Review: "Bait and Switch". I received damaged goods in lieu of excellent quality ordered.

I inquired of [redacted] of Ferrparts, located in Sacramento, California, the availability of a pair of vintage Ferrari 330 GT V12 engine heads in excellent, original, undamaged condition, without any previous repairs. I was shortly informed that he did have a pair through Ferrari Classiche in Italy. I was repeatedly assured of their excellent, original condition and on March 15, 2013, I purchased them under invoice #SO-XXXXX for the amount of $19,200.00 with a Bank of America cashier's check, plus the freight cost of $352.00, using my credit card. I was informed that parts were missing on the heads, so on March 27/28, 2013, I ordered and paid for those under invoice #'s SO-XXXXX and SO-XXXXX, for an additional amount of $4,759.00, using my credit card. When the heads arrived, I immediately took them to a very well known and respected Ferrari machine shop, [redacted] of [redacted] CA, to analyze the heads. On May 6, 2013, I was informed that one head was found to have three cracks in it. I immediately informed [redacted] of Ferrparts and requested a full refund. In an attempt to get me to accept damaged goods, I was informed by Ferrari Classiche through Ferrparts that the heads with damage in the form of cracks were "serviceable we mean useable as they are". Ferrari Classiche later denied this advice. In my later e-mails to [redacted] of Ferrparts, he stated "the issue of one (head) having a very slight crack is common". According to [redacted] the head has three cracks, not one, as stated by [redacted] and that cracks in Ferrari heads are not common, not slight, not desirable, and render the head unusable. It was to me an apparent "bait and switch" to get me to accept the damaged head. I also realized that I had purchased a useless, damaged head for the price of an excellent, undamaged head. I have repeatedly requested a refund in full for the entire purchase. [redacted] forwarded a statement via e-mail indicating sufficient funds to forward the refund. Although Ferrari Classiche later agreed to a full refund and [redacted] agreed to a full refund (later added with a 20% restocking fee on some of the parts), I have received no refund at all - nothing but highly unprofessional statements and responses, false accusations, and tactics to either delay or avoid the refund altogether. I have been advised to submit a complaint to the Office of the District Attorney. Desired Settlement: I request a refund in full for all of the expenses spent, $24,311.00

The customer fails to mention. ( hes dishonest in his statement to you and whom ever else he sent the lie to ) simply put- he fails to mention he called us threatening in an unprofessional and childlike manner that his wife was a lawyer and that he has free legal advise and service to put out-tarnish in an attempt to extort monies with no regard to the co policy written on the sales orders he mentioned... He says its his intention to destroy, all business of ours if we did not do as he says. He said he did not and does not care about the part and order contract. He says the head is not good and ferrari suppliers for parts on our end say its fine. Never the less in the email you will see that the customer fails to explain the truth. I/ We offered to fix the head that he claims has an issue. Our ferrari supply said its not a big issue and they can easily remedy. I as well offered to replace the head making it in fact good. He failed to allow us to do so. In good faith I said ( see email again ) " I WILL REFUND YOU IN FULL" for the head you claim is faulty. As to the good parts, and the special order items, as well as the new cams that I provided at less then 80-90 percent of real cost to help him out with his 1950's era ferrari I will ALSO REFUND but will charge ( per the contract ) and its well written on the invoices he supplied you folks with a 25 percent restocking Fee ( ONLY ) on the good part/special order cam caps and cylinder head. Please read the invoice for legality and accuracy as well as my email offering to replace the head with a head that's perfect and or repair and refunds noted. I have also retained the law office of [redacted] J [redacted] here in sacramento for ANY AND ALL FURTHER ISSUES REGARDING HIS CLAIMS, EMAILS, PHONE CALL THREATS ECT.

Ferrparts NEVER got this order correct. Their offer to replace the damaged head was, quite simply, a lie. Ferrparts never intended to replace the damaged head or I would have received it by now. I have always agreed to accept, and will accept now, an excellent, original, undamaged head without any previous repairs as I originally ordered. Please note my previous responses. If Ferrparts refuses to replace the damaged head, I will accept a refund in full for my entire purchase in the amount of $23,959.00. It should also be noted that I had to pay a Ferrari expert to inspect and find out that Ferrparts had sold me damaged goods.

As a major part of my purchase, I was sold via "bait and switch" a damaged cylinder head and that damaged cylinder head makes my ENTIRE purchase USELESS. I would NEVER have initiated this purchase had I known that a major part of it would be damaged. What would I do with only one good cylinder head? To top it off, Ferrparts still wants to profit on this nightmare of a purchase to the tune of several thousand dollars naming it a "restocking fee" on the undamaged parts. It should also be noted that Ferrparts "terms" were not forwarded to me for my review. These "terms" were received by me only after the funds were paid.

There is no customer out there who would accept this degree of abuse. A "Consumer Fraud Complaint" has been submitted to The Sacramento County District Attorney.

I sent several emails to the customer and you at the Revdex.com explaining our position. I have sent emails asking as well for any other new correspondense be sent to the law office of [redacted] J hanachek whom we have retained. I offered a refund for the "part hes unhappy with " and a refund less our restocking fee on the other items. Per the invoice and contract.

Review: In February I purchased a engine for my 1997 Ferrari Spyder I paid $5668.30 for it. The engine I received was no good it was rusted and completely seized. I called them and they sent me another one which was just as bad as the first. I made a dispute with my bank [redacted] and they were going to give me the money back and the day the money was supposed to be deposited in my account. I received another engine and another charge which I never agreed to. This engine was also not good and I believe it to be the original engine that was sent to me. I finally after going back forth with my bank got them to refund me one charge. I then sent at my expense the engine back. I am trying to get my money back from the bank. Meanwhile I am now receiving threating messages via email from [redacted]. I just want the second unauthorized charge to be returned to me. I have had my Ferrari blocking a lift in my shop since February. I have lost a lot of money waiting on this company who keeps sending me bad engines.Desired Settlement: I would like for the second charge of $5668.30 to be refunded to me and to be done with this. Also I would like for these people to NEVER CONTACT ME AGAIN.
