Complaint: [redacted] I am rejecting this response because:I contacted the Revdex.com because the company I hired to work on my bathroom was unwilling to work with me There were some issues that needed to be addressed and he was unwilling to come to our house and talk When I sent email's regarding the issues, he stated they had been addressedThey have notI sent multiple emails regarding the aboveHe also told me he only had one day left with one person to finish the jobThat day came and the job was still not finishedWe started this project in May when I wrote him the first check I have not been able to use my shower since the end of June.I was sent a final bill stating he would not come back until the balance was paid Per his contract the balance was due upon completion of the jobI currently have a shower I cannot use due to design error I have tile in my shower with different color's of grout My towel bar is about 3-inches higher than my other towel bars My shelf above the toilet that was supposed to be painted, was thrown away by his company He did not replace it The light and fan that was installed works occasionally He only painted part of my vanity The new toilet seat purchased is all scuffed up I also have a carport full of garbage he was suppose to takeI also have pictures of my bathroom that will back all issues aboveI did not contact the Revdex.com to give him a bad review I was hoping he would complete the job he agreed to Sincerely, [redacted] ***

This is the exact same email that we received before There is no new information As I stated last time, Lawyers are involved and the information that is being relayed to my lawyer is not the same as what is being sent to the Revdex.com In regards to her complaint about her carport, in an email dated 10/16/I stated, "We have a number of material and tools left at your projectWe need to know when we can come get these items and set up a punch list with you We did not receive any response from her about when this could happen Therefore I do not see why this is being brought up at this point in the process This is just clearly another item where Ms [redacted] is misinforming the BB of the situation As for her claims that she mentioned a shower curtain This is true On 5/she did mention a shower curtain This was in reference to her not being able to figure out which tile she wanted so she wanted to switch to a one piece surround Once on site we discovered that this would not fit thru her door At that point we went back to the plan of tile and the month process of her figuring out tile designs At that point all plans changed During our first meeting I suggested a glass door for the tile design Ms [redacted] did not want to pay for that As for "Our Design" FF Construction does not design any bathrooms Just as we do not pick colors of painttile, grout or any other finishes It simply has too much liability as this situation clearly shows Also as you can clearly see on the invoice she attached there is not design included in our bid Therefore we cannot be held liable for this Also if there were concerns about the design, she had literally months to say something before the job was completed yet she did not do that W build what our customers relay to us If she can produce some design that we submitted to her for approval then that would be different The bid says provide a shower and that was completed Our bid also does not say anything about a shower curtainAs for the towel bar Out of kindness we lowered it once She did not give a dimension for where we moved it to, so clearly she was relying on our discretion on it I believe we have more than done right here As far as the painting is concerned WE had in our bid to paint the shower room ceiling and walls We excluded the vanity area because there was not a good place to start and stop the paint color We avoid cutting in paint on outside corners to the roll over of the color He cabinet This was our mistakeOur guy disposed of this during demo At that point she was notified and we were told not to worry about it because she had a spare in her garage and we could just paint that one Now it is a big deal for her We purchased another one and attempted to paint it, but due to the material it was made of, it would not take paint We then asked her to pick out another one and she still has not done so Of course the new one would need to be comparable As I stated in the previous response about the vanity, We painted all of the vanity WE paint from the inside of the door and drawer opening out We also paint the door faces and drawers Once the entire thing was painted and completed (Please keep in mind that painting is a two step process one primer and then paint) we were then presented with a scrap of wood that they were claiming went with the vanity We tried to fit it everywhere on the vanity and it did not fit anywhere Ms [redacted] also could not show us how it went Therefore since it was not one of the ares that we paint when doing cabinets, it will not be painted the toilet seat was not used as a ladder as she is speculating I do not know why it was scratched and I offered to put this on a punch list The bottom line is that Her lawyer has demanded that we either come back and do hundreds of dollars extra in work in order to receive payment for the items already completed or forfeit all rights to seek legal action against them for refusal to pay At that point we decided against investing anymore money in this project since they were refusing to pay us This was of course not without consulting our business attorney As for Ms ***s Delusion of us not giving her a list of items to pick out, I have multiple emails of us giving her lists of items we need During our sit down in her kitchen we also gave her a list that she later notified us that she could not find the notebook that it was written in On October 11th Ms [redacted] asked us to have a meeting, we responded with an email giving her dates and times we could be there This was rejected by her FF Construction has made more than ample attempts to get this project completed We have already had to pay all suppliers and contractors for work done and material provided We will not put another dime into her project without payment It just isn't good business to more money into something that it is clear will not work out We will maintain the right of legal retaliation for nonpayment

