Deal was not fraudulent and explained to the client what happened and everything was done on the up and up Mercedes was notified as well, being they wrote the lease and understood what had happened and changed it in there system Client drove the vehicle for several days, of which a
usage and restocking fee is business processes when a client drives a vehicle and had the option to come in and resign At this point the client is not up holding his word or agreement Feldmann imports did everything we said we would, got the deal done as promised (legitimately) and now client is deciding to go somewhere else and using this as an excuse At this point we see no reason to be blasted for it and called liars, when everything was explained We will refund the deposit being no good can come out of this...especially when one side is looking for an excuse to not honor their word and agreement

Books where provided with vehicle (in car)history will be overnighted VIA FEDEX today............Mike *** did speak with the client and told him that the items would be sent. That was just a few days ago, so not sure why the client is feeling that we would not follow through on what was

See attached documents**Revdex.com NOTE: PDF of consumer 'rebuttal' letter attached, plus zipped folder of photos provided by consumerText of letter reads as follows: I am rejecting this response because:1) Dealership claims that vehicle was certified according to strict Mercedes guidelinesa) Customer has overwhelming reason to believe (including dealership documentation and emails) that the vehicle may have been certified on paper onlyIf it was not certified (on paper only), it was not properly inspected and documented by the technicianDocumentation and other evidence will demonstrate:ONE: Vehicle was not in possession of dealership during the "Certification" process.TWO: Documents show irregularities with date, time, mileage, and other factors.THREE: Documents show that certification did not occur before sale of vehicle (supporting the claim it was done on paper only)FOUR: Customer found multiple deficiencies that should have been conducted / addressed during the certification including but not limited to: MBCPO Inspection Booklet, Non Factory Windshield, Blown 12v socket Fuses (replaced after the sale on service lane by advisor), front hood latch needed adjustment, Steering wheel was not centered (still an issue after multiple alignments), Inside brake pads on drivers side was less than half of outside pad (Was inside pad inspected?), First Aid kit was missing at the time of sale, Excessive vibration, Parking Brake Operation needed several adjustments, possible excessive peppering on front hood of vehicle.2) Dealership Claims Certification Badge fell off.Customer speculates it was never affixed to vehicle or at least not affixed properlyAlso, the badge is symbolic to the completion of the certification and has little function other than that.3) Dealership claims tires were within guidelines.Customers argument is that tires needed to be replaced with winter tires due to wet and snow performanceMileage on original tires was limited to summer monthsThe original wear on the tires may have been borderline acceptableCustomer has emails showing concern about tires before and after the sale.4) Dealership claims brake are within guidelines.Customer has physical evidence the inner pad on the driver's side was worn almost to the metal (around 3.15mm or well within the sensor line)The outside pad was measured around 7.1mm and passenger side was very similarService department did not advise or warn customer about this safety issueRotors were changed out two times and technician had full access to inspect and measure the inside padsCustomer had pads inspected and replaced at his own expense with OE Pads.5) Dealership claims maintenance items were done before the sale.Customer is not able to verify the maintenance but does not dispute the claim.The dealership has recently quoted the customer over $in maintenance and repairsPart of the quote included brake pads and rotors because of "rust." Customer has documentation, photos and videos showing car was not properly diagnosedDocumented mileage of less than one mile and dash videos shows the car never left the parking lotDealership had car for full daysCustomer returned after days to find nothing was fixed on car and had to call Mercedes Customer Support in order for dealership to replace the month "new" rotorsSymptom was corrected by the rotor but root of the issue is still unknownCustomer speculates the drivers side caliper since inside pad was almost worn to the metal.At this time Mr *** believes management at Feldmann should conduct an internal investigation into the sales practices of its staffFurthermore, the vehicle at question should be purchased back at full price and an official apology should be issued to the buyer

