Thank You for the opportunity to respond I agree that the project has taken too long It has been a challenge to accommodate the requests desired by the the client In an effort to satisfy your requests to handle portions of the project yourself we were idle for weeks at a time This pattern of start / stop began right from the start when you requested that your person do the excavation for the pool We waited for weeks for the excavation to happen During this time we were forced to schedule then cancel, schedule then cancel our crews This pattern of start stop, the multiple changing of responsibility as to who was doing what caused this project to extend in time I am in communication and have been on site repeatedly since the Revdex.com process has started in an effort to protect and clean your pool during the flooding of late We have prepared the pool to receive the cover, an addition that you requested I want to complete the cover installation and I am prepared to do so immediately upon resolution of this dispute

The pool is not completely level I disagree however that it is plus inches out of level A representative from the Manufacturer has seen the pool and informed myself and the client that it would be covered with the full warranty from the manufacturer.The standpipe is functioning as intended This was viewed by the representative from manufacturer and I was informed that it was not an issue.The pool does in fact have a bond beam around it.The contract calls for three PAL 2LLED lights to be installed in the pool and one in the spa These lights are installed They are colors lights They have an individual remote to control them The client specifically requested the Hayward Omni logic control unit It has been installed and is functioning The contract does state individual control of lights A wireless controller for the lights has been provided Additionally I have offered to exchange the lights but this offer was rejected.Two spa jets are functioning intermittently I have discussed this with the client and have a solution I can implement Possible leak is something the client has not previously brought up as an issue I will be happy to take a look at this and verify leak or no leak.I have previously replaced the autofill device as it was not installed correctly I will be glad to verify that it is working properly.The client has previously complimented the masonry around the pool The client expressed a desire to install a waterline tile (a change order) around the pool I presented a quote for doing the work The client rejected the quote sighting price I offered to allow the client to purchase tile through my wholesale account with no mark up as the client said this could be a project he would so at a later date Tile can be installed around the pool.“Implied in the Description” The client specifically and personally researched the Omnilogic controller by Hayward prior to directing Fiberclassy Pools to purchase and install it To date, the manufacturer has not released a hand held remote for the Omnilogic It is set up for controlling through a smart phone If and when the hand held controller is released to the marketplace the client can purchase it if that is his desire Fiberclassy Polls is under no obligation to provide it.The client has requested construction plans and installation guidelines from Fiberclassy Pools Fiberclassy has given the client what has been provided as an installation manual from the pool manufacturer Additionally we have previously provided all technical date by way of installation manual’s and data sheets per the clients requests Another meeting was requested and scheduled per the client request with a representative from the pool manufacturer The client canceled the meeting with the factory representative who was scheduled to drive some four hundred miles specifically to meet with him

I The pool is not level The finished pool is out of level by a difference of four or more (4+) inches end-to-end along its length This may be due partly or in total to a “distortion” of the fiberglass pool shell’s design shape at its deep end (i.e., the pool rim clearly “dips” downward beginning about three quarters of the way along its length from the shallow end) In the early stages of construction, as the pool shell was inserted into the excavation, we observed that the excavation bottom, coated with a bed of gravel, was prepared using a laser level device The inserted pool shell was then checked for level using that same device, using the pool bottom as reference, not the upper pool rim.Soon after the pool shell had been inserted, we had severe rain This caused some walls of the excavation to cave in When Mr [redacted] , supervisor of the job site, arrived with a crew several days later, I noted to him that there was much loose wet clay in the excavation from these cave-ins Nevertheless Mr [redacted] began to fill the pool with water (gradually up to about 2/full) and his crew began backfilling the excavation with gravel, without removing any cavmuddy clay type matter that had partially filled some areas of the gap between the pool shell and the excavation walls At the deep end, and along one side in particular, much of this matter was present, preventing backfill gravel from reaching all the way down to the original floor of the excavation A standpipe system to mitigate hydrostatic pressure – a de-watering system – was, by virtue of workers leaving cavmatter in place, installed contrary to its ordinary requirement to reach to the very bottom of the excavation Instead, the bottom of the standpipe was at 18” or more from the bottom of the excavation We questioned this at the time but Mr [redacted] ***, the prime contractor, insisted it was not a problem.We