Starting off with Carlos, the owner and operator of Fences FL LLC, he seemed to be a legit business owner, but as of right now things are not going so well between my family and this company.
We signed a contract with them in early December 2015 to put up a 4' tall metal fence. We paid 1300 dollars up front on a 4,000~ dollar contract. After being declined a permit by our HOA for being a lakefront property, we contacted Fences FL LLC about getting our money refunded. As per their contract, they were to keep 300 of the 1,300 we paid them upfront for a cancellation fee which we agreed upon. After multiple attempts to have our money refunded we finally got a letter of cancellation with all that we agreed upon in writing. This letter came on December 18, 2015.
Today is January 15, 2016. Last night I called them and left a message to have them call me back in regards to this situation. This morning around 9:22am I called them on my cell phone number but again I got their voice message, which oddly enough seems to happen every time my wife calls as well. I called back at 9:30am using my Google Voice number and surprisingly they picked up right away.
While on the phone with the woman who picked up, presumably Karen their assistant, speaking about this issue she told me that she sent out the letter of cancellation and the check weeks ago. According to her they sent it out just before the 31st of December. This means that they waited nearly two weeks to send out the refund check. Now, more than two weeks later from the date she claims to have sent the refund check we still have not received it. Her excuse was that maybe the holidays have something to do with the delay through the postal service. I find it hard to believe that it takes more than two weeks to deliver mail. She almost sounded like they feel that the responsibility is off their hands.
I told them that if we do not have the check in the mail this Monday, Janurary 18, 2016, one month after receiving the cancellation letter, that we will be forced to take them to small claims court.
If the check truly did get lost in the postal service, a quick check of their finances would tell them that we have never cashed the check that they supposedly sent out. Knowing this they could easily cancel said check, write another one and sent it with good intentions.
We shall see how this turns out. For the time being this review will stand at one star with a strong recommendation to steer clear of this company.