Mr. [redacted] and I emailed about the PrePaid Maintenance purchased in hi lease agreement from May 2016. This is a MB Financial Services policy where all disclosures were initialed by him during signing-including cancellation policy in bold for the contract...

which specifically discloses cannot be cancelled and not refundableEmail chain:[redacted]:I am requesting a refund for the prorated amount of the maintenance plan I purchased on 05/13/2016. I no longer own the vehicle and I was told by MBUSA to contact my dealer for the refund. Please issue a refund and send to my current address as I have movedJenna:Did you get into a new Mercedes Benz and have a Maintenance Plan added to that vehicle?  If so, then the contract will be able to be refunded back to you.If you do not have a Mercedes Benz with a maintenance plan on it, then there is no cancellation refund.How the maintenance is disclosed is that it is not a cancellable option (without another contract in its replacement)[redacted]:I did not get another Mercedes Benz with an additional maintenance plan. While I see this disclosure is signed, this was never disclosed to me from you or my salesman regarding that it would not be refunded shall I need to cancel. If that would have been clear, I would have definitely not elected to add it on. That is a complete ripoff as that is money paid for services that will never be received given the vehicle is no longer in my possession. I actually specifically remember having a discussion with my salesman regarding this maintenance contract as I reluctant to purchase this along with the other additional add-ons. I was assured that is was optional and if need be, this was refundable. Sounds like there is some discrepancy here.I apologize for this miscommunication, but I definitely wouldn't have purchased this given that I fully understood the ramifications. Is there anything that can be done to rectify this because I'm quite taken back that almost two thousands is being wasted here

I am rejecting this response because:
If it were a matter of, "He said, she said" then we would be at a crossroads with both sides defending their stance. The issue is that my spouse's financial documentation was falsified by the dealer, not myself, and I have the emails to prove it. After contacting an attorney, they said had I signed the falsified documents, I could have been held liable for what was written on that contract and I am thankful I did not sign. I do not understand how a business can knowingly falsify documents and then blame the customer. I am awaiting my refund for my deposit, therefore this complaint is still open...

as follows: "To whom it may concernRegarding [redacted]we received a letter from the Revdex.com regarding Mr [redacted] Vehicle purchase from Feldmann ImportsHe is disputing his purchase of vehicle id #[redacted] In response to his claims in his letter to the Revdex.com, our following response is.1) He claims that we never gave him Certification paperwork, or a copy of CARFAXI have attached all inspection sheets and CARFAX to this letter and have sent owner copies as of well.2) He claims that we never attached a Certification badge to his B-pillarIf it fell off, he can reapply it, I have sent him a sticker as well and one in this letter3) He claims that the tires did not meet Certification guidelinesThe tires measured at 8/32 in the front and 7/32 in the rear at 44,462 miles / Mercedes guidelines are that they measure no less than 5/32 front or rear, he was recently in for service and had 60,144 miles on the car, at that time his tires measured out at 6/32 in the front and 4/32 in the rear putting the rear tires just out after 15,682 miles of driving4) He claims that the brakes did not meet Certification guidelinesThe brakes measured at 8mm front and rear at 44,462 miles, Mercedes guidelines are that they measure out at least 50% of new pads / new pads are 12mm, making his brake pads at that time 67% of original, which passes Mercedes guidelines (at 60,144 we measured the pads at 7mm)5) When we inspected the vehicle before sale, our Technician found the following items needed to be addressed...COOLANT FLUSH / OIL CHANGE / BRAKE FLUID FLUSH / AIR FILTER / DUST FILTER / ALIGNMENT / TIRE ROTATION / and a bulb that was burned out, ALL of these items were done prior to saleMr [redacted] was in recently with a brake pulsation issues which was repaired at no charge to him (we replaced brake rotors in the front)Other than a few minor repairs and an oil change, Mr [redacted] has had ZERO out of pocket expenses, we have done several Alignments for him at no charge and an oil change to try and please him.At this time I feel Feldmann Imports have met all of our obligations and then some"