believe that water filling the pool could have pressed outward on the shell and, because gravel had not replaced the muddy clay that had caved in, the design shape of the pool shell could have been compromised.Mr [redacted] claims that his crew “re-shot” the pool for level after they returned to backfill the excavation Our photographic evidence does not confirm or deny that this actually happened but a photograph taken 1/7/shows the backfill task completed and that the laser device had been taken away That photograph does not indicate an out of level condition.As the excavation was being backfilled, Mr [redacted] discussed with me that one of the next steps would be the installation of a “bond beam.” Ordinarily, this is a reinforced concrete “collar” installed around the outside rim of the fiberglass shell The collar conforms to the shape of the rim and is put in place to prevent that shape from being altered by lateral movement of the pool itself or by movement of the surrounding earth This collar is generally several inches wide and deep and is reinforced with steel rebar (Alternately, Leisure Pools, the shell manufacturer, describes in a promotional flyer the installation of a steel rebar reinforced concrete deck completely surrounding the pool This deck would serve the dual purpose of a recreational surface and as a bonding structure laterally locking in the pool’s shape Presumably, the bond beam was outlined to me by Mr [redacted] because our pool plan did not allow for a deck to completely surround our pool.)When Mr [redacted] , masonry worker then first came on site to begin concrete work he stated, when asked, that he had no work order to install a bond beam Instead, he apparently was ordered to simply lay down a concrete base atop the gravel, around the rim, upon which to set the stone pieces in mortar that would form the “coping” or ledge of the pool I questioned this change from what Mr [redacted] had clearly stated and stopped the job This brought Mr [redacted] again out to meet with me on site I expressed my concern that no bond beam was to be installed I had already done my own research and found that a bond beam seemed a somewhat ordinary installation practice when a deck does not surround the pool However, Mr [redacted] assured me, in the strongest terms, that “no bond beam was necessary.” After a lengthy back and forth, I reluctantly agreed to let his crew proceed.We believe that, if a bond beam had been ordered to be installed, it could well have been discovered then that the pool shell had moved from level in some way so as to cause it to be misshapen and lower in elevation at the deep end (Note: In these early stages of construction the pool was only partially filled with water, making it almost impossible to see an out-of-level condition It wasn’t until the pool was filled to capacity that the difference between the water line and the pool rim was clearly evident.)We do know as fact that the concrete base Mr [redacted] set down, and the stone pieces he set in mortar on top of that base, were both installed after the pool rim at the deep end had moved This is evidenced by the fact that there are no cracks anywhere along the ledge of the pool, as there would be if the pool shell had moved after all this masonry work had been done.No resolution has been offered to correct this errorII An incorrect lighting system was installed The actual light fixtures in the pool and spa were installed by Mr [redacted] He discussed with me on installation day that he had “saved money” by obtaining the fixtures he was using, and so was installing a fourth one for us “without charge.” Not knowing what would eventually happen, I accepted this offer However, much farther down the road -- after all masonry work had been completed, a recreational concrete deck had been poured, the plumbing/electrical/ mechanical & electronics system connected (but not tested) and the pool filled to capacity -- the computer operating system was started up and it was discovered that the lighting system did not function as specified Later, as the overall operating system – named the Hayward Omni-Logic System – was being initially serviced and further set up by a Hayward Company technician, the technician reported that the light fixtures were not Hayward brand fixtures and, therefore, would not function properly.The fixtures Mr [redacted] installed are PAL Company brand fixtures When recently asked why he installed PAL light fixtures, he stated to me that PAL fixtures were specified “in the contract.” This is not so The contract we signed clearly states, “Hayward Omni Logic pool automated control systemIncludes individual control of lights, spa, heater operation and temperature ”Mr [redacted] attempted to address the situation by obtaining a PAL “controller” and remote device However, upon arriving to install this device, Mr [redacted] stated to me that the only control the device has over the lights is “on and off.” The Omni-Logic system we paid for includes themed light shows and all variety of lighting colors, changes, themes, etc The PAL light fixtures are not programmable using the Hayward system and, it appears, nor through a PAL control device other than to turn them on and off No resolution to correct this error has been offeredIII Two of the six jets in the spa do not function as required and its air-blower shuts down The spa contains six high-velocity jets of water that operate when the system is in spa mode and the pump is running at maximum speed In addition, there is installed an air blower that injects air into the streams of water for therapeutic purposes, much as in hydrotherapy tanks and above ground spas sold In “Blower” mode, only four of the six jets emit air with