I am rejecting this response because: See attached em,ail for my reasons
Sincerely,
*** *** ----- Forwarded Message ----- From: *** *** To: '*** * ***' Sent: Thursday, May 25, 11:AM Subject: RE: Big problems with pool repairs ***, I
think you may have me mixed up with another one of your customers,
because you only sanded my pool coping down and re-applied the gel coat
onceI have lots of pictures and emails that will document and support
this and all the other facts I’ve mentionedYou are also wrong about my
complaint with the initial application of fiberglass particles and gel
coatIt wasn’t a “minor” problem it was a major problem that made
walking on the coping or swimming in pool very hazardous, because of all
the sharp edged pieces of fiberglass and gel coating that would cut
your skin and had no place on a swimming poolI told you it was
unacceptable and dangerous, and that it had to be sanded down smooth and
redone before I could close the pool for winter It hasn’t been a year either…you finished the 2nd application on or about Sept 22nd and we closed the pool Sept 29thIt was then re-opened on May 12th
and that is when we discovered the gel coat didn’t cure and was
imbedded with dirt and other stuffAs you can see at the start of this
email, I notified you on Monday , May 15th which is the first business day after discovering the gel-coat problem Concerning
your contract and obligations….the job was never completed and as of
today I’m still out $and worse off than before you ever touched
the poolI already provided an extensive explanation for why I don’t
want you or your son to ever touch the pool again, but the short version
is, you have already done enough damageThe only way you are going to satisfy me, is to refund the money I paid you to do this job If you don’t refund the money by June 30, 2017, I will be suing you for whatever it cost to fix the pool, replacing the damaged winter cover and my attorney fees Sincerely, *** *** From: *** * *** [mailto:***@sbcglobal.net] Sent: Thursday, May 25, 6:AMTo: *** *** Subject: Re: Big problems with pool repairs In
your own words I had filled my obligation per our contract the first
time I did the jobYou said there were a few minor problems you had
with the work and you wanted more non skid texture on the coping so at
no cost to you I reworked the job, Then later you called saying it was
to much texture, so once again at no cost to you I reworked the jobNow
a year later, you call with problems. I tell you I will rework the job
once again at no cost to you. I am and always have been committed to
satisfying all my customers. I am willing to rework the job yet again
to your satisfaction which is far above and beyond my responsibilities
per the contract.***From: *** *** To: '*** * ***' Sent: Wednesday, May 24, 12:PMSubject: RE: Big problems with pool repairs ***,Can’t say I’m surprised by this very meaningless response, but I wanted to be fair and give you a chance to make it rightSince
I haven’t heard anything from you in more than a week, I’ve started
looking for someone else to fix this mess you createdWith only a few
calls I was able to find two people who have seen similar unsatisfactory
work done by youThen when asking my pool supply store (***) if
they had someone they could recommend to repair a fiberglass pool they
said No, the guy they used to recommend had too many complaintsWhen I
asked who it was, they said his name was ***When I sent a few
people in the fiberglass repair business some pictures of your work,
they were shocked at how bad it looked, so it’s not just me.Your
failure to do this job correctly, even after being given a second
chance confirms my fears about your lack of concern or ability to do the
kind of work you claim to be an expert atI’m not just talking about
the gel-coat not curingI’m talking about the terrible surface finish
on the top of the coping and the walls of the poolThe sanding and
re-coating job you did looks like something done by a person who knows
nothing about fiberglassIt’s supposed to be smooth and glossy like the
hull of a boat, side of a shower or a swimming poolIt looks like
someone attacked it with a 4” angle grinder and there is nothing
professional about the entire job, least of all the rollmayo
texture you put on the poolWhen we asked for a small amount of texture
to the coping to reduce slips and falls when wet, we told you to
duplicate the existing surface, and you turned it into something that
would tear skin and bathing suitsYour sanding and re-coating job to
correct this dangerous surface was only a slight improvement, because
while it still looked horrible, at least it wouldn’t tear someone’s skin
offI
have lost all faith in your desire or ability to properly repair my
pool, and from the tone of your letter you don’t sound very concerned
about it“You will let me know when you can get me on your schedule”
Really ? I already paid you $for this job, and fixing it should
have been at the top of your list, if you were really concerned about
making this rightI keep asking myself how in the world a guy like you
can continue to stay in business doing work like thisWe have had our
pool repaired twice before and both times it looked like a new pool with
same textures and surface finish as before repairs, just without the
surface cracksI was also told about another unhappy customer of yours
with similar pool coping repair issues, who said he’s thinking about
suing you, so it appears I’m not alone. For
all the reasons stated above, I don’t want you or your son anywhere
near my pool or my propertyThe only way you can make this right is to
refund the $I paid youThat isn’t going to come close to
covering what it’s going to cost to the mess you have made of my
pool or to pay for a new pool cover, but I will accept it to avoid the
unpleasant and time consuming court processIf you don’t refund the
money by June 30, 2017, I will be suing you for whatever it cost to fix the pool, replacing the damaged winter cover and my attorney fees.I look forward to your timely response.Sincerely,*** ***PS:

