In an effort to obtain complete customer satisfaction, we honored the price that was a mistake. I met Ms. [redacted] for the first time in the finance office and talked with her about her experience. I tried to change her outlook and actually sold her a 5 year 80k mile warranty on the vehicle at our cost. About two weeks later the previous owner came in to our service department and talked with me and told met that he did not care about the refund on his warranty and would like to pay it forward and pass it on to the next owner. I called Ms. [redacted] and told her that she would be getting a 100k mile warranty instead. I had not done a transfer before up to this time, so I was unsure everything I would need to do so. I talked with Honda and sent them everything they needed including a signed letter from the previous customer. They told me they had everything they needed and it would just take some time to process through the departments. I explained this to Ms. [redacted] on several occasions. Sho would not be patient enough for the waranty company to process the transfer. So, she called her credit card company and had them cancel part of her down payment on the vehicle for $500.00 amd then called Honda and told them that in no way, shape, or form was her warranty a transfer. The 100K mile coverage is not available for purchase on that vehicle through Honda since it is a 2012. Honda will no longer let the transfer go through because of the customer statement and we cannot sell her the coverage at 100k miles because it is not offered on that vehicle. We tried to purchase her a 90k warranty from a different warranty company, but she states that will not work for her either. I have now reissued her Honda Care warranty that I had cancelled under the assumption she would be happier with 10K more miles of coverage. We have been completely unsuccessful with any attempt to maker her happy. This is all I am able to do.

Fenton Honda cancelled my Honda Care warranty without my authorization. This is not acceptable because I PURCHASED this warranty with MY MONEY and they are not to cancel it without my approval. Their option is giving me the 100K or denying it.
They used my $980 I paid for my Honda Care warranty to purchase the other warranty without my approval. This is considered fraud.

Ms. [redacted]'s story is correct for the most part(or at least on her end). Jacobe McDaniels was our Internet Manager. Mr. McDainels as of 6th of November is no longer employeed at Fenton Nissan of Ardmore.

buying a USED vehicle from us. We CAN NOT hold a vehicle without a down payment. Unfortunately no money was placed on vehicle at the time vehicle was sold. By the time we did receive the cashiers check vehicle was sold.
Due to the fact that vehicle was sold Ms. Biship's cashiers check was never cashed. There was no contract to purchase ever entered into.
This was a certain vehicle that Ms. [redacted] wanted. We have looked for another like vehicle for Ms. [redacted] but to find a make and model with proper milage was to no avale especially at the price we had ours at.
Ms. [redacted] did locate one that was $7,000.00 over ours. To purchase that vehicle and sell it at our price...we would lose $7,000.00. That was not a route we could go.
Fenton Nissan of Ardmore has not entered into a contract with Ms. [redacted] and we never cashed her check.
Since Mr. McDaniels is not longer with us, I can not tell you what was said between him and Ms. [redacted].
I have overnighted Ms. [redacted]'s cashiers check back to her. Due to the fact that I have no signed intent to purchase, I can not reimburss funds when I have no intent to purchase signed.
We feel horiable for what Ms. [redacted] might have gone through had she not telephoned about her flight. But once again, we had no idea that Ms. [redacted] was coming in.
I wish Ms. [redacted] all the luck in the world at finding another great vehicle and wihh I could make her happy. I know at this point I am unable to and I do appologize for this.

Let's get the claims laid out, and then the facts and proof.
FENTON NISSAN/HONDA CLAIM: "We CAN NOT hold a vehicle without a down payment. Unfortunately no money was placed on the vehicle at the time the vehicle was sold. By the time we did receive the cashiers check the vehicle was sold."
FACTS AND PROOF: A cashiers check made out to FENTON NISSAN OF ARDMORE was Federal Expressed on 10/28/14. Tracking number XXXXXXXXXXXX arrived 10/31/14, 5:00 pm at Fenton Nissan in Ardmore OK.
Vehicle in question was sold on 11/8/14 Carfax dated 11/23/14, confirmation number PW5J5Q7H88UEX. Car was sold 9 days after receipt of deposit.
FENTON NISSAN/HONDA CLAIM: "Due to the fact that vehicle was sold Ms Biship's cashiers check was never cashed."
FACTS AND PROOF: The internet director [redacted] telephoned me on 11/1/14 to say he had received the cashiers check, but that I had not signed it. I answered that I did not think that I had to sign a cashiers check as it was not a personal check, but that I would look into it and call back. I wrote an email on 11/1/14 inquiring about the VIN # for insurance purposes, and at that time I told [redacted] the Internet Director that the cahiers check did not need my signature, and that there was no place for my signature. The dealership could cash the check. It was as good as cash. I also told him by telephone on 11/3/14.
FENTON NISSAN/HONDA CLAIM: "Fenton Nissan has not entered into a contract with Ms. [redacted] and we never cashed her check."
FACTS AND PROOF: I started a written dialog (via email) on 10/23/14 with [redacted] (the Internet Director for Fenton Nissan/Honda) regarding the Nissan Murano Cross-Cabriolet that Fenton Nissan/Honda had for sale on the internet (cars.com). We wrote to each other discussing, price, mileage, interior color, previous owner (this was a dealer car, license #I047), deposit required, offer of a ride from the airport, my flight details (purchased 10/27/14 American Airlines ticket #'s XXXXXXXXXXXXX/08) and time of arrival in Oklahoma City. VIN # for insurance, cashing of cashier's check and pictures of the vehicle being purchased. We also had hotel reservations at the La Quinta Inn on 11/11 & 11/12 in Ardmore OK. These emails constitute a good faith effort to purchase the car. Never once was an "intent to purchase" form discussed, or even broached with me. I most surely would have signed it. I remind you that I offered the full purchase price ($33,199.00) to be paid in lieu of the $5000.00 deposit.
I am not responsible for the lack of business acumen displayed by Fenton Nissan in not knowing that they could cash a "cashiers" check without my signature. It is the type of check they asked for.
Nor am I responsible for the lack of communication between departments displayed at Fenton Honda/Nissan. (if no communication, did indeed occur.)
Fenton Nissan had my name, telephone # and my email address in their data base. They could have written or called me at any time between the termination date of the Internet Manager ([redacted]) and the advent of another buyer. But they were willing to let us travel on our one way ticket to Oklahoma and just leave us stranded at the airport In Oklahoma City.
Despicable.
I am now adding the $40.00 it cost me to generate a new CarFax to the $417.00 I feel is owed to me. Total $457.00.

Why would I send a $5000 deposit if I were not serious about purchasing this car. The dealership never offered me a contract to sign. I would have signed it. This dealership is being less than truthful about when they received the check, which I can prove. They are being less than truthful about needing a "signature" on a cashiers check. They are being less than truthful about wishing me another "great car". They have been less than truthful about the entire dialog.I, in good faith was willing to come from California to pick up the car.....had airline tickets, hotel, a ride from the airport. Why would I not sign a contract had one been offered? I was told by their employee that the $5000 would be enough to hold the car. And by the way, emails are written documents, and I have them all!
