Initial Business Response /* (1000, 5, 2014/06/15) */
This complaint was initiated by a bride who sent in a reservation and payment on April 28, 2014, which I confirmed on April 29thThe wedding was scheduled for May 20, 2014, and according to my records, neither the bride nor the groom
called me to check-in, as is implored in paragraph of their confirmation emailTherefore, I didn't know when this couple arrived on the island of Oahu, but based on the fact that they had a rental car, I believe they had ample time to, "do a trial run to determine the layout there." This was plainly stated and advised in paragraph of their confirmation emailIn a May 27th communication from the bride, Bonnie Wan, she admitted that they did not inspect the site prior to the wedding in order to determine whether the site fit their expectations
Upon their arrival at the site and during the course of the ceremony and the photo shoot that followed, neither the bride nor the groom ever mentioned anything about the characteristics of the site nor did they reveal any disappointment with itWhen I gathered the bride and groom in the park on the grass with the waterfall in the background, I remarked that the small leaves falling off the trees from high above looked like Hawaiian "snow"I mention this because the net effect of the leaves falling on the ground was that they lightly blanketed the green grass and adjacent rocksDespite this occurrence, neither the bride nor the groom made any mention about their desire to move or be standing in a place with only luxurious green grass, which was in fact abundant throughout the park and plainly visible in not less than of the couple's photosAs for the "advertising" comment, the bride is referring to of photos posted at the description of this site that shows luxuriant green grass from a portion of the park where the aforementioned photos were takenOne should note that of the photos posted online show leaves on the ground and on the rocksThe bottom line here is that we have no control over the appearance of any wedding site, leaves falling from the trees, and other environmental factors that proved to disappoint this coupleHaving served over 9,couples in the past 13-1/years, we have great experience and flexibility in making adjustments to suit a couple's needs when the occasion arisesSuch was not the case in this matter
The professional photo package (valued at $if ordered separately) that was included in the wedding package ordered by the couple, included: "One Professional photographer & camera, Up to 1/2-hour coverage, Shooting up to images"What our company delivered was one professional photographer & camera, shooting images over a period of minutes, from 9:to 10:AM, which were then posted online same day at 7:PMThe professional photographer I hired for this wedding has worked with me for more than yearsHis demeanor and ability to work with my couples and to capture the action during the ceremony and poses after is, in my opinion, as good as it getsThe bottom line here is that we delivered a very economical package (unmatched on this island), over-shot the "up to images" advertised and timely posted their photos online on the same day at http://***.com (Album: ***)Had the couple truly have been disappointed with the site or anything else, I would expect that they would have expeditiously examined the images the following day, or in the least, while they were still here in Hawaii
I regret that the bride has expressed that they feel "cheated" and accused our company of "advertising" in this complaint, and additionally, in a June 3rd email replying to my May 29th email, accusing my company of being "extremely misleading.", "irresponsible", falsely advertising a green beautiful location, failing to suggest a site inspection, and criticizing the photographer for not noticing "ugly" facial expressions or that her eyelashes were dislodgedBottom line here is that the couple reportedly did not examine their photos on a proper screen while they were still in Hawaii, but did so one week laterAgain, we have no control of these factors mentioned
In an effort to resolve this matter, it would be my pleasure to offer the couple all of their photos copied to a CD (valued at $140) at no chargeIn this way, they would have control of the images and could edit them to their heart's contentIf this is agreeable, I will un-publish their album from our website and demand that they refrain from making any further complaints, removing any such comments that they might have already made, to effect final closure of this matterApplicable supporting documentation is available if requested
Initial Consumer Rebuttal /* (3000, 7, 2014/06/24) */
(The consumer indicated he/she DID NOT accept the response from the business.)