water The remaining two emit water only Added to that, the blower then shuts down after only a minute or so of operation The shutdown appears to be due to overloading of the motor That leads us to further believe the motor is too small (it is 1-1/HP) If the motor is too small, it could also be why the two jets do not emit air Mr [redacted] and I have discussed trying a larger motor However, Mr [redacted] insists the problem is a “pebble” lodged in one of the pipes, and the spa’s stone façade must be removed in order to get to the pipesNo specific resolution to correct this error has yet been offeredIV Possible leak(s) in plumbing and/or pool shell We notice that the water level in the pool drops by an inch or more over only two to three days This does not seem normal Evaporation will cause some water loss but we have not been given any answer to questions asked about the loss we notice At the time when plumbing which services the water in the pool was installed, “***,” the crewman who was doing the work was asked by me about pressure testing of the plumbing before it was buried in gravel and covered in concrete [redacted] stated that he “never pressure tests” his installations and sees no need to do so because of his “eighteen years of experience” doing such work I stated to [redacted] at the time that I wanted the system pressure tested before pipes were buried He said he would comply, but we have neither been given nor seen any evidence or results that the test actually happened.We are also concerned that, with the pool shell “warped” out of shape at the deep end, there may have been some cracking that could result in leakage.We have no assurance that we have a pool without leaksV After several attempts an auto-fill device still does not appear to work properly This device has gone through several re-installations and is yet to be shown as working properly Its valve system at the house exterior wall appears to leak The float system at the pool appears non-functional Mr [redacted] has come out twice to “repair” things but has shown us no evidence that the system is functionalVI Poor masonry work around the pool rim will not allow tile to be installed When installing the stone pieces around the pool rim to form the coping, or ledge, the mason left a) huge gaps in the mortar, and b) numerous areas where mortar was squeezed and allowed to bulge This is evident (photos) all along the inside of the pool The gaps should have been filled and the mortar that squeezed out in places should have been troweled away to leave a smooth joint Neither happened and it is now impossible to install decorative tile around the rim, under the ledge/coping, without significant grinding away of mortar and filling in where gaps exist In addition, there are areas where the coping stone was laid with little or no inside overhang of the fiberglass rim Tile installed there will have edges exposed.No specific resolution of this error is offeredVII Implied in the description of the Omni-Logic System, as purchased, is included a hand-held remote control It has not been delivered A representative of the Hayward Company indicated that the remote device is just now out of Beta testing and is soon to be coming off the assembly line Mr [redacted] seemed surprised when I inquired that I was expecting to receive one as it became available We do expect this remote device to be included within our contract price We understand that Omni-Logic is a new top-of-the-line system for Hayward but we also understood from the beginning of the contract negotiation process that this system would be controlled from a hand-held remote as well as a cell phone app.No guarantee of receiving this item is offeredVIII Requests for copies of Fiberclassy Pools construction plans that specify equipment and materials to be used, as well as labor schedules, and any installation guidelines from Leisure Pools Company, have gone largely unanswered On two occasions we have asked for copies of these documents so that we might determine why errors and omissions may have occurred with specifications of equipment (e.g., light fixtures) and/or labor orders These requests have, so far, largely gone unanswered by Fiberclassy Pools Mr [redacted] wishes for us to meet with him and a representative from Leisure Pools to discuss the pool’s condition, as installed We have been advised not to permit this meeting until we receive and have had a chance to examine these documents

I am rejecting this response because: The contractor is
denying responsibility for the poor quality installation of this pool. 1)
Measurements vary from to inches, but more importantly this pool is out
of level due to a distortion of the pool’s design shape, or a sinking, at its deep
end. We have had no hard evidence presented to us that the pool's
manufacturer will warranty our pool as it does all others. Verbal
assurances will not be accepted. Even so, the aesthetics of a luxury swimming
pool this distorted is unsightly and repelling. Contractor *** *** sold
himself as a premier pool builderSomeone who builds pools costing hundreds of
thousands of dollarsAnd now expects us
to accept this shoddy workmanship. 2) Contractor has not provided details
of construction orders generated by the contractor to his subs, as demanded. It is almost ridiculous to show the flyer
from Leisure Pools that Contractor gave us and call it an “installation manual.” But even as it is a selling aid, it shows
clearly installation of heavily reinforced concrete completely surrounding the
rim of the pool. 3) With regard to lighting, Contractor has already
admitted that incorrect equipment was installed but has provided only
"take-it-or-leave-it" solutions that involve only on-or-off control.
