Bold face lieHe asked you months ago, after the shell was put up if you put the attic ladder in and you told him yes it was inI helped him install it in November I took pictures so he could see it wasn't inYou liedHe asked you if the insulation had been blown in the attic, you told him yesWe had to have it doneI told him after he asked you if it was done that it wasn'tI knew I would have seen piles of it in the garage if it had beenBut even then, I didn't have a ladder to look up there so he checked when he moved down here in SeptemberHe found out for himself that once again, you liedHe showed you the back of the house where your subs pieced together the siding (on a brand new house) not a remodeled home from ***You told him that wasn't right and you would send someone right overAnother lieHe had to go buy more siding (because there was not one single piece left from what we paid for) There are so many more things that you have lied about that it's disgusting We have also heard from some of the sub contractors that you like to gouge the customerYou sure didYou got usYou sure like to remind us how much it rained but in reality I think it was a tad more that thatAs for the lady sub contractor and the gutter situationShe bold faced told [redacted] that she wasn't going to change any of themSo yes, he told her she could leave As for [redacted] being angryI asked you why would you try to talk him out of something that we wanted? You tried to do it the way you wantedThe money wasn't coming out of your pocketSo why? Then when you would keep on him about something he would tell you to do it the way you wanted since you didn't care about how we wanted our homeThere were plenty of text messages and emails that went back and forth so you can't say we didn't tell you when things weren't rightnever thought of my new home being a remodel but that's what you referred it too.again, I did not sign the contract but I am the homeowner and I have been watching since I moved down here March 6thIt was pretty amazing to watch when [redacted] would say he was coming down how fast you could get a crew to the house but as soon as he would go back to Ohio everything would slow back down againI have never met someone that can treat people like you do and act like your the victim [redacted] and no, I didn't sign the contract

Response: The claims made by Ms*** are erroneousFor starters, I have never had a contract with Ms***I have a completed contract agreement signed by her husband, Mr*** ***, onlyThe contact signed by Mr*** and myself is dated February 15, The contract
clearly states Mr*** is a self-pay customer (not payable through bank financing) and it is the responsibility of the Mr*** to do and take responsibility for all painting and trim work for the projectSince the agreement was for Mr*** to do the finishing work I agreed to a reduced builder fee of 11.5% (my standard minimum is 15%)The estimated date of completion shown on the contract is “July 30, 2017; however, any change orders and/or unusual weather might delay or otherwise affect the completion date”Per the contract change orders were to be assessed a 12% fee and additional time considered added to the project completion date. Upon start of the project in early March, the land clearing was delayed due to weather and natural springs on the propertyThe property is very shaded naturally and it took days at a time of dry conditions for the ground to be dry enough for equipment to be moved on and off the siteMr*** also decided to relocate the home on the property back an additional feet on the lotThe change meant additional grading work would be needed not originally plannedAs a result, I had to find a new sub-contractor to complete the work since the original party did not have the necessary equipment once the job scope changedThe required additional clearing work to move the house also meant additional concrete, more than planned, would be needed for the driveway to be extended. Mr*** provided his own construction drawingsThese were not provided in traditional architect style with markups and detailsMany updates and notes and versions of the drawings, even additional drawings, were sent by email throughout the projectAgainst the contract, Mr*** sent some drawings directly to my subs which resulted in confusion and mismatched work because drawings versions were not clearly marked. By April, I was receiving text and email communications from Mr*** expressing his expectation that I would be completing certain finishing work to the home not previously agreed upon, considered trim workThese requests included: installation of doors and trim and a sump pump in the basementSince Mr*** was to do the trim work per the contract I offered to send my crew to assist as possible with things like hanging the doors but he insisted he would not be doing the work himselfThese change order additions to the scope contributed to the increase in the cost of the home constructionMore requests for changes and corrections due to miscommunications from items not shown on plans came in. It was early May before we began pouring the walls of the homeThe retaining wall expense which had to be added because of the house being reset on the lot and Mr***’s desire for a walk-out basement came out to $36,from the sub-contractorMr*** also opted for the more expensive option of having a foundation wall poured by my sub at the same time as the retaining walls were being poured over my offer to do it and save him money. I understand the building codes and laws here were new to Mr***, but just because he didn’t agree with the codes did not mean we didn’t have to abide by themSince he did not work with an architect there were a few items which required modification to his plans or where defaults in his plans required additions be made at added expense. Mr*** also had a habit of using belligerent and aggressive language toward myself, my crew, and even my subsAt one point, he kicked a sub off his job for doing work to code so it could be insured and warrantied which also saved him money vsthe way he drew the plansI communicated to Mr*** on more than one occasion and in writing that his continued verbal abuse would not be tolerated and I would stop work until he could communicate in a professional manner. I offered on three separate occasions to stop work and let him take over if he had issues with my handling of his jobEach time he would tell me to continueIn the end, I didn’t charge Mr*** a single change fee, I reduced my builder fee on some of the work, I offered options to cut costs which were refused and sent my crew to complete work outside of the contract scopeHad I billed Mr*** for the change fees, full builder fee, and additional labor the cost would have been nearly $25,more. I have emails, and records which I am more than willing to supply should they be requestedI am including a copy of the signature page showing where only Mr*** signedMy desire is to be done with Mr*** and his project which is why I did not send him a bill for the additional change order fees, labor expense of my crew, or additional builder fee I could have assessedI have completed all of my obligations per the contract and beyond. To address Ms. [redacted]’s rejection response… Ohio building codes and soil conditions are very different from SC. The delays caused by rain were only extended by Mr. [redacted]’s request to relocate the home further back on the lot, as previously explained.  I’d like to remind Ms. [redacted] of a conversation I had with her (the 2nd time we met) when I had just expressed to Mr. [redacted] his language would not be tolerated. I mentioned the conversation to her as I was leaving the property and her response was along the lines of “Yes, I know. I have told my husband he can’t talk to people that way”.To make the statement "all the things that were in the contract were never fulfilled" is unreasonable. Mr. [redacted] nor his wife reached out to me or my office prior to filing this complaint. This “long list of things” is one that I have never seen or had shared with me. Any time Mr. [redacted] contacted me with questions or issues I responded and took action to correct concerns and made sure to notify him prior to any work which would result in additional costs. In regards to the HVAC power mentioned, it was for an outside unit which is typically powered from an outside panel. Delays on the power company’s part to turn on service did lead to an oversight of the outside unit connection but as soon as I was notified I had my crew out and resolved the issue. My last interaction with Mr. [redacted] was to have the gutter company come out and make a correction to their installation work. The gutters were agreed to be the last piece of my contracted work and Mr. [redacted] was to take over finishing per the contract. I arranged the crew and when the saleswoman for the subcontractor went to determine the needs and draw the plan for the crew she was very rudely confronted. Mr. [redacted] told her to leave and not come back as he would do the work himself. Since that interaction I have had no contact from Mr. [redacted]. Building a home is not like what you see on [redacted]. It’s not edited for smiles and sunny days. Decisions must be made, delays occur, costs can vary from estimates, and “photoshopped” expectations like on TV do not equate with the reality of construction progress. I cannot see what is being requested by Ms. [redacted] to resolve this complaint. If Mr. [redacted], who I do have a signed contract with would like to make a formal complaint he is welcome to do so. Ms. [redacted] does not have a contract with me and therefor her complaint is not valid as I do not owe her anything even if I knew what she was seeking.