First off, contrary to what *** stated, I did in fact check in with him when we arrived in HawaiiI couldn't call him on Sunday since the office was closed, but I did send him an email instead at ***.com on Sunday, May 18, 2014, but we never got a response back from himAlso, I don't know where he got his facts about my husband and I having a rental car considering the fact that we did notOn our wedding day, we arrived at the garden in a taxiThis also was the first and only time we met with ***
The confirmation email states "you may want to do a trial run to determine the layout there"Seeing that the wedding was only going to consist of me, my husband, ***, and the photographer, I did not see the need to determine any layout at the wedding siteIt was understood that we were going to get married in the front of the waterfall, and I was under the impression that the surroundings would be as green and lush as advertised on their websiteEven if it was not 100% as presented, we did not expect the garden to be in the untended state that it was
Considering the responses that I have received so far from ***, he seems to be content that everything was stated clearly in the contract leaving the onus on the couple to read between the lines to determine whether the aesthetics of the site was as advertisedIn that respect, I highly doubt that had I made verbal contact on arrival to Oahu that *** would have reiterated that we should have gone to do a site inspection, informed us that the condition of the park was not as advertised on their website, and if we were not satisfied, then there was still time for us to get our money backIt is clearly stated in our contract that there were no refundsThe information should have been provided on the business website with a clause stating that there is an option to change with no penalty and that the difference in location fee and permits will be refunded if applicableWe were never made aware of any flexibility with our booking until I filed my complaint
On the day we got married and arrived at the site only to notice the visual difference in the setting, we were in a difficult situationWhat were we to say upon arrival? We were getting married in minutes, only had the place booked for an hour, and the ceremony and photography had to be completed in this time frameWe were not rushed but we felt rushedTo be honest, on the day of the wedding, any couple can tell you that they do not want any more stress than they are already feelingAgain, as mentioned before, we also were in the mindset that everything was binding according to the contractIt is inconceivable for me to believe that if my husband and I said at the time that the site was not what we had expected because it looked nothing like the photos on the website, then *** would have said "okay, hop into my car and we can go somewhere else"In fact, based on everything listed in the contract, I would more likely have gotten the response that it was too late to change locations, that I should have done a site inspection prior to the ceremony, and more likely than not, there would have been an added charge for the extra time incurred for the ceremony, photographer and new locationIt did not matter that the leaves were falling; it still does not take away the fact that the garden did not look like photos 1, and on the website which is what we based our decision off of (combo of all photos and not just photo 2) when we chose this location for our marriageTruth be told, there were hardly any leaves on the trees; they all looked like they were dying just like the rest of the garden since it was poorly maintainedIt did not even cross our minds that we could have moved over to the "greener" grass because, for one, the waterfall would not have been in the picture (which is what we were paying for), and two, we were too busy "getting married" at the momentThe ceremony had started as soon as we got down to the waterfallWe honestly had put our trust into what was presented to us on the company's website
My husband and I did not say anything about the location and photos during our short stay in Oahu as we only had two days left on the island before we had to return home after we received the link to the photosThe images were difficult to analyze on a smartphone, and also the hotel internet was really slow so it was difficult to go through the photosMy husband and I wanted to enjoy the remainder of the time that we were there on the island, and we trusted that the quality of photos were going to be better than what we had receivedI was a bit bothered about the garden at the time, but it was not until we returned home and went through the photos that I realized how upset I was about thisThat was when I contacted *** about my concernsIf the wedding site was not important, then why would we have flown 4,miles from home to get married? We cannot "redo" this experience because it would not be the same as the first time aroundTo add more insult, A Beach Wedding $is not taking any accountability for the state of the garden while I (a first time tourist to Hawaii) am basically getting blamedIt is concerning that the company is comfortable in stating that the aesthetics of the garden was the same as depicted on their website, and that it was in an acceptable state to hold weddings
We appreciated that more than photos were taken than what was included in our package but what is the point of snapping those extra photos if none of them were good? I never said that we did not like the photographer; it's just that the vast majority of the images captured by him were not goodIt seems that the company values quantity over qualityI do not consider it a "very economical package" as stated by *** if only 30% of the photos were acceptable, and he considered those photos captured during the ceremony and poses after "as good as it gets"Had I contacted *** after we had accessed the link to the photos, I would have requested for a refund for the same reasons
I have to reiterate that the ceremony itself was wonderful; it was just the location and the quality of photos taken that we were not happy aboutOf the 9000+ weddings served by A Beach Wedding $95, there were only reviews writtenIt is hard for me to believe that I would be the first unsatisfied customerBased on ***'s response in downplaying the issues and putting all the blame back on us, I feel like we were just a business transaction to himBecause of this, it did not leave me any option but to file a formal complaintThis all could have been avoided if A Beach Wedding $had put a disclaimer on their website about the grounds not looking the way it did all year roundWhile the company may not maintain the grounds or have control over the conditions, I feel it is definitely their responsibility to be aware of the state of the garden because they are technically selling the grounds for their profit and they need to be accountable for what they advertiseIf this is not considered misleading or advertising, then what would this be called? Bad luck? The company should take this experience to better their business and not blame their customers for their flaws
I am upset and saddened that my wedding day memories have come to thisIt baffles my mind that for someone who has been in this industry 13+ years that they would not understand that everything should be as close to perfect as possible on the wedding day for a coupleThe offer of a free copy of the CD of our photos is also absurdWe had ALREADY PAID and received a copy before we left OahuWe do not need or want a second CDThe unedited images on the CD is not valued at $as stated by ***, but rather $which we had paid in addition to the $for the wedding packageWe had originally asked for a refund for the for the photography portion of the wedding package only to have *** choose to address the issue by dismissing our concerns and initial request and, instead, put the blame back on us for choosing the garden, not doing a site inspection as well as not saying anything at the timeIt only seems like now he is taking this seriously because I had filed a complaint, and to be honest, it feels like the offer is an exchange for my silence so that the company can sweep the situation under the rugIn light of how this was handled, I would rather have my experience posted to make consumers aware of the lack of accountability, poor business ethic and professionalism that the company hasIf A Beach Wedding $stands behind what they say about the photos on their website, being that they are accurate and their professional photographers are the best at their craft, then there is nothing to hide