There is nothing stated in the contract about PAL 2LLED lights. What is
stated is Hayward brand lighting with Omni-Logic control. Contractor is
misleading about the lights. His sub-contractor, *** ***,
installed “cheaper” light fixtures (he boasted about this) that we now find
will not work as intended with the Omni-Logic control system that we
specifically paid for. This is shear fraudulent behavior. 4) We have never "complimented" the
masonry work of the contractor. We had to argue for the right coping
stone sizes. We stopped the job at one
point over the mason not preparing to install a reinforced bond beam. (*** *** stated a bond beam would be
installed. Contractor stated no bond
beam was needed.) We reserved opinion when
we were deciding on installation of tile. However, the sloppy masonry work
seen in photographs makes it impossible to mount tile without severe grinding
down of bulging cement everywherePictures speak volumes. We will show in
clear photographs the shoddy workmanship that cannot now be easily
corrected. 5) As to the bond beam, Contractor is untruthful. We
have photographic evidence that a bond beam was not, nor could not be, installed
as the site was backfilled. Furthermore, we can show two reports from
experts that will state there is no bond beam support around this pool
installation. 6) The standpipe was installed in a manner such that it
does not reach to the bottom of the excavation, as is required. 7) The issue with the spa jets is not even
resolved within Fiberclassy Pools. ***

has another. We have no idea what we can
expect to fix this problem. The air
blower does not function. It shuts
itself down after a minute or so of operation. 8) We have made it clear that we will no longer accept any verbal assurances
or assessments from Leisure Pools or Fiberclassy Pools. We will rely on our Structural Engineer and
former pool contractor to advise us with their reports. 9) In addition, a) Contractor destroyed a
mature Magnolia tree when bringing the pool shell incorrectly into our yard, b) we were
double-charged and paid over $for items that *** *** insisted were
not in the contract but actually are, and c) Contractor has not called for this
pool installation to be been given final inspection by the city, county, etc
At this time, we request Revdex.com mediation as per the terms of
the contract

I read the response from Fiberclassy Pools to the previously filed complaint # ***, but I don't see intheir response any proposed solution to all the pending issuesEven worst is the threatening response thatis not acceptable as they even say there will be no guarantee of their work or even of the pool itself.I'm stressed out and simply do not know how to proceed as we have never faced this type of aggressivebehavior from a contractorIn addition to the contract signed with Fiberclassy Pools (The Swimming Man) we verbally had a changeorderThis change order included adding a section of deck (sqft) and ft of drain deck, adding 2steps and the replacement of the pool pump, which the difference I will have to payBy the way, I paidfor the new variable speed pump and the robot cleaner with my credit card, for which I have the receipts.The day the cement was being poured Fiberclassy demanded the balance payment of the change order(actual balance is $1090), based on an incorrect invoice they presentedWhen I told the VP Operationsthat they need to rectify the invoice, he threatened to stop all the work required to finish the cement deckand as he said: "the cement job will be ruined"I complained to *** *** and he asked me to pleasehave patience as he was “training” this VP OperationsBut when *** *** told me that this VPOperations had threatened to be violent towards me, I asked *** to remove this employee from myproperty.There was a lot of frustration during the pouring of the cementI had requested that the rebar be raisedfrom the ground and they placed some small plastic risers which were being displaced and broken by thepeople handling the hose to pour the cementI did say in Spanish that those stupid risers are not going towork, they should have been cement blocks, which is the standard to raise rebar from the groundNowthey are saying that I called them stupid! (By the way not one worker walked out of this job, I told ***Smith to remove the VP Operations as he was threatening me)For completeness, back in February, theVP Operations once before demanded payment as the pool equipment was being installedI explained tohim that I need to talk to *** *** to replace the pump with a variable speed pump, as the single speedpump they installed was very inefficientTo this the VP