and we told her that we never received her checkAt that time she told my assistant that she didn't have our address, which I had given to her twiceI told her she had to overnight a check in order for a court reporter attendWe discussed the amount of $and I told her if she was due a refund, I would certainly send it to her.My reporter drove minutes to the deposition, the reporter waited minutes and went on the record at 11:an and it concluded at 11:amThe reason the deposition did not go forward was because *** *** was to appear in person as agreed upon between her (prose) and opposing counselOpposing counsel would not go forward with the deposition due to the fact she had agreed to be there in person, therefore opposing counsel put a statement on the record.The statement therefore qualified for the minimum transcript fee of $and a $appearance/wait see, which totals $130.00.*** *** is not entitled to a refund of any kindWe did not overcharge her, we charged her our court reporting rates as we do all our clients.If you would like to discuss this further or see any documents that can prove that we charge our other clients the same rate, please don't hesitate to call me.Best regards,Donnamarie MManaging Member

Originally, Donna provided a quote of $125 but when I called their office they increased it to $150 but I reiterated that the meeting will be about 30 minutes only and I already ordered the money order for $130. The check issues came up the day before my deposition and I was very worried. After numerous talks with Donna to get the check mailed, I ended up paying $45 for overnight delivery. No one in their office reached out to me about the missing payment which I believe is not a good business practice. As for the reporter, Donna asked for the address of the court again in one of our phone conversations and told me that she have a reporter around Montgomery County Courthouse.The meeting only lasted seven minutes because it was cancelled by the opposing counsel. Thus, I expected a refund back for the unused service. On the same day of the deposition, I emailed Donna to tell her that the meeting was cancelled and that the meeting only lasted seven minutes. I request a refund for the service I did not receive.
