Discrepancy with the contract.
Salesman came to my home and quote a price for fence and screen porch. After installing the screen porch, they wanted to change the contract and charge more. I cancel the contract and they refused to refund me the $800 difference from the deposit and the price of the screen porch.

Desired Outcome

To refund me the $800 that they are keeping after I terminated the contract.

Our salesman went to our client's house to quote a screen room installation and fence installation service. Both services are considered as two different contracts and installation dates.

Our client accepted the quoted price, signed a Fence Contract and Porch Contract individually. Each contract specifies a deposit and balance of payments pending as requested by the company.

Our client wrote a check for the sum of the two deposits for the fence and the screen room installation.

Once we install the screen room on the client's property as agreed by the Porch Contract, the client must make the final payment for the outstanding amount as written and consented in the contract by seller and customer the same day that its installation was completed.The screen room installation (Porch Contract) was completed on July 23, 2019. Next day on July 24, 2019 we communicated but we did not get an answer. We send the invoice by email to make the final payment. On July 25, 2019 our client responded and asked the company for an explanation of the payment.We send you a copy of the Porch contract and invoice signed by him.We had consideration and did not apply late payment fees during that period of time.

In conclusion, our client refused to pay by not agreeing with the balance or the terms and conditions established in the contract.Therefore, the client is left with an outstanding balance for the screen room installed in his property for the amount of $850.00.

Moreover, our client decided not to continue with his second fence installation contract. Our written cancellation clause was accepted and signed by our client. It specifies that the client has up to three business days by law to cancel the contract and receive his return deposit. After three days, the deposit will not be refundable and the contract remains active.

We highly recommend our customer to rethink, contact us and make his final payment for the porch contract. If he decide to continue with his fence contract, please notify us and follow the procedures as indicated per our personnel.

Attached is included a copy of Porch Contract, same our customer accepted and signed.

I do not accept the response from the business and attached please find the copy of the contract. As you could see the contract deposit of $2,500 is in one contract not the other. Which indicated 50% of the total contract required by the business. I was told by the sales person that reason for the two contracts was because the drawings did not fit in one. To be informed by the business after completing the enclose porch that it was two contract one for $1,700 for the porch and 4.200 for the fence. At that point I cancelled the contract and since and requested the difference of $800 to be refund it since they mislead me. They refused with the explanation they provide you. which is wrong and misleading to keep the extra money. This company is using wrong and misleading practice to get business. That is wrong and should be stop.

In the contract, they said that they do not return the money; but they were the one who made the mistake
On July 21st, I contracted the Fence & Porch company LLC to do my fence, they told me "do not worry about to get the approval from the Home Owner Association" (HOA) because that was part of the service. When they asked for the permission, they wrote down on the contract that they are going to install "A WHITE fence" .When they came to do the job at my house (***), they installed a White and Tan fence instead (that we were agreed).
By the time the HOA noticed that my fence was White and Tan instead of White without me knowing the situation, they sent me a notification that I was violating the rules I WAS SHOCKED!! Because I made the contract with the company that my fence it is supposed to be "White and Tan".
When I contacted the company to let them know that the HOA was not agreed with the colors of the fence that they installed, obviously because the fence was white and tan, no completely white like they said on the contract. That was the reason why I got into a trouble with the HOA. I called the Fence and Porch Company LLC to let them know what is happened with the HOA and I told them that if it is not White and Tan, I did not want any fence around my house, that they need it to come back and remove the fence and give me my money back, they refused to do EITHER ONE because they said "They do not refund money". The difference between "A white and tan fence and a white fence" is $400 and they do not want to give me that money back, which is not fear because I never knew that the HOA did not approved the White and Tan fence and even tho the Fence and Porch LLC knew it that the HOA did not approved, they still installed it.
This is the reason why I want my $400 back or some type of percent back because of the mistake that they did.

Desired Outcome

The resolution that I want is either the $400 back or 75% back of the $400 and I wanna make sure this company do not do this to anybody else what they did to me.

As soon as the customer called us about the HOA guidelines , we were willing to replace the require color with no additional cost.

These replacement was on August 30,2017 and get into labor costs, new material and receiving a non-refundable merchandise. We also waived client's permits fee ($150.00) even permits were not included in the signed contract.

By the date of October 5, 2017 we received to our business account a Chargeback dispute and a withdrawal for the amount of $ 2,200 because our client explained to her bank entity that she cancelled the contract on August 14, 2017 with our company. This information provided to the banking entities was intentionally false. Her contract began on July 21 and it was completed, accepted and paid through a credit transaction on August 4, 2017.

I can not accept their response because this company is full of lies and excuses. They got me into so much trouble.
I paid for a "tan/white fence" $4400. They offered to get the permit with the Home Owner Association, and they asked to the HOA through a letter that it would be a "white fence", it was their mistake and they installed a tan/white fence. It is not my fault and I even contacted the bank to get the money back. They have to give me back my $400. HOA only allows a white fence and they installed a tan/white fence which is $400 more expensive and it is stated in the contract. It was a mistake made by Fence and Porch LLC. I have a white fence now complying with the HOA rules and the company must give me back the money. It is clear in the contract.
How do they dare to state that they offered to replace the fence at no cost??? This is insane.
The customer service provided to me has been awful and I deserve what I am asking.
They even requested a separate email without the note stating the reimbursement in order to switch the fence. This is unacceptable. I am just demanding what it is right. white fence is $4000 and tan/white fence is $4400 which I pay so It is very clear that this company owe me this money. I even think that they made this on purpose to steal the money from me from the very beginning.
They even have bad reviews in this regard.
Please help me to get justice in my case.
My family works vey hard and this company just pretends to get this money out of my pocket for no reason. They are criminals.
I wanted a tan/white fence and that is what I paid for and their response was that what they could do would be replace the fence to a white one. So it is very clear that they have to give me the $400 back.
Also they asked for the permit on Oct 9th and they installed the fence on Aug 4th without even calling for inspection. The inspector came today Nov 30th by my request. This is very fishy.
I hope you will be able to fix this issue.

Unfortunately, we will not proceed to your desired resolution. Our response was final and we differed from the information provided to this entity.

Shoddy Fence Work and no response to correct the issues with the response after multiple calls.
After contracting Fence & Porch to put up our fence and providing the salesperson "Peter" all the details, write-ups and photos of what were required by the Home Owners Association to have the fence comply with HOA standards they still screwed it up. The installers damaged our lawn beyond repair on the sides of our house, in addition, the owner "Javier" wanted additional money to correct the mistake they made with our fence and to bring it up to the HOA requirements/standards, we did not give in to paying additional money and a half as fix was made which I'm not totally happy with. It took only 5 months after the fence installation to find out after Irma came through that the installers did not put enough cement/rock on the fence posts. All the fence posts are wobbly and some of the inserts came off while all the other fences our community did not sustain damage. I have called F&P multiple times and I have been told they would call back or come by and I'm still waiting. I have lost hope of them fixing their horrible install. I need for them to fulfill their warranty as stated in the contract and the fence to the required specifications.

Desired Outcome

I want the fence repaired and corrected as was originally stated when the contract was signed.