Operations threaten me that if I don't give himthe check that minute he will remove the installed equipmentAfter talking with *** *** he asked meto have patience as he was training this employee.The wood forms and the cantilever coping foam forms were not installed correctly prior to pouring thecement, which led to wavy and crooked copings and stepsAlso they did not do the cuts in the cement toprevent stress breaks although this was discussed in detail with *** ***, including stating that Iwanted rectangular shapesOn this last issue, they told me they will come back when the cement is dryand make some deep cuts with a saw for this purposeThey came to make the cuts in the cement, but thestress problem has not been corrected proven by a crack on the cement.The deco drain has not been completed satisfactory, as a section is missing and there are gaps between thedrain and the cementThis work was done by a Swimming Man sub-contractor,who also painted thecement deck, as part of a repair job to try to correct faulty original installationI have tried several timesto call this sub-contractor but he does not answer my phone calls or pay attention to voice mailsI haveinformed and sent photos to *** *** showing the(a) deck paint is peeling, (b) there is a crack on thecement of the deck, which he told me that he will correct sawing the cement deeper in the section wherethere is a crack, which has not been done yet, (c) the cantilever coping is still crooked, jagged in places
Regards, and rough where it meets the fiberglass, (d) the steps installed with the deck are very poorly done andthey are curved instead of being straight which is unacceptable, and last but not least (e) removing therocks and grading the yard to correct the damage done by the heavy machines, as I was told they will do,even utilizing a laser level (the only thing that was not included is reseeding the grass).In the previous complaint I forgot to include that the cement pad under the pool pump and filter iscrackedThis problem was informed to Fiberclassy Pools (The Swimming Man)'s *** *** over thelast monthThe answer was he will look into it, but to no availThe cement pad is getting worst and is notacceptable. I request urgent actions to fix these problems to our satisfactionNobody should have to undergo thistreatment and total disregard to complete a job satisfactory within the days they promised to completeit and a total lack of consideration to the stress and mental anguish that have produced on both me and mywife by the lack of timely corrective actions.We will be willing to place the small balance of the change order in escrow until the work is inspected bya third party expert to be deemed satisfactory to industry standards of all the issues outstandingFinallywe will have to have a written guarantee with all the detailed coverage, in light of the refusal to honor theguarantee as stated in Fiberclassy response.

We are in this position because you have failed to honor our original contract You have failed to honor a change order request You told me that you would pay for the change order when the concrete truck showed up After we poured you refused to pay.You have made demands for extra
work that is neither my responsibility nor in the scope of our agreement.Your job has strung out because of your failure to honor your word. I will be filing liens immediately should you fail to honor the contract. Additionally there is no warranty for any of the work done nor the warranty from the pool manufacturer.I grew up listening to Paul Harvey......A program called "The Rest of the Story" You have gone out of your way not to honor our agreement You are using a public forum to cause good people grief The rest of the story is your shabby treatment of the workers on the project......calling them "Stupid" is not an inspiring way to have workers be motivated I had people walk off the job as a direct result from your verbal abuse. You didn't pay your bill....not even after I adjusted the draw schedule per your request

We have responded to your Attorney as a courtesy and we have continued to maintain your pool until will can get our issues sorted out.Our agreement says that all disputes shall be handled by the Revdex.com.  This agreement precludes attorneys.  We are using the format we agreed upon to find resolution by going thru the Revdex.com.  I have done substantial work in preparation for the cover install.  I am prepared to immediately complete the cover install once we reach an understanding.  It is not fair that I refund your deposit after I have already begun the work so that you can have the cover installed directly.

