To whom it may concern:I received a letter regarding a complaint made by *** *** (complaint # ***)I would like to dispute this matterThis claim is being fraudulently made and is based on information.The tenant signed a legally binding year lease agreement on November 23,
Less than months later, the tenant contacted me requesting to break the lease agreementThe tenant became very angry that she was legally bound to the terms of the contractWe did not receive rent for the month of April when dueThe tenant was notified that, as per the contract signed by both parties, rent and late fees were overdueThe tenant claimed to have mailed the rent times and further claimed that the letters were returned to her as undeliverableI asked her to send me a photo of the letters marked as undeliverableShe stated that she had thrown them awayRent was due on April 1, and was finally received on April 15, Tenant was notified that late fees were still due and outstandingI received rents from all other tenants without incidentGiven the reliability of the U.SPostal Service, it is extremely odd that one envelope would be returned and almost statistically improbable that would be returned.*** then sent me a text message on April 22, (the day her complaint was made) asking me about the status of *** *** applicationI replied that I had not received an application from that personShe replied, “WeirdThat claim they saw the apartment and filled one out to youyou’d let them know this weekend?” (spelling in context of message)I asked her to give *** my number and also let her know that I’d be happy to call *** texted me the number and I attempted to call the number a couple of times; each time receiving a message that the number had been disconnectedI asked *** to try callingIn a text message, she responded “yeah, it went through and rang for me”I had a couple other people try the number and they both received the disconnected messageVerizon confirmed number not in serviceI sent her a text with this informationShe responded by saying “I do not appreciate you harassing meI have heard what you saidI disagree with a lot of what you are sayingThis apartment needs to rented ASAP.” Tenant was angry that she was still obligated to pay rent and was angry that we had not found a new party to rent the apartment toI responded “I have not harassed you in any mannerQuite the contraryI tried to call a number you accused me of avoiding contact withI am merely protecting myself in writing against your accusationsYou said you called her today and that the phone was not disconnectedVerizon confirmed phone is disconnectedWe will proceed according to our legal signed contract and I will document my showings of your apartment and I will let you know in writing when I have a deposit and have your apartment rented”She then requested all contact be through email.She then sent an email at 5:on April 22, stating “ Due to the urgency of this situation, I am will be holding an open house on Saturday, April, 29, at 12pm, in order to create opportunity for this rental to be rented by another partyI do not believe the same level of determination is being upheldTherefore, I will begin taking action and measures to ensure that there are opportunities for another renter to view and apply for this property In the mean time, I would like daily updates on what is being done to gain a new tenant for this propertyBelow is a list of numbers that have contacted me regarding this property:

***Thank you”I responded via email "You may want to have your attorney review the legal contract we signed at the conception of the leaseI show the property frequently and have it listed on multiple sitesI will contact you as soon as I have a deposit and a signed leaseYou are welcome to show the apartment anytime you are availableAs per the lease you are responsible for the vacant period as well as the utilities for the vacant periodAll contractual fees and late fees will apply.”On April 23, 2017, I sent her a late fee reminder(On April 9, - she sent a text message saying “I sent off a checkTwice nowI’m not sure why you aren’t receiving itI will mail another out tomorrowI can only afford the rent right now and after the 21stI can send a check for the penalty charges.) She responded stating "Per our conversation, you stated the late fee was only $Are you no longer honoring that agreement?”I responded "That is absolutely not trueI told you I would not turn you into collections if we received the rent by SaturdayI sent you multiple reminders to pay rent and went to the post office over six times just to check for your rent, which was a waste of time and money on my partI absolutely did not agree to waive late feesWe did not receive your rent until the 15th of April and as such late fees will apply as per the legal document that we both signed”She responded "I can see that you do not recall our conversation, nor honor your wordSince are no longer honoring the agreement that was made during the conversation on April 13, at 7:52am that was seven minutes long, where you stated that you would waive all past due fees except the $if payment was received by Friday, April 15, 2017; which I am in unaware if you received it, seeing as there as no communication from you until I contact you on Monday, April 17, at 1:04pm with no response and then again at 5:48pm.Therefore, please outline what is dueIn addition to you not honoring this agreement that you had made with me verbally over the phone, I will not be able to pay a full amountI am able to send a $check every weeks until that agreed amount is paidAlso, I would like the guidelines to which you are charging me, so I am confindent that these amount is correct.”To this I responded "After sending this message I will also send a picture of the late payment clause in the legal lease agreement you signed on November 23, I disagree with your statement about waiving late feesAll fees apply as per the legal lease agreement we both signed on November 23, Your rent was delivered to us on SATURDAY, April 15,You sent a text message Monday, April 17th asking me if I received your rentI replied the SAME day indicating that we did receive itI have attached a picture of the late payment clause in the legal lease agreement we both signedAs per the agreement, you actually owe $in late feesas your late fees begin to accrue on the 3rdThis amount is currently past dueAlso, as per your lease agreement "all payments received shall be applied first to late charges and then to rent”Please refer to your legal lease agreement for information regarding all contractual fees and ALL CONTRACTUAL terms and obligationsYou may want to consult with an attorney if you have questions"As of 4/29/2017, we still have not received payment for any late fees.I would be happy to send screenshots of all text messages and forward all email communications between myself and *** ***.I received the Revdex.com complaint letter when checking my PO Box today (4/29/17)In response to this, I looked up the messages and called *** Butler*** confirmed that her phone was disconnected for a few days and that *** did not complete a telephone call to her on April 22, when she claimed to have done so in a written text message to me on that day*** said she would be happy to confirm this information and said you could contact her at 208-320-to verify this information. *** is angry that she is being held responsible for the terms of her lease agreementWe have put extensive effort into getting this apartment re-rented and advertised the apartment on multiple sites and also have shown the apartment many times each week and sometimes multiple times per dayWe have now found someone to rent this apartment.Please contact me at 208-623-if you have any questions or would like me to send you any or all communications between myself and the aforementioned partyI would be happy to comply in anyway.Sincerely, Aleshia F*Faulkner Properties208-623-