I am rejecting this response because:On November 21, 2017, I sent you the response of my clients regarding allegations thatMr. Brian F[redacted] made in his response to the complaint filed by my clients. In that letter, I askedthat all communications directed to my clients regarding this matter be directed to me, theirattorney. I have learned that you sent a letter to my clients dated November 29, 2017, whichincludes communication from Mr. F[redacted] regarding his response to my clients' November 21, 2017,letter. Again, moving forward, I ask that you send any communications regarding this matterdirectly to me.My clients received an invoice for final payment on October 11,2017, stating the punchlist would be taken care of after the final payment was made. Per the bid form provided by FFConstruction, it states that "the final payment is due at completion of the job." The punch list ispart of the completion, therefore, the project is not complete. In my clients' response to the requestfor final payment, they also requested a meeting with Mr. F[redacted]. This was their tl1ird attempt toget Mr. F[redacted] to meet with them so they could discuss discrepancies.Regarding the shower curtain, after receiving his bid my clients had several questions. One of thequestions: "was a shower curtain rod and installation included?" Mr. F[redacted]'s response: "notincluded add an additional $45.00 for the rod." This response was dated Aprill9, 2017. On May22, 2017, Mr. Client's sent Mr. F[redacted] an email asking if they could change to a shower stall insteadof a tile shower. My clients stated that they planned on covering the shower with a shower curtain.On October 5, 2017, my clients sent Mr. F[redacted] an email stating that they "were going tohang a shower curtain but [they] don't think it will work etc." Mr. F[redacted]'s response: "We can hangit." My clients believe that Mr. F[redacted] was purposely not addressing the problem in an attempt tominimize the mistakes he had made. Mr. F[redacted] was aware that my clients wanted to hang a showercurtain. My clients had made clear that they did not want to bother with the upkeep of a slidingdoor, and instead requested a design that facilitated a shower curtain. Mr. F[redacted] failed to deliveron this request.Mr. F[redacted] further states that he does not pick any finishes. This is not true. Mr. F[redacted]picked my clients' shower head and handle, their bathroom faucets, vanity door handles, and towelbars. My clients picked one color of grout and ended up with two, one of which they did not pick.Mr. F[redacted] also acknowledged the grout. The shower has two different colors of grout. Mr. F[redacted]said before it was sealed it would be taken care of. However, the shower has been sealed with twodifferent colors of grout.Regarding the towel bar, it was placed approximately two-to-three feet higher than thetoilet paper holder. The problem is, if my clients put a wet towel on the bar the toilet paper wouldget wet, and the toilet paper holder would be totally obstructed. Mr. F[redacted] did move the toilet paperholder but not the towel bar. All my clients wanted was the towel bar the same height as the towelbar in the other room. It is a simple request. Additionally, my clients still have spackle on thewall by the toilet paper holder.As for painting, the bid states, "[p]aint drywall or plaster wall" and "[p]aint drywall orplaster ceiling." It does not limit painting to only the shower room ceiling and walls.My clients' cabinet is another issue. When my clients spoke to Mr. F[redacted] about himmistakenly throwing aware their cabinet, they thought they had a spare from a previous remodelMr. F[redacted] could use. It turned out to be part of their kitchen cabinet, and not bathroom. The oneMr. F[redacted] threw away was solid oak, and my clients expect a comparable cabinet to replace theirprevious one that Mr. F[redacted] threw away.Mr. F[redacted]'s statement regarding my clients' vanity are also incomplete. My clients didshow his workers where the vanity was to be placed. However, his workers response was "[ t ]hisjob is over budget and we are not allowed to do anything without Brian's ok and he did not ok it."Mr. F[redacted] was not on site at the time to "ok it" so nothing happened. Further, while the causationtheory regarding the scratches on the toilet seat may be speculation, it does not change the fact thatMr. F[redacted] installed a scratched toilet seat on my clients' toilet and tried to pass it off as new.Mr. F[redacted] alleges that he gave my clients a list of items to pick things for the remodel. This is nottrue. Mr. F[redacted] never gave my clients a list. Mr. F[redacted] would email my clients with a few itemshere and there. My clients had to ask him where he had accounts to get these items. It would havebeen extremely helpful if at the original meeting when my clients signed the contract, he had giventhem a list of everything he needed, along with where his accounts were.Regarding the October 11, 2017, meeting, my clients requested a meeting on September14,2017, October 11.2017, and October 16,2017. On September 14,2017, Mr. F[redacted] respondedthat a meeting was unnecessary. Mr. F[redacted] responded to the October 11, 2017 request with, "weare available Monday from 9 am to 130 after that, I am not sure our next availability." That daydid not work for my clients so my clients sent three other dates that they would be available.My clients contacted the Revdex.com on October 11,2017, in hopes that Mr.F[redacted] would live up to his contractual obligations. On October 201,2017, my clients retained ourlaw firm once they learned that Mr. F[redacted] had no intention correcting his work. Since retainingour firm, my clients have gotten a few bids to correct Mr. F[redacted]'s work, and it will cost them atleast $7,000.00 out of pocket. As such, my clients will not be paying any more money to Mr. F[redacted]to correct his work. However, the window is closing on their offer for him to return to theirresidence and complete the project.Again, direct all further communication regarding this matter to me.Respectfully,

Our company has gone above and beyond to try to meet her request. At this point the lawyer that she has retained has relay to my lawyer the only acceptable means to settle this is for us to not receive any more payment for work that is completed and to release any liability from payment. We do not...

see this as an acceptable solution to the issue. Also she is not allowing us to return to get any material tools or to complete any work at her house anymore. We would be more than happy to compromise with her on some of the items. But as stated above she's not even communicating any type of compromise.  It is abundantly clear that her only intentions of going to the Revdex.com is in order to give us a bad review on it. At this point we requested the Revdex.com close the complaint without any negative repercussions toward our company. It is very clear this matter will most likely be going to court.