ordered to be installed, it could well have been discovered then that the pool shell had moved from level in some way so as to cause it to be misshapen and lower in elevation at the deep end.  (Note:  In these early stages of construction the pool was only partially filled with water, making it almost impossible to see an out-of-level condition.  It wasn’t until the pool was filled to capacity that the difference between the water line and the pool rim was clearly evident.)We do know as fact that the concrete base Mr. [redacted] set down, and the stone pieces he set in mortar on top of that base, were both installed after the pool rim at the deep end had moved.  This is evidenced by the fact that there are no cracks anywhere along the ledge of the pool, as there would be if the pool shell had moved after all this masonry work had been done.No resolution has been offered to correct this error. II.  An incorrect lighting system was installed.  The actual light fixtures in the pool and spa were installed by Mr. [redacted].  He discussed with me on installation day that he had “saved money” by obtaining the fixtures he was using, and so was installing a fourth one for us “without charge.”  Not knowing what would eventually happen, I accepted this offer.  However, much farther down the road -- after all masonry work had been completed, a recreational concrete deck had been poured, the plumbing/electrical/ mechanical & electronics system connected (but not tested) and the pool filled to capacity -- the computer operating system was started up and it was discovered that the lighting system did not function as specified.  Later, as the overall operating system – named the Hayward Omni-Logic System – was being initially serviced and further set up by a Hayward Company technician, the technician reported that the light fixtures were not Hayward brand fixtures and, therefore, would not function properly.The fixtures Mr. [redacted] installed are PAL Company brand fixtures.  When recently asked why he installed PAL light fixtures, he stated to me that PAL fixtures were specified “in the contract.”  This is not so.  The contract we signed clearly states, “Hayward Omni Logic pool automated control system. Includes individual control of lights, spa, heater operation and temperature……”Mr. [redacted] attempted to address the situation by obtaining a PAL “controller” and remote device.  However, upon arriving to install this device, Mr. [redacted] stated to me that the only control the device has over the lights is “on and off.”  The Omni-Logic system we paid for includes themed light shows and all variety of lighting colors, changes, themes, etc.  The PAL light fixtures are not programmable using the Hayward system and, it appears, nor through a PAL control device other than to turn them on and off.  No resolution to correct this error has been offered. III.  Two of the six jets in the spa do not function as required and its air-blower shuts down.  The spa contains six high-velocity jets of water that operate when the system is in spa mode and the pump is running at maximum speed.  In addition, there is installed an air blower that injects air into the streams of water for therapeutic purposes, much as in hydrotherapy tanks and above ground spas sold.  In “Blower” mode, only four of the six jets emit air with water.  The remaining two emit water only.  Added to that, the blower then shuts down after only a minute or so of operation.  The shutdown appears to be due to overloading of the motor.  That leads us to further believe the motor is too small (it is 1-1/2 HP).  If the motor is too small, it could also be why the two jets do not emit air.  Mr. [redacted] and I have discussed trying a larger motor.  However, Mr. [redacted] insists the problem is a “pebble” lodged in one of the pipes, and the spa’s stone façade must be removed in order to get to the pipes. No specific resolution to correct this error has yet been offered. IV.  Possible leak(s) in plumbing and/or pool shell.  We notice that the water level in the pool drops by an inch or more over only two to three days.  This does not seem normal.  Evaporation will cause some water loss but we have not been given any answer to questions asked about the loss we notice.  At the time when plumbing which services the water in the pool was installed, “[redacted],” the crewman who was doing the work was asked by me about pressure testing of the plumbing before it was buried in gravel and covered in concrete.  [redacted] stated that he “never pressure tests” his installations and sees no need to do so because of his “eighteen years of experience” doing such work.  I stated to [redacted] at the time that I wanted the system pressure tested before pipes were buried.  He said he would comply, but we have neither been given nor seen any evidence or results that the test actually happened.We are also concerned that, with the pool shell “warped” out of shape at the deep end, there may have been some cracking that could result in leakage.We have no assurance that we have a pool without leaks. V.  After several attempts an auto-fill device still does not appear to work properly.  This device has gone through several re-installations and is yet to be shown as working properly.  Its valve system at the house exterior wall appears to leak.  The float system at the pool appears non-functional.  Mr. [redacted] has come out twice to “repair” things but has shown us no evidence that the system is functional. VI.  Poor masonry work around the pool rim will not allow tile to be installed.  When installing the stone pieces around the pool rim to form the coping, or ledge, the mason left a) huge gaps in the mortar, and b) numerous areas where mortar was squeezed and allowed to bulge.   This is evident (photos) all along the inside of the pool.  The gaps should have been filled and the mortar that squeezed out in places should have been troweled away to leave a smooth joint.  