Review: The Fertility Center of California has failed to remove fraudulent charges. Three weeks of phone requests to the company's billing department have failed to yield any result. The company alleges charges for services performed in 2013. All business with this company was completed in good standing in 2007, in accordance with the company's existing policies. I have had no additional contact with the company in the past 7 years. No bill, nor contact was received from this company indicating funds were due or overdue. No statement of account can be provided. This account has been sent to collection by the company. Repeated requests to the billing department have yielded the admission from the company's billing department personnel that the company has no record of this charge or my original business with the company. To be clear, the company admits it has no records on which to base any claims, yet the charges remain, and a collection remains against me. I am a member of the United States Military who was forward deployed when the bill and collection where initiated. This collection is, thereby, also in violation of U.S.C. 50 "Servicemembers Civil Relief Act" Section 523.Desired Settlement: Immediate negation of fraudulent charges, erasure of collection, removal of collection and overdue account from all three credit reporting agencies.

Dear [redacted]; This is a letter in response to the complaint against Fertility Center of California by Mr. [redacted] as registered with the Revdex.com. The Fertility Center of California was created in 2006 and one of its main functions is to store reproductive tissues from people with infertility issues and potential infertility issues such as the military or cancer patients. Mr. [redacted] was in the military. I am the chief operating officer and joined the clinic in May of 2015. The patient provided samples in 2008 for long term cryopreservation storage. At that time, he signed documentation noting that he was 100% responsible for any change of address. Upon the expiration of his service contract with FCC, and per company policy, the patient was phoned as recorded by our electronic medical record with no answer, a letter was then sent and returned and finally a certified return receipt mail was sent to his last known address. Again, per the contract, any contract in default means the reproductive tissues become the property of FCC and can be humanely destroyed at any time. Although the tissue was NOT destroyed, the account was sent to collections (AWA Collections). The Collection Agency was able to contact Mr. [redacted] who disputed the claim. He was billed on 2/9/13 a charge of 125 dollars for 6 months of storage. Our normal charges for that service was 250 dollars but was discounted because of his military service. As Mr. [redacted] disputed the charges, management at FCC decided to write off his outstanding account. The tissues are still in storage and AWA closed their activities to collect on his account as of 08/04/2014. They also notified all of the credit bureaus to remove all trade-lines. An email after this note has been included from Harley Marchbank who owns the collection agency to verify the actions taken Please note that Mr. [redacted]’s credit record was NEVER affected nor was he charged for services rendered. The only organization that lost was FCC in storing tissues at no cost, holding and continue to hold the liability for reproductive tissues and not being paid of any of the services rendered.
