The customer was given our best assessment at the time of the proposal which was to clean and seal the gutters It is not apparent that a gutter is short from looking at it from the ground (which is how the estimate was done) After looking at the picture (after our work was done) it looks like the one gutter is short and allows water to run behind, which is the advice we offered to help in our first answer to the complaint The short gutter is a pre-existing condition which we didn't doGutters do need to be serviced times per year to maintain their functionality (on our contract) and the cleaning and sealing we did is a necessary service and was completed We don't feel we are responsible to go back and perform extra work that we will not be paid for because we had to go to collections to receive $of the $contract for the work we did do The original proposal/contract had written payment terms on, and the sales person also hand wrote deposit and balance terms Thank you

I am rejecting this response because:I find it very difficult to believe that the company did not realize the gutter was short when they provided the service They are saying that based on the snapshot I took from feet away(and on the ground I might add), they can tell the gutter is short, but when analyzing the gutters for the estimate they could not Further, once they were up on the roof cleaning the gutters, they still didn't "notice" the gutter was leaking because it was short? I was pretty clear on the problem I was having when I spoke with them on the phone The right thing to do would have been to call me to tell me the leaking was not due to the gutters needing sealing, but rather that the gutter is short At this point, I'm not sure what to believe....either they mislead me and did unnecessary work(resulting in no help to my leaking) or they didn't do the work well (again resulting in no help with the leaking) Either way, the gutter is still causing leaking into the house It feels like I was duped At a minimum, I would like other patrons to know about how they do business, even if I'm unable to get any of the $$ back

$400.00 of the $450.00 dollars in January 2015, 9 months after we did the work. I am rejecting this response because:The Gutter Men company was asked to look at the leaks I had in my gutter system and to provide their best estimate as to what was causing the leaks.  They came back to me after allegedly coming out to the house and inspecting the problems.  I spoke with them at length over the phone.  Not once, did the gentleman say that the leaking was not a problem he could fix.  Not once did he say that the "water runs between the gutter end cap and the brick creating the water shown on the wall and downspout".  He never talked about a roof diverter or installing a new gutter and running it against the wall.  Had he provided these options with estimates, we would have moved forward with these options. Rather, he told me that a gutter tune-up would stop all the leaking problems we were experiencing.After talking on the phone, he asked me to sign a contract which was sent to me via email.  I couldn't read the fine print on the contract (I still have the email as proof), but he said it was just giving them authorization to move forward.  Not once did he indicate he needed a deposit before work could be started.  Frankly, if that was the case the work would never have been started, correct?  Clearly, if that is a policy it is not communicated nor is it followed.Days after the work was completed, I reached back out to the company letting them know I still had a leaky downspout.  The response (which I still have) from the secretary in the office was that it was impossible to have a leaky downspout (yet I have pictures).  After wrestling with her for a bit, I gave up and assumed they would eventually finish the job when they wanted payment.   Several months later, a different secretary reached out to me regarding payment.  I forwarded her the communication between the prior office worker and myself and again explained the issue.  She seemed more helpful, but nothing was done to fix the issue.  I received a few calls from a gentlemen, but we did not connect over the phone.  I asked them to consider emailing me (partly because I like to have everything in writing and recorded) and I did not receive anymore communication.Finally, in January I received a collections notice from the company.  Frustrated and quite frankly feeling beaten down, I paid $400 of the $450 given I still had the leaky downspout.  I wrote a letter indicating as such and was hoping to be done dealing with this company ever again.However, only 1 week after making that payment, the gutter that had been leaking into the house the winter prior, started leaking into the house again.  Now, if the Gutter Men did not think they could fix this issue with a gutter tune-up and additional work was required, I would not have had the gutter tune-up in the first place.  I would have saved myself the $400 and put that money towards the work they are now saying I need. This whole process has been difficult with them and I feel as if they provided unnecessary work due to misdiagnosis.  Not only was this unnecessary work shoddy, but the communication process has been difficult.  So, yes I took a long time to pay--because the work wasn't complete.  I wish I would have waited another week to pay...had I done so, I would have realized the entire job was unnecessary and possibly a scam.  I have video, pictures and emails that can be utilized to support all the details in this response.

Review: I entered into a contract with The Gutter Men in January 2014. I had a conversation with them about having a gutter tune-up. I expressed my concern about leaky gutters and drainpipes and one gutter endcap in particular that was causing water to leak into the house. The work was completed in April as they claimed the temperatures needed to be above freezing in order for the caulk to be effective. I'm not sure if it was warm enough or not, but the work was not fully completed as we had a drainpipe continue to leak. I complained on 04/24 about the leaky drainpipe and the receptionist([redacted] told me it was impossible for water to drip from the drainpipe. I have pictures, videos, etc. showing that it does leak. In addition, there were additional emails sent with no response.

In November, another receptionist ([redacted]) contacted me regarding the invoice. I forwarded her the communication that [redacted] and I had as well as sent her a few voicemails.

Finally, in January, I received collection notices. I sent a letter indicating I would pay $400 of the $450 balance given the drainpipe wasn't fixed.

About a week after I paid the $400, the gutter endcap started leaking again into the house. I have pictures of the leaking, so I sent them to [redacted]. She sent me an email back indicating I was not able to eligible for the warranty given I didn't pay a deposit (which I was never asked for) and because I didn't have the Gutter Men come in for maintenance. This was impossible given I couldn't even get them to come in to fix the drainpipe.Desired Settlement: My preference would be for the Gutter Men to fix the initial problem that I had back in 2014. However, if they refuse to do this, I would like them to refund some of the $400 I paid them last week so I can hire someone else to fix the leaking into the house from the gutter.