Neither happened and it is now impossible to install decorative tile around the rim, under the ledge/coping, without significant grinding away of mortar and filling in where gaps exist.  In addition, there are areas where the coping stone was laid with little or no inside overhang of the fiberglass rim.  Tile installed there will have edges exposed.No specific resolution of this error is offered. VII.  Implied in the description of the Omni-Logic System, as purchased, is included a hand-held remote control.  It has not been delivered.  A representative of the Hayward Company indicated that the remote device is just now out of Beta testing and is soon to be coming off the assembly line.  Mr. [redacted] seemed surprised when I inquired that I was expecting to receive one as it became available.  We do expect this remote device to be included within our contract price.  We understand that Omni-Logic is a new top-of-the-line system for Hayward but we also understood from the beginning of the contract negotiation process that this system would be controlled from a hand-held remote as well as a cell phone app.No guarantee of receiving this item is offered. VIII.  Requests for copies of Fiberclassy Pools construction plans that specify equipment and materials to be used, as well as labor schedules, and any installation guidelines from Leisure Pools Company, have gone largely unanswered.  On two occasions we have asked for copies of these documents so that we might determine why errors and omissions may have occurred with specifications of equipment (e.g., light fixtures) and/or labor orders.  These requests have, so far, largely gone unanswered by Fiberclassy Pools.  Mr. [redacted] wishes for us to meet with him and a representative from Leisure Pools to discuss the pool’s condition, as installed.  We have been advised not to permit this meeting until we receive and have had a chance to examine these documents

The pool is not completely level.  I disagree however that it is 4 plus inches out of level.  A representative from the Manufacturer has seen the pool and informed myself and the client that it would be covered with the full warranty from the manufacturer.The standpipe is functioning as intended.  This was viewed by the representative from manufacturer and I was informed that it was not an issue.The pool does in fact have a bond beam around it.The contract calls for three PAL 2L2 LED lights to be installed in the pool and one in the spa.  These lights are installed.  They are colors lights.  They have an individual remote to control them.  The client specifically requested the Hayward Omni logic control unit.  It has been installed and is functioning.  The contract does state individual control of lights.  A wireless controller for the lights has been provided.  Additionally I have offered to exchange the lights but this offer was rejected.Two spa jets are functioning intermittently.  I have discussed this with the client and have a solution I can implement.  Possible leak is something the client has not previously brought up as an issue.  I will be happy to take a look at this and verify leak or no leak.I have previously replaced the autofill device as it was not installed correctly.  I will be glad to verify that it is working properly.The client has previously complimented the masonry around the pool.  The client expressed a desire to install a waterline tile (a change order) around the pool.  I presented a quote for doing the work.  The client rejected the quote sighting price.  I offered to allow the client to purchase tile through my wholesale account with no mark up as the client said this could be a project he would so at a later date.  Tile can be installed around the pool.“Implied in the Description”  The client specifically and personally researched the Omnilogic controller by Hayward prior to directing Fiberclassy Pools to purchase and install it.  To date, the manufacturer has not released a hand held remote for the Omnilogic.  It is set up for controlling through a smart phone.  If and when the hand held controller is released to the marketplace the client can purchase it if that is his desire.  Fiberclassy Polls is under no obligation to provide it.The client has requested construction plans and installation guidelines from Fiberclassy Pools.  Fiberclassy has given the client what has been provided as an installation manual from the pool manufacturer.  Additionally we have previously provided all technical date by way of installation manual’s and data sheets per the clients requests.  Another meeting was requested and scheduled per the client request with a representative from the pool manufacturer.  The client canceled the meeting with the factory representative who was scheduled to drive some four hundred miles specifically to meet with him.

Thank You for the opportunity to respond.  I agree that the project has taken too long.  It has been a challenge to accommodate the requests desired by the the client.  In an effort to satisfy your requests to handle portions of the project yourself we were idle for weeks at a time....

 This pattern of start / stop began right from the start when you requested that your person do the excavation for the pool.  We waited for weeks for the excavation to happen.  During this time we were forced to schedule then cancel, schedule then cancel our crews.  This pattern of start stop, the multiple changing of responsibility as to who was doing what caused this project to extend in time.  I am in communication and have been on site repeatedly since the Revdex.com process has started in an effort to protect and clean your pool during the flooding of late.  We have prepared the pool to receive the cover, an addition that you requested.  I want to complete the cover installation and I am prepared to do so immediately upon resolution of this dispute.

Our contract clearly outlines scope of work and roles and responsibilities.  You have not honored that agreement.  I will be filing a lien so as to protect the workers who have already executed the work and have not been paid due to your refusal to honor your contract.
