Their response does not address the two late fees I am being charged on the same day When the payment was made a fay before it was due Their answer has nothing to do with my complaint at all

Based on our investigation of the claimed issue by the borrower,
FCI has determined that the payments received were applied in accordance with
the terms of Note and Mortgage signed by the borrower. Any additional
funds received were applied to principal as is required. The
borrower
would need to go to the Lender with any issues on the terms of the loan; FCI as
servicer does not have any authority in this area

[redacted] filed a complaint that he did not receive his Mortgage Interest Statement (1098).  If he would have simply checked with FCI, or his CPA or the IRS, he would have realized that it was not required by the IRS in his case.  Even if it was required, he did not...

allow enough time for the Post Office to deliver it over a Holiday (only 4 business days) before complaining.    His complaint is completely invalid.
Mr. [redacted] paid off his loan in March of 2014.  His total
interest for 2014 was $78.50.  The IRS only requires a 1098 be sent if the
interest paid is over $600.00.  A  borrower statement of account with relevant information was
emailed to Mr. [redacted] by our customer service department on 2-10-15.THank you

Revdex.comRE:[redacted]Attn: [redacted] FCI Lender Services is a State and Federally regulated Sub Servicer working on behalf of the Lender.  When this account was setup for the loan payment to be escrow/impounded for taxes, neither the Lender nor the Consumer (borrower)...

provided the correct tax information to be escrow/impounded.  The amount collected was not sufficient to pay the taxes due and FCI, as a State and Federally regulated Sub Servicer, cannot pay less than the total amount due.  We have a recorded conversation where the consumer told us that he had a copy of his tax bill in hand; he was obviously aware of the amount that needed to be paid and the due date for the payment.   Additionally, Federal and State compliant Monthly Statements were sent to the consumer by FCI clearly disclosing the escrow/impound amount in his account.  The consumer knew his escrow impounds were not sufficient to pay his taxes.  Even after the Consumer paid his taxes to the county, an escrow/impound analysis shows there is still a shortage for future taxes to be paid.  We have already mailed this analysis to the Consumer showing the new monthly payment amount needed to fund his account and allow FCI to properly pay his taxes in the future. While there was absolutely no fault by FCI as the Sub Servicer of this loan, we have mailed the requested $158.00 to the Consumer as a good faith gesture.  Thank you  [redacted]Senior Director,Marketing & StrategiesFCI Lender Services, Inc.[redacted]

FCI received short payoff funds that were applied to your account on 3/24/16. This resulted in a small balance remaining due. A small balance demand letter was generated and provided to you advising of the remaining balance due to zero out your loan. On 3/28/16 we received your check by phone payment for the small balance due. After further review of your account and discussion with your lender, your lender has agreed to update your loan as 'Paid in Full'. Therefore we are returning your recent check by phone payment (check #[redacted]). Please note that FCI does not report to any of the credit bureaus.
In addition, your recorded release is being processed and will be provided under separate cover.

The originating address was from Mobile, AL. FC was unable to identify this wire with the information provided. On 10/13/16 the wire was rejected,On 10/13/15 your lender had instructed for FCI to update the account with the default rate effective with the 10/1/16 payment. On 11/2/16 your lender instructed FCI to start the foreclosure process.On 2/26/16 the account was reinstated and the default rate was removed.On 5/10/16 your lender mailed out a ‘Demand Letter'. No payments were received by FCI to cure the default referenced in the letter.On 6/15/16 your lender had instructed for FCi to update the account with the default rate effective with the 6/1/16 payment. On 7/8/16 your lender instructed FC to start the foreclosure process. There is a current sale date scheduled for 9/6/16.Furthermore on 6/3/16 FCI received the insurance claim check from [redacted] in the amount of $17,636,41. Your lender has confirmed they are pending receipt of the adjuster's report along with supporting documentation from the construction company before the funds can be released. Insurance claim funds cannot be applied towards monthly mortgage payments.FCI is obligated to service loans in accordance with the terms outlined on the executed Note.