we were shocked to find that the gel-coat (top and side surfaces) are
imbedded with dirt and other stains, and have impressions from cover and
associated hold down strapsEven when using a psi pressure washer
and strong cleaning solution the stains won’t come off and look
horribleIt’s evident that the gel-coat didn’t cure properly and has
dirt and plant particles imbedded that didn’t come in contact with pool
for several months after closing itWe waited a week after your last
round of repairs before closing, winterizing and covering the pool for
the winter, so there was plenty of time for gel-coat to cure and no
obvious signs of a problem or we would have contacted you before closing
it.The
attached pictures were taken after power-washing and scrubbing with a
citrus based degreaser and concentrate cleaner on one corner to see if
anything not removed by power-washer could be taken offThe cleaner
didn’t remove anythingPlease see the attached pictures of how it looks
after power washingIt’s apparent there was a problem with the
gel-coat not hardening properly and now the only way to fix it is to
sand it all off and start overIn addition to the pool looking
horrible, the gel-coat has also transferred to the winter cover and it
may now scratch the surface after we repair it, so we will probably need
to buy a new pool cover too(approxcost $1500.00) I
am writing you now to give you one last chance to make this rightBy
making it right I mean to sand this mess off and redo the gel-coat to
look like the surface did prior to the work you didThe completed
surface should be even smooth and shiny like the rest of the pool, with a
slight amount of texture on the top of coping to make it less slippery
when wet…(like it was before you made this mess of it)All we wanted
you to do was remove the surface cracks in the gel-coat and now we have a
huge mess that is going to have to be fixedIf
you are unable or unwilling to fix this pool as I have described above,
I am demanding a full refund of the $I paid you to do this job,
because we are worse off now that before you touched itIt
actually looks worse in person than it does in the photos I’ve attached
If you want to come and see this for yourself, please call me to make
arrangementsDo not show up at my house unannounced or do any
inspections or work to the pool until contacting mePlease consider this email your formal notification, that if we don’t hear from you within week, we will consider Fiberglass by Lehman, LLC non responsive and begin taking the necessary legal action to recover damages.Sincerely,*** *** *** *** **StCharles, MO 63303PS: Copy also being mailed today

Fiberglass By Lehman was hired to fiberglass over badly cracked coping, then lower pool water to roll apply gel-coat below the waterline. Job was completed in a timely manner and owners were very happy. They said it looked great and paid the contracted amount in full. A week later
the homeowner called and said that he knew I had fulfilled the contract to the letter but there were some minor problems he would like corrected. I told him that if he wasn't pleased I would be happy to come back and rework the job at no cost. I fixed the issues requested and the home owner asked if they could get a heavy non skid coating around the pool. I completed the additional a items at no charge. Customer said they were happy and I left. I was called back later with the customer saying it was too much texture. I once again went over and reworked the job at no cost to the customer. Customer was happy and I left. This spring I received an email that the customer was unhappy because the gel-coat was stuck to the pool cover and not cured properly. Went to customers home again and the gel-coat wasn't cured. The gel-coat I had left over had cured fine but I called the supplier and there were no issues they were aware of. I am not sure if the customer put something over the gel-coat or not. I once again offered to fix the pool at no charge. The customer said the only thing that would satisfy him was a full refund of amounts paid by June 30. The next day I received notification of this complaint. I will forward the chain of email regarding this issue.*** ***

Complaint: [redacted]
I am rejecting this response because: Once again [redacted] is wrong about the timeline and number of times this pool was repaired. There was no subcontractor, just [redacted] and his son. They did a terrible job that I was very angry and upset with, then after I complained they did a half hearted repair job once, and they didn't do it correctly. The sanding job was terrible and looks like a grinder was used, the texture of the gel coat looks like someone smeared on mayo with broom, but ;since it never cured it now looks even worse and is still embedded with dirt, plants and the fabric and strap pattern of the winter cover that is also ruined. In a word it looks HORRIBLE. Since the discovery of the uncured gel coat when pool was opened on [redacted], I have spoken to numerous people about fixing this mess and discovered that [redacted] has done this type of work to several other people, and even the local pool supply company will no longer recommend him because of numerous complaints. [redacted] doesn't accept responsibility for this mess, but says he will fix it again. I have lost all faith in [redacted]'s desire or ability to fix my pool correctly and I don't want him to ever touch it again, because it will just cause more damage that I will have to pay someone else to fix. The only thing I want or will accept from Fiberglass by Lehman LLC is a full refund.
Sincerely,
[redacted]

I returned 4 phone calls to people today that said they were referred to me by [redacted] pool supplies, but the customer filing this complaint says [redacted] is no longer referring customers to me. He is a not telling the truth about any of the job I did for him, he is a scammer trying to get something for nothing. Please help me get this to the complaint department. Thank You[redacted]
